RE: Subdrain Connection at Fairbrooke Pond
Dear Don:
This letter is to document our of Augu:,L ij, 19"6 in reference
to the subdrain connection at Fairbrooke Pond.
The approved utility plans for Fairbrooke require a signed agreement with
Mr, Michael and the City. Since this has not been obtained, the City is
allowing the subdrain for the development to discharge to the surface swale
along the west: and north side of the Fairbrooke Pond. The discharge from
the subdrain must be clear water. This is being permitted as a temporary
construction measure.
Meanwhile, to finalize the subdrain it will be necessary to obtain the
agreement with Mr. Michael, the City, and the developer, and tie into the
subdrain. If an agreement is not obtained, a revised utility plan will be
required.

Re: Street and traffic signs in the Fairbrooke 1st, 2nd and 3rd
Dear Mr. Developer:
My office has been informed by Dick Wartenbe of the City Traffic Department
that the signs installed in the Fairbrooke 1st, 2nd, 3rd Developments are
substandard and do not meet the City's criteria for signs. Dick has talked
with your sign contractor, Rocky Mountain Safety Services, and was not
satisfied with their response. Therefore, as the developer of this
project, it is your responsibility to the City that your sub -contractors
provide acceptable products and work. Please be informed that until such
time as the signs are brought up to the City standard, Certificates of
Occupancy will not be issued for any structure within this development.
If you have any questions regarding specific corrections to the signs in
this development, please contact Dick Wartenbe at 221-6815.

Re: Fairbrooke 2nd Filing
Dear Mr. Neal:
The intent of this letter is to clarify and expound upon our telephone
conversation of February 26, 1987. The City Engineering Department will
accept an irrevocable letter of credit in lieu of a cash escrow to cover
the cost of the uncompleted street improvements for Fairbrooke 2nd Filing.
Please be informed that such letter of credit shall be in an amount
sufficient to cover the remaining street improvements to Coventry Court,
Hinry Street and Cedarwood Drive, plus fifty percent (500). In order to
facilitate our evaluation of the amount established by your engineer,
please submit: an itemized cost estimate for the work to be covered under
this letter of credit.
After our conversation a visual inspection of this development was made to
determine the condition of the existing roadbase material. The condition
of the base cover material is questionable and may need to be removed and
replaced prior to the installation of the asphalt pavement. A final
determination of its suitability and the condition of the subgrade will be
made by the City inspector when the construction work resumes.

ENGINEERING
In an effort to provide Certificates of Occupancy for homes within this
development, the following list of conditions are to be utilized prior to
and during the street construction:
A. Coventry Court, Hinry Street and Cedarwood Drive will be maintained by
Wheeler Realty at their expense until the streets have been fully
constructed and accepted by the City.
B. Prior to the release of any Certificate of Occupancy for this
development, an acknowledgement of maintenance responsibility is to be
signed by the property owner of each address requesting the C.O. and
submitted to City Engineering (draft copy attached).
C. It is important that vehicular access is provided throughout all phases
of construction.
D. No building materials, trash or construction debris is to be stored or
placed within the public right-of-way.
When the City Engineering Department has received a letter of credit for
the street improvements and the property owners' acknowledgement for
maintenance, Certificates of Occupancy will be processed.

Re: Fairbrooke II Subdivision Subdrain
Dear Mr. Cochran.
Currently, the Fairbrooke II Subdivision has been issued 16 building
permits. According to our discussions and written correspondence, the
subdrain issue must be finalized prior to the issuance of 2.8 building
permits. I have left numerous telephone messages with your office in order
to contact you or the proper individual who can help resolve this matter.
With the addition of the Fairbrooke II subdrain flows, an additional
system is required to carry the flow to the ponds on the east side of Taft
Hill, Approximately 807. of the line is installed and the City has
developed the preliminary engineering for the rest. We proposed that the
Fairbrooke II Subdivision be involved with the construction of the
remaining portion of the subdrain system. Also, we intend to proceed with
signing of the three party agreement to allow the connection of the
subdrain.
Please contact me so this issue can be resolved without impacting your
development schedule. I can be reached at 221-6589.

As per our phone conversation of June 6, 1988, the City of Fort Collins
Engineering Department requires that the water service line at 2331
Cedarwood be relocated to allow the 10-foot minimum clearance from the
sanitary sewer service at the same address.
This problem was discovered May 13 while repairing a broken section of pipe
in the sanitary service. Verbal notice was given to George Hall on that
date and as yet no action has been taken to correct this situation. Your
cooperation in this matter will be greatly appreciated.

In response to your letter dated June 7, and pursuant to
our telephone conversation, this morning, Hall -Irwin has code
to the folJ_owing agreement with fir. Dave Clarkson, of Fair -
brook Development Co
The f 'I.re hydrant at 1707 Coventry Court is 12 inches too
high due to a street grade change. Mr. Dave Clarkson has
agreed to pay Hall -Irwin to lower the hydrant. As per our,
telephone conversation, this morning, the installation of a
nuw fire hydrant with a 4' 5arrell will be an acceptable
method of Im"'ering. Hall -Irwin will lower the fire hydrant
within 48 hours, after receipt of monies fron Mr. Dave
Clarkson.
Relocation of the dater service line at 2331 Cedarwood Dr:
Responsibility in this natter has not been determined.
Although Hall-Irwin's warranty period has expired we have
agreed to relocate the water service contingent upon the
follm,iing; Mr. Dave Clarkson will pay all_ past due accounts.
Mr. D,.ve Clarkson will take out the street cut permit, Mr.
Dave Clarkson will schedule and pay for all asphalt and
concrete repair. Hall -Irwin will relocate the water service
within 48 hours after the aforementioned conditions are not.
