OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE DRAINAGE EASEMENT DEDICATED
ON THE BOSTON CHICKEN AT LEMAY AND PENNOCK, PUD
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of the Boston Chicken at Lemay and Pennock, PUD has
requested that the City vacate a portion of the drainage easement dedicated on the Boston
Chicken at Lemay and Pennock, PUD and more particularly described below; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that a portion of the drainage easement dedicated on the Boston Chicken
at Lemay and Pennock, PUD more particularly described as follows to wit:
A part of an 80.00 foot drainage easement situate in Lot 1, Boston Chicken
at Lemay and Pennock, PUD, City of Fort Collins, County of Larimer, State
of Colorado which begins at a point on the West line of the said drainage
easement which bears N 89054'00" W 80.03 feet and again N 01 °40'57" E
41.00 feet from the Southeast corner of said Lot 1 and run thence N
01 040'57" E 66.03 feet; thence S 89°54'00" E 18.18 feet; thence S 00006,00"
W 66.00 feet; thence N 89°54'00" W 20.00 feet to the point of beginning.
be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins held this 15th day of January A.D. 1998.

SERVICES OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE 80 FOOT DRAINAGE EASEMENT LOCATED ON
LOTS 1 AND 2 OF BOSTON CHICKEN AT LEMAY AND PENNOCK P.U.D.
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins
authorizes the Director of Community Planning and Environmental Services to vacate
certain easements by resolution or by approval of replats containing notation of such
dedication, and
WHEREAS, the Owner has requested that the City a vacate portion of the 80 foot
drainage easement on Lots 1 and 2, Boston Chicken at Lemay and Pennock P.U.D.,
more particularly described on Exhibit "A", and
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments, which departments report no objection to the vacation.
NOW, THEREFORE, be it resolved by the Director of Planning and
Environmental Services of the City of Fort Collins, that a portion of the 80 foot drainage
easement on Lots 1 and 2, Boston Chicken at Lemay and Pennock P.U.D., and more
particularly described on Exhibit "A", attached hereto and incorporated herein by this
reference, is hereby vacated.
Passed and adopted by the Director of Community Planning and Environmental
Services of the City of Fort Collins this I Sr day of November 2005.
