RESOLUTION NO. PZ98-2
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE 6 (SIX) FOOT REAR LOT UTILITY
EASEMENT AND A PORTION OF THE 8 (EIGHT) FOOT SIDE LOT ACCESS,
UTILITY AND DRAINAGE EASEMENT DEDICATED ON LOT 19 OF THE
COURTYARDS AT MIRAMONT PUD, SECOND FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of Lot 19 of the Courtyards at Miramont PUD, Second Filing
has requested that the City vacate a portion of the 6 (six) foot rear lot utility easement and
a portion of the 8 (eight) foot side lot access, utility and drainage easement dedicated on
Lot 19 of the Courtyards at Miramont PUD, Second Filing and more particularly described
below; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that: a portion of the 6 (six) foot rear lot utility easement and a portion of the
8 (eight) foot side lot access, utility and drainage easement dedicated on Lot 19 of the
Courtyards at Miramont PUD, Second Filing more particularly described as follows to wit:
That portion of Lot 19, Courtyards at Miramont PUD, Second Filing, in the
City of Fort Collins, Larimer County, Colorado, being more particularly
described by the following boundary lines:
Commencing at the Southwest corner of said Lot 19; thence N 19°20'32" W
26.42 feet; thence N 70039'28" E 2.92 feet to the TRUE POINT OF
BEGINNING; thence N 70°39'28" E 5.08 feet; thence S 19°20'32" E 20.42
feet; thence N 70039'28" E 18.84 feet; thence S 19°20'32" E 2.08 feet;
thence S 70039'28" W 23.92 feet; thence N 19020'32" W 22.5 feet to the
POINT OF BEGINNING, containing 153 square feet, more of less.
be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins, held this 15th day of January A.D. 1998.

VACATING A PORTION OF AN ACCESS, UTILITY AND DRAINAGE EASEMENT
LOCATED ON LOT 23 OF COURTYARDS AT MIRAMONT PUD, SECOND FILING
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins
authorizes the Director of Community Planning and Environmental Services to vacate
certain easements by resolution or by approval of replats containing notation of such
dedication; and
WHEREAS, the Owner has requested that the City vacate a portion of an
access, utility and drainage easement on Lot 23 of the Courtyards at Miramont PUD,
Second Filing, more particularly described on Exhibit "A"; and
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments, which departments report no objection to the vacation.
NOW, THEREFORE, be it resolved by the Director of Planning and
Environmental Services of the City of Fort Collins, that a portion of the access, utility and
drainage easement on Lot 23 of the Courtyards at Miramont PUD Second Filing, and
more particularly described on Exhibit "A", attached hereto and incorporated herein by
this reference, is hereby vacated.
