Evergreen Park Third Filing.
Gentlemen:
We are a general partner of Evergreen Park 2, a Colorado gen-
eral partnership, which is the developer of Evergreen Park, a
commercial and residential subdivision located in the City of
Fort Collins, Colorado. The Poudre Valley REA currently has
overhead electrical transmission lines running through an
easement granted to the Bureau of Reclamation across the
center of the southernmost lots in Evergreen Park Third Fil-
ing. Arrangementshave been made with the Bureau of Reclama-
tion to vacate that easement.
The Poudre Valley REA has agreed to relocate its transmission
lines in accordance with the right-of-way plat, Poudre Valley
REA, Evergreen Park Third Filing, dated February 6, 1978,
prepared by Miner and Miner Engineers, Greeley, Colorado,
provided that: (a) Evergreen Park 2 pays the costs of reloca-
tion; (b) the City of Fort Collins has no objection to the
relocation of the transmission lines in accordance with the
above -referenced right-of-way plat; and (c) the City of Fort
Collins agrees that it will not contend that its Ordinances
No. 57 and 581 1977, apply to the Poudre Valley REA as a re-
sult of such. relocation if such Ordinances do not otherwise
apply.
Please confirm by your signature hereon that you have been
authorized by action of the City Council of the City of Fort
Collins, at a meeting of Council on March 21, 1978, to agree
to the conditions set forth in (b) and (c) above.

Re: Public Improvements
Evergreen Park Subdivision

This letter will confirm my conversation with you in which I advised
you that the remaining public improvements to be made in the above
captioned subdivision will continue to be scheduled as rapidly as new
development will permit.
We have, as you know, paid for the masterplan drainage study for the
Evergreen Park basin and have begun already to implement this plan.
We will, as soon as possible, complete the open ditch from Willox Lane
to pond #3 'located behind Block 5 and will, this Summer, complete the
shaping of i=his pond together with inlet and outlet structures. In
addition, an overflow open ditch channel will be provided to the south
to the prel'minary excavation of pond #5. The open ditch channel
draining the Evergreen Park 3rd Filing into the pond at the Lemay Street
side of the property will be completed as soon as possible. Weather
permitting, work will be commenced in the next few days.
We have commenced procedure for updated bids to complete the paving of
Conifer Street from Redwood to College Avenue and expect to be able to
contract for the completion of that work during the Summer.
In the balance of the first filing, including Sundance Hills and Coach-
liaht Plaza, we expect the completion of final improvements to be made
on a phase by phase basis as development continues and buildings are
completed,
Evergreen Park has no legal right or obligation to make any improvements
in Evergreen Park 2nd Filing other than perimeter streets and mainline
utilities. All other improvements are to be made by the owner and
developer o-' this property, Ivan Giroux.
believe this letter addresses each of the items agreed to be important
on an immediate basis. The other improvements and their final completion
will be determined by mutual agreement pending the development of
Greenbriar Subdivision on the northeast, the shopping center site on the
northwest, the Lemay Street drainage plan on the east and the approval
for culverts on Lake Canal and the Dry Creek area on the south. It is
difficult to be specific about development plans in a year when interest

rates have gone from 10% per annum to over 20% per annum, virtually
halting all new construction. We are of the opinion with any
co-operation from the financial markets, the general economic recovery
of the economy and a reasonable sales program that this project should
'De able to completed during the next three years.

specific conditions and continue to pledge the spirit of co-operation
in meeting the development criteria for this project with the City of
Fort Collins.

This letter is to recap our conversation of Friday, May 22, 1981
concerning the Evergreen Park, 3rd Filing, Subdivision.
As you are aware, the developer for this filing is now in the
process of constructing the required storm drainage system.
The City will now require the closure of the temporary retention
ditch which was constructed for the building units at 1201 and 1207
Renegade Court.
In order to avoid any conflict with the drainage, the ditch should be
filled in conjunction with the overall drainage system for this
subdivision.

Dear Mr. Engemoen:
Thank you for your patience and efforts regarding your testimony
in the referenced case. I believe that your testimony contributed
significantly to the verdict which was rendered by the jury. I
am sure you will be at least interested in knowing that the jury
returned a verdict in favor of Richard Pitner in the amount of
$50,000 for actual damages and an additional $65,000 for punitive
damages. The verdict was against the partnership known as
Evergreen Park 2, Archie Wainwright and Lyle Carpenter.
That portion of the verdict relating to the $50,000 was to
compensate Mr. Pitner for the losses he experienced by reason of
Evergreen Park's delays. The $65,000 was an award to Mr. Pitner,
not to compensate him, but rather "as a punishment to the defendants
and as a warning to other wrongdoers". I have been told that the
punitive damage award is one of the largest punitive damage awards
given in Larimer County and, as I stated above, I believe the reason
for the award stems, in part, from your helpful testimony.
I again thank you for your time and diligence in going through the
records and making yourself available and cooperative in this case.

This letter is to summarize our meeting on the 18th of May between
yourself, Mauri Rupel, and myself regarding storm drainage in Evergreen
Park. In particular, two items were discussed which were:
1. Alteration of the gradation of the Rock Trickle Channel
as shown in the detail on sheet 2/9 of the plans titled
"Major Storm Drainageway for Evergreen Park."
2. The effect of leaving the nisting power pole as exists
within - the limits of Pond OA as shown on sheet 7/9 of the
plans titled "Major Storm Drainageway for Evergreen Park."
The gradation of cobbles originally specified on sheet 2/9 called for
an average size of 12" equivalent diameter stones. As shown in our
meeting, a reduction to a 6" D50 gradation of cobblestones will be ade-
quate for the velocities in the channels as designed. An approximate
gradation is as follows:

This change in gradation applies only to the Trickle Channel as an
option to the Concrete Trickle Pan Locations. Also, as shown on the
attached detail A, the channel sideslopes will be extended over the
edges of the rock pan to minimize problems due to vandalism.
It is desired by the developer not to relocate the existing power
pole within Pend #OA adjacent to Conifer Street. As shown in the attached
detail B, the pole, guy wire, and access way were left at existing grade
to determine what storage volume would be lost. A top width of 15 feet
and 4 to 1 side slopes were used as the requirements for the peninsula
into the pond. This peninsula reduces the volume of the pond below the
100 W.S. elevation of 4955.3 by 6900 C.F. In evaluating the available
volume on the pond as exists, as -built elevations taken in Conifer Street
indicate an additional 5600 C.F. of available storage at the 100 year
water surface elevation of 4955.3. The resulting loss of volume of
1300 C.F. is equal to a rise in the 100 year water surface elevation of
0.0093 feet. This information is shown in Table A. Therefore, the
power pole and access way can remain within the limits of Pond #OA with-
out any notable adverse affects to the ponds operation.

Also regarding Pond #OA, it is yet to be determined whether the pond
will be graded according to contours shown on sheet 7/9, or be over
excavated to form a permanent pond below the outlet elevation. I
understand that we will be required to provide proposed contours and
additional information as necessary should a permanent pond be desired.

Dear Mauri:
This letter will confirm our brief telephone conversation in which
I advised. you that our engineer, Donald Parsons of Parsons &
Associates, requested that I write you a letter agreeing to author-
ize the engineering of the realignment of Redwood Street as it crosses
Lake Canal proceeding toward vine Drive to intersect at existing
Linden Avenue. It is our understanding that the City has requested
this realignment for the purposes of creating a collector road system
to alleviate traffic flow on Lellay Avenue and that the engineering
cost will be paid for by the City of Fort Collins.
It is our further understanding that the City desires to reduce the
Redwood right-of-way from 80 feet to 50 feet. If that change is to
be made it is imperative that an agreement be reached in the
immediate future as our engineer and Gefroh & Associates are submitting
to the City for conceptual review a residential subdivision lying east
of Redwocd, south of Evergreen Park 3rd Filing and North of Lake Canal,
on Monday June 14, 1982 with plans to proceed immediately to prelim-
inary subdivision and final plat. Since there is existing curb and
gutter, there will be a sizeable expenditure for removal and replace-
ment. I will hope we can discuss both of these matters at a meeting
to be scheduled by you in the near future.

This letter is to follow-up on our conversation on the 29th of June
reaardinq the construction of Ponds #OA and #OB as temporary retention
Ponds in the Evergreen Park area. These ponds are some of the storm
drainage improvements recommended in the "Major Storm Drainageway for
Evergreen Park" study of the City of Fort Collins. The ponds will
temporarily operate as retention ponds until such time as the Green -
briar outfall improvements provide a positive outfall location.
At present, Pond #OA is over -excavated to an elevation of approximately
4950+. This elevation corresponds -to the high ground water elevation
encountered this spring. Additional work will be done to Pond #OA
which will include the dressing up of the perimeter slopes to the
designed 4:1 slope and grading of the bottom to provide a smooth uniform
surface. Because of the over excavation, Pond #OA provides additional
retention capacity of approximately 7± ac. ft. This is based on the
difference between the contours shown on sheet 7/9 of the "Major Storm
Drainageway for Evergreen Park" plans and the high ground water eleva-
tion of 4950-.
As originally designed, Pond #OB provides additional retention capacity
for accomodating over -flow from Pond #OA. Because of the additional
capacity in pond #OA, Pond #OB can be reduced in size from 9.5 ac. ft.
to 2.5 ac. ft. This resulting volume required can be accomodated in
Pond #OB by excavating to an elevation of 4954.2. The top of water
elevation of 4955.0, which is called out in the Evergreen Park Drain-
ageway study, will be maintained.

[n addition to these items, it was agreed that the concrete trickle
channel inlet from the curb outlet in Conifer Street to Pond #OA would
be replaced with the 6' riprap alternate shown on sheet 2/9. The
gradation of this alternate will conform to that specified in our letter
to you dated May 21, 1982.

Gentlemen:
We have recently reinspected the Third Filing of Evergreen Park Subdivision,
specifically with regard to the two buildings constructed by Mr. Pitner. In
order to obtain engineering releases for certificates of occupancy for these
structures, the completion of the following public improvements is required:
(1) road base at least four inches (4") in depth must be placed in the
Muddler and Sugarpine cul-de-sacs after the subgrade has been shaped
to a reasonable grade;
(2) additional road base may be required on Conifer between Muddler Court
and Lemay in those areas where the City engineering inspectors determine
the existing roadbase is too shallow or has been disturbed or displaced
by local construction;
(3) barricades must be placed in the southern ends of both cul-de-sacs
where curb,, gutter, and sidewalk have not been installed pending
completion of drainage structures; and
(4) the Developer Host submit a letter to the City Engineer stating the roads
providing access to these structures will be paved as soon as the weather
permits it,.
All of the above work is subject to the inspection and approval of the Public Works
Department of the City. It should be understood that because the subgrade in the
cul-de-sacs cannot be properly shaped and compacted at this time, the roadbase
installation is a temporary measure. These streets must be stripped and reworked
when weather permits to insure compliance with City specifications.
Finally, please note that no additional building permits shall be issued by the City
for structures within the Third Filing of Evergreen Park Subdivision prior to the
completion of the detention facilities as indicated in the subdivision agreement
for this developmant.

Dear Bob:
This letter is to update you as to the status of Ponds #OA and #OB in
the Evergreen Park Third Filing area. As described in my letter to
you dated June 30, 1982, these ponds will function as temporary
retention ponds until a suitable outlet is available. In that letter,
Pond #OA was to remain at the existing depth with the bottom of the
pond being leveled out to provide a smooth uniform surface. The per-
imeter of the pond was to be graded to a 4:1 slope according to the
...contours shown on Sheet 7/9 of the "Major Storm Drainageway for Ever- I
green Park." Also, Pond #OB was to be excavated to an elevation of
4954.2 to provide additional overflow retention capacity.
The above described work has been substantially completed as of this
date. The remaining excavation and grading work to be completed is
shown as the cross -hatched area in Detail B. Also, the bottom of
the pond has not been graded due to groundwater. The perimeter berms
have been graded to above the maximum highwater elevation and will
be brought to the final grades according to the plans when the
ponds and outlet are ultimately completed.

The purpose of this letter is to confirm in writing the discussions which took
place at the Fort Collins Municipal Building on November 29, 1983, regarding
Lots 1H and 19, Evergreen. Park Subdivision, Third Filing. As you know, I
represent Mr. and Mrs. Wilbur D. Babcock, who are the owners of said Lots.
At this meeting, the following was discussed:
1. Lt is the position of the City that before a Certificate of Occupancy
would he issued with respect to any improvements constructed on Lot 19, the
owners of Lot 19 would be required to enter into an agreement in form
acceptable to the City, acknowledging responsibility for one-half the expense
of improving that portion of Lemay Avenue which extends along the easterly
boundary of Lot 19 (222.55 feet), including curb, gutter, sidewalk, and asphalt
pavement. The remaining one-half of said expense would be the responsibility
of the owner of the real estate on the east side of Lemay Avenue.
2. The City would require that said improvements be completed within five
years. Within said five-year period, the owners of Lot 19 could endeavor to
establish a special improvement district under the ordinances of the City of
Fort Collins, thereby financing the cost of improving Lemay Avenue over a ten -
to twenty-year period of time.
3. The owners of Lot 19 would also be required to install sidewalk along
the northerly boundary of Lot 19 (134.97 feet along Conifer Street).
4. With respect to Lot 18, improvements could be constructed and occupied
without liability for the improvement of Lemay Avenue. However, a sidewalk
would also need to he installed along the northerly boundary of Lot 18.

Dear Mr. Carpenter:
In a letter from this office dated September 30, 1983, you were
given notice to remove weeds and rubbish which had accumulated in
Tract C of Evergreen Park, 3rd Filing, and were allowed 15 days'
time to comply. Upon your failure to do so, the City of Fort Collins
caused such work to be done at a total cost of $113.66 (see attachments).
I have assumed that this is precisely the course you wished to take,
given the inconvenience associated with making arrangements for such
removal from your Denver office.
A check from you for $113.66 will resolve this matter quickly and simply.
However, I :am compelled to withhold all future building permits in
Evergreen Park, 2nd Filing, until this amount is paid so that the
City's interests are fully protected.

Dear Mr. Carpenter:
It has been brought to my attention recently that young children are
swimming in a detention pond located in Tract C of Evergreen Park,
3rd Filing, a detention pond your company is responsible to maintain
until it is completely installed and has been formally accepted by the
City of Fort Collins for future maintenance. As you may already know,
there is currently no outlet for this pond, so that it simply fills up
with more stormwater and groundwater which has no escape. According
to a nearby resident, the water is approximately neck -high on an
eight -year old.
I bring this matter to your attention because I assume you will be
concerned about possible liability and may wish to take some
precautionary measures to address this safety issue (such as installing
warning signs, etc.)

Re: Detention Pond in Tract C, Evergreen Park, 3rd Filing
Dear Mr. Carpenter:
The Larimer County Weed District has given notice to the City of Fort
Collins, as owner of the property referenced above, to control noxious weed
growth on this site. Until the detention pond is completed and accepted by
the City for perpetual maintenance, current maintenance is the
responsibility_ of your company, as developer, per the development
agreement.
I have arranged for an extension of another 10 days (until July 11) to
allow you time, to comply, at which time the County will arrange to have the
weeds controlled and will bill you for 100% of the cost. Failure to pay now
will only add to the costs to be cleared up later when the City is asked to
accept the pond for perpetual maintenance. Please have your local property
manager make arrangements to control the weeds.

ing permits for structures within the Third Filing as requests
for such permits are made through the building inspection
department. Please make every effort to complete the
installation of the remaining improvements before requesting
certificates of occupancy for these structures.

Dear Mr. Carpenter:
I contacted Air. Jim Byrne of Poudre Valley Rural Electric Association and
Mr. Bob Kost of the City's Light and Power Division, After our meeting
of Tuesday, December 1S, 1979, concerning the power pole belonging to
PVREA which is located within the detention pond for Evergreen Park, 3rd
Filing, Mr. Byrne stated that he would be happy to give you an estimate
of cost and time for relocating the power pole to within the easement you
provided for that purpose upon written request from yogi.
Mr. Kost and I visited the site and agreed with Marc Engemoen that the
hest interest of all parties would be served by moving the pole from within
the detention pond.
The rat-_iag of the water vZves aad manholes in the in and and filings of
Evergreen is a very serious matter as referred to in Mr. Zakely's letter
of October 26, 1979, and reiterated in Air. Stringer's letter of December 12,
1979. We have no alternative but to hold any further certificates of occupancy
on these filings until these :items are completed. We trust you understand
our position and will see that these problems are corrected forthwith.

Dear Mr. Carpenter:
Pursuant to our meeting of Tuesday and as a follow-up to my letter of
Wednesday, the 19th, our Storm Drainage Engineers have tried to piece
together the various storm drainage studies and plans which have been
submitted on the referenced subdivisions.
The Storm Drainage Engineers have also reviewed the studies which were
prepared by another developer for the proposed 4th and 5th Filings of
Evergreen Park as well as the subdivision to the northeast (Greenbrier
P.U.D.).
The Storm Drainage Engineers have concluded that the original drainage
design for the First Filing is inadequate by todays standards. Due to
the fact that the facilities for the First Filing have never been
completed, no additional building permits within this Filing will be
permitted until adequate acilities afire esi� ai�constructe_cT. In
Filing No. 2, building permits and C.O.'s will be permitted at the
presently relatively slow development rate within Watershed No. 1 (the
east portion). However, due to the fact that Watershed No. 1 (the west
portion) has no suitable storm water outlet, no building permits will
be permitted there until suitable facilities are constructed for that
portion of Filing No. 2. Building permits for lots 18 and 19 in Filing
No. 3 will be permitted when the addendum to the subdivision agreement
is signed and an arrangement is made for the completion of the detention
pond within Filing 3.
Mr. Carpenter, in view of all the drainage questions within Evergreen
Park and its drainage basins, we suggest that you arrange a meeting with
our Drainage Engineers, you and your engineer to compile all the existing
studies into one master study for your area which will meet the City's
needs.
Please contact Bob Smith or Marc Engemoen at your earliest convenience to
arrange the meetinq.

The subject subdivision has been a difficult one to maintain
any semblance of orderly development since its inception in
the mid 701s. Conversely, it is an area which the City has
tried to encourage development to try to slow the "trend
to the south".
We are having extreme difficulties trying to get the Developer
to answer telephone calls or respond to correspondence.
He has sold lots to builders who have built homes and/or
dwelling units, some of whom we have had to withhold certificates
of occupancy due to lack of completion of improvements within
the public right-of-way. The builder is the "scapegoat" in
that he is led to believe the Developer will complete the
improvements in time for him to get a certificate of occupancy
and our building and construction inspectors are really put
"on the soot" since the only enforcement tool we have is the
building permit or certificate of occupancy.
Due to lack of completion of improvements, (listed on attached
sheet) we have shut-off certificates of occupancy in Filings
1, 2 and 3. This has caused severe financial hardship on some
builders and our building and construction inspection departments
are under severe criticism for "doing their job".
Can you exert any pressure to require the Developer to either
complete his obligations or come in to negotiate revised
agreements so that our inspection departments can perform
their duties while still maintaining some semblance of order?

Dear Morey:
This letter will confirm our telephone conversation of yester-
day in which I advised you that Evergreen Park 2, a partner-
ship has agreed to guarantee paymentof1000 of the drainage
study currently in process by Engineering Professionals. As
I advised N70u, we entered into the contract for that work
approximately a month ago and are advised by Michael Schmidt
of that firm that the work is approximately 50% complete.
We understand that one of the parties has not signed the
agreement. We trust our agreement to cover their share will
satisfy you as to completion of the study with the under-
standina that Evergreen Park 2, a partnership will expect to
be reimbursed by the other parties benefiting from this
study at such time or times as they come to the city for
approval for construction or development.
