This letter is to clarify our phone conversation of March 10, 1988.
Staff has reviewed the requst to replat Lots I - 7, Block One, Fairbrooke
Subdivision Third Filing. The following comments should be considered and
shown accordingly on the final mylars:
1. Please address, in writing, that the replatting will not affect the drainage.
If drainage is affected, then the utility plan and drainage report must be
revised.
2. Staff is concerned about the condition of Ccdarwood after utility cuts arc
completed and the utilities are installed. Cedarwood is a newer street that
was built by a Special Improvement District and the number of proposed
utility cuts will affect the life and appearance of the street. The utility
plans must be revised to state that after all utility cuts are made,
Ccdarwood will be overlaid to City specifications from the northwest
portion of the property to Hampshire Road.
The basis for the timing of this improvement is found in Section 29-679 of the
City Code which pertains to required improvements being installed prior to
issuance of a Certificate of Occupancy for lots in this replat.
Consequently, it will be necessary to revise the existing Utility Plan for
Fairbrooke Third. Subdivision. Such a revision will take the form of a note on
the appropriate sheet that states the treatment of Ccdarwood shall be overlaid
after the utility cuts have been completed and the utilities installed. It will not
be necessary to amend the existing Development Agreement.
