DEED OF DEDICATION FOR EASEMENT
(Spring Creek #3 - Slope Easement)
KNOW ALL MEN BY THESE PRESENTS: That the undersigned, SPRING
CREEK FARMS LIMITED LIABILITY COMPANY, a Colorado Limited Liability
Company, in consideration of Ten Dollars (SI0.00) in hand paid, receipt of which is
hereby acknowledged, and other good and valuable consideration, does hereby dedicate,
transfer and convey to the CITY OF FORT COLLINS, COLORADO, a Municipal
Corporation, the mailing address of which is Post Office Box 580, Fort Collins, Colorado
80522-0580, for public use, forever, a non-exclusive, permanent slope easement over,
across and upon the real property legally described on Exhibit "A-l" and depicted upon
Exhibit "A-2" attached hereto and incorporated herein by reference.
The above described easement shall grant to the City of Fort Collins the perpetual
right to enter upon said easement at any time and to place adequate soil to provide and
maintain lateral support and proper drainage grade for public improvements along Drake
Road consisting primarily of paving, curb, gutter and sidewalk construction. The City, its
successors, contractors or assigns, and its agents and employees, shall have full right to
enter upon said easement to survey, construct, repair, remove, replace, reconstruct,
inspect, improve and maintain a suitable slope or grade which will provide the above -
mentioned lateral support and proper drainage grade, provided, however, that the ground
surface shall be restored to its prior condition after disturbing the same.
It is understood by the undersigned that, by acceptance of this dedication, the City
of Fort Collins will not accept the duty of maintenance of such easement.

KNOW ALL MEN BY THESE PRESENTS: That the undersigned, SPRING
CREEK FARMS LIMITED LIABILITY COMPANY, a Colorado Limited Liability
Company, in consideration of Ten Dollars ($10.00) in hand paid, receipt of which is
hereby acknowledged, and other good and valuable consideration, does hereby dedicate,
transfer and convey to the CITY OF FORT COLLINS, COLORADO, a Municipal
Corporation, the mailing address of which is Post Office Box 580, Fort Collins, Colorado
80522-0580, for public use, forever, a non-exclusive, permanent slope easement over,
across and upon the real property legally described on Exhibit "A-1" and depicted upon
Exhibit "A-2" attached hereto and incorporated herein by reference.
The above described easement shall grant to the City of Fort Collins the perpetual
right to enter upon said easement at any time and to place adequate soil to provide and
maintain lateral support and proper drainage grade for public improvements along
Environmental Drive consisting primarily of paving, curb, gutter and sidewalk
construction. The City, its successors, contractors or assigns, and its agents and
employees, shall have full right to enter upon said easement to survey, construct, repair,
remove, replace, reconstruct, inspect, improve and maintain a suitable slope or grade
which will provide the above -mentioned lateral support and proper drainage grade,
provided, however, that the ground surface shall be restored to its prior condition after
disturbing the same.
It is understood by the undersigned that, by acceptance of this dedication, the City
of Fort Collins will not accept the duty of maintenance of such easement.
