Cedarwood Drive. Could you please let me know as soon as possible when this
is scheduled for repair. I will pass the information along to the callers.
If you could send me copies of cut permits, it would save us time investigating
trench cuts. I know we have talked about this earlier, but if it can still
be arranged, it would be appreciated.

Dear Jack,
I have received numerous complaints on the sewer trench on Prospect Road
at Cedarwood Street. As you remember, this street cut was done in
February and patched with cold mix asphalt. This temporary patch has
deteriorated and some settling of the trench has occurred.
This temporary patching should be replaced now with a permanent hot mix
asphalt patch, as per City specifications. Thank you in advance for your
prompt attention to this matter. Please notify me at least 24 hours
in advance of this work.

Dear Jack:
I had occasion to visit the job site last Friday and noticed the
anticipated ground cover growth has not occurred in the areas where
considerable stripping occurred early in the construction phase of
Fairbrooke Special Improvement District.
I would suggest that either supplemental planting of a good ground
cover or a tractor and disc harrow be available on very short notice
to provide a means of overcoming blowing dust when our wines —pick up
in the near future.
Please refer to the Development Agreement for your single family portion
(Tract E) of Fairbrooke P.U.D. for the City's requirements on stripping.

Dear Jack:
I have just completed a tour of the district and would like to call
to your attention some deficiencies which need to be remedied prior
to the setting -in of winter.
1. At the intersection of Cedarwood and Hampshire, the apron pan
on the northwest corner needs replacing.
2. At the intersection of Cedarwood and Hampshire, the shoulder
needs to be graded such that the intersection can drain. As it
now stands, no drainage occurs away from the intersection.
3. Valve box covers need to be straightened throughout the project.
It appears they have been knocked over during the paving process.
These will need to be straightened before final acceptance.
4. The guard rails on the bridge over PV&L Canal look out of proportion.
Can anything be done to correct this aesthetic discrepancy?
5. Adjust -the two manholes mentioned in Matt Baker's letter to Brett Hall
dated October 5, 1984.
Jack, I realize Mother Nature has not been kind to us this past month but
you have a beautiful project to date and these little corrections could be
a real "plus" in getting this district finalized prior to the real set-in
of winter.

Dear Mike:
I would like to address two items concerning the storm drainage within the
1st Filing of Fairbrooke Subdivision.
First, Jack Cochran of Wheeler Realty has requested a payback by the City
for oversizing the culverts beneath Hamshire Road at the southern boundary
of the project. This request was initiated about one year ago and has yet
to be resolved. I have a letter from Ken Rabbers to Marc Engemoen dated
January 30, 1984 that includes flow calculations and cost estimates for
the culvert oversizing. Some of this information is needed to evaluate
the City's share of costs, but some is extraneous. The policy is that the
Stormwater Utility will pay for the incremental cost increase necessary to
upgrade drainage improvements to meet basin -wide needs that are not necessary
for the development in which they are built. In this particular case, that
means the City, will only pay the cost for oversizing the culverts to handle
the 66 cfs proposed to come from a temporary spillway on the Pleasant Valley
and Lake Canal. Further, if existing (historic at time of development of
Fairbrooke) conditions would also cause the P.V. and Lake Canal to overflow,
then that overflow rate would be deducted from the proposed 66 cfs rate.
The tributary flow from Brown Farm must be considered historic, and hence is
the entire responsibility of the developer. In addition, since this thalweg
drains a relatively large basin, all flows that would have historically passed
Hampshire are also the developer's responsibility.
Before payment: can be made by the City to the developer, the historic flows
must be determined, documentation of actual costs presented, and a detailed
estimate of the costs if the culverts had been smaller (to only handle on -site
and historic flows) must be submitted.

The second item I want to mention concerns the discussion we had in
my office last week regarding elimination of a storm sewer line along
Hampshire Road. At that meeting I approved the substitution of a
grasslined Swale with a 6" subdrain for the proposed 15" R.C.P. storm
drain. I regret to tell you that the 15" storm drain must be installed
as originally planned. I was mistaken to approve the change without
researching the situation in more detail. While going through the
Fairbrooke Subdivision file, I discovered several comments Phil Waite
had made while reviewing the utility plans. One note dated April 22, 1984
specifically requested that the swale be replaced with a storm drain and
inlet. I also talked with Matt Baker, the Construction Inspector,
watching the project and Bob Smith. Matt said the pipe was already
strung out ready to be laid, and Bob was concerned with trash accumulating
in the swale on the rip -rap - a maintenance problem. We discussed the
problem with the existing sidewalk lying above the proposed storm drain
and decided it would be best to relocate the line to the west so that the
sidewalk would not have to be replaced. From the utility plans
(Sheet 7/8) iit appears it is possible to move the line west and still
only require one manhole in the line, so the cost will be the same as
the originally approved plan.
After you have redrawn the storm sewer on the original mylar plan sheet
(7/8), please bring it in so that the revision can be approved.

On behalf of Wheeler Realty, the developers of the Fairbrooke S.I.D., I have
investigated the potential for a payback by the City of Fort Collins to Wheeler
Realty. This payback is occasioned by the over -sizing of the storm drainage culverts
which pass under Hampshire Road near the project's southern boundary.
The 38" x 60" concrete culverts which have been installed were designed to carry
a 10-year flow of 137.1 cfs. This flow -is the combination of 71.1 cfs which the level
oper would be required to accommodate, plus 66 cfs which would spill over from the
Pleasant Valley and Lake Canal. I have calculated that two 48-inch reinforced concrete
pipes (hydraulically equivalent to two 38" x 60") would be the minimum size necessary
to carry this flow. I have also calculated that two 36-inch pipes would be the
minimum necessary to carry the above -mentioned 71.1 cfs. The difference in costs for
these two improvements is reflected in the payback summary. (Exhibit "B", attached)

RE: Developer Repayment for Culvert in Fairbrooke PUD
Fairbrooke PUD lies within the Canal Importation Basin. The Master
Plan, Volume II - Preliminary Design Report identifies several
spillways that should be constructed to control overflow of the
Pleasant Valley and Lake Canal. One such spillway is proposed
to be constructed upstream from Fairbrooke PUD and will generate
an estimated 66 cfs flow during a major storm. This runoff is
routed through a natural thelweg that separates Fairbrooke from
several of the Brown Farm filings, under Hampshire Road and into
the proposed regional pond at the southwest corner of Taft Hill Road
and Prospect Road.
The culverts under Hampshire Road were increased in size to handle
this additional 66 cfs flow proposed in the Preliminary Design Report.
The developer is now requesting repayment for this additional cost.
Attached you will find a cover letter from Michael Jones of Parsons &
Associates, the developer's engineer; an exhibit "B" form; calculation
sheets and two (2) change orders authorizing the oversizing of the
culverts, and a letter from the contractor documenting costs.
I have reviewed the material, contacted other contractors, and called
the pipe supplier to check the figures submitted and find them to be
reasonable. I recommend approval of this repayment of $23,200, to
come from the Canal Importation Basin Fund, which has a current balance
of $537,826. The $23,200 will be transferred within the fund from
the contingency line item to Fairbrooke Developer Repayments.

Dear Bill,
On December 12, 1986 a visual inspection of the storm drainage
improvements, shown on sheets 7 and 8 of the Fairbrooke Subdivision 1st
Filing, was made to determine the status of completion. This inspection
was performed in order to determine if the storm drainage requirements of
the Fairbrooke 1st Development Agreement was being adhered to. Section 2-A
of the Development Agreement allows for the release of 35 building permits
and 17 certificates of occupancy prior to the completion of all storm
drainage facilities. As of today's date, 26 building permits and 17 C.O.'s
have been released by our department. Since several of the 9 buildings
under construction appear to be near completion, we will extend the C.O.
requirement to 26 certificates of occupancy when you have submitted to the
City an acceptable schedule stating when and who will perform the remaining
work. You also may obtain 9 additional building permits as per the
agreement.
This is to inform you what remaining work needs to be constructed by the
Developer prior to approval and acceptance of the storm drainage facilities
by the City. The following items and locations can be referenced to sheets
7 and 8 of the Utility Plans.
• Storm Sewer "B" - Hollingbourne Drive
- install rip -rap as per plan
- replace outfall flared end section - existing is damaged
- 7U L.F. of 18" RCP needs to be lowered - does not drain curb chases
- install flared end section at inlet - Sta 0+70 to 0+75.2

In accordance with the Drainage Facility Approval Policy, we are hereby sub-
mitting this certification that the Storm Draining Improvements on this sub-
division have been installed and constructed as shown on the approved plans.
The Construction Plans were prepared by Parsons & Associates in April 1984
with Revisions approved by the City on January 29, 1985 and February 19, 1985.
The items outlined in the letter dated December 15, 1986 from Fort Collins
Construction Inspector Rodney Alpers to Wheeler Realty have now been com-
pleted. In addition, the swale along the Southerly edge of Fairbrooke First
Filing as shown by Cross -sections A & B of the Grading and Drainage Plan
(Sheet 7/8) was enlarged and reshaped to specifications,
As Construction Engineer, we staked the improvements for construction, and
made final inspections by survey on April 13, 1987 and visually on May 13,
1987. We find the construction to be in conformance to the approved design
and plan with only a portion of the final seeding to be completed.

Dear Bill,
On Thursday, June 2, 1988, Fort Collins Hydroseed and I met on site to
inspect and evaluate the seeding progress and needs of the vegetation on the
channel West of Hampshire Road. At this time, the following conditions of
the channel/vegetation were observed. I have also included maintenance
recommendations which, in my opinion, would help obtain channel conditions
that would be acceptable to the City for final acceptance.
1. Vegetation density is generally better than I had expected to observe
after only one year's growing season. With a little maintenance now, I
would not, anticipate having any problems achieving the required density
for City acceptance. Generally, two years minimum would be considered
quite successful for dry land seeding.
2. Three areas on the North side of the channel need to reseeded. These
are areas where excavation material was stockpiled by the builder. (I
brought this to your attention when I found the builder piling dirt in
the channel.)
3. The vegetation height dictates that it be mowed. This will help prevent
weeds from seeding and will also provide mulch for moisture retention
for additional seed germination. I would anticipate mowing to be
required three to five times this summer, depending on the amount of
moisture we receive. I would also suggest that you set up a schedule
for this work with your contractor in order to avoid confrontations with
the Weed Abatement Officer.
4. Several of the homes on Hollingbourne adjacent to the channel have
apparently "dumped" their landscaping debris (rocks, concrete, etc.)
over their fences into the channel. This needs to be removed.

5. The entire channel requires that weed control be performed. I would
suggest that this be delayed until the spring of '89 for two reasons.
First, weed spraying is more efficient in the wet, early spring when the
weeds are, growing vigorously. Secondly, it appears that seed
germination is still taking place and the spraying might jeopardize this
germination.
I would suggest that you consult Fort Collins Hydroseed prior to performing
any of the above. I would expect them to be better informed of proper
maintenance techniques than I am. Please tap that resource since they did
the original seeding.
I would anticipate with the proper maintenance now, that you should be able
to obtain an acceptable stand of grass from what is now in place. (Except
the three damaged areas.) I would be happy to check the channel for final City
acceptance anytime you feel you have obtained the required density as per
Ci ty speci fi c:ati ons .

In regards to the variance request dated August 2, 1994 for non-compliance with the City of Fort
Collins standards for cul-de-sacs, Engineering will grant such a request as long as the following
conditions are met.
• The interior corners of the cul-de-sac shall have a minimum radius of 15 feet. This will
provide for accessibility by street sweepers, reduce the amount of debris that would be
contained in the corner and still provide for the square look.
• As indicated in the written comments dated July 22, 1994 (item #13) a 50 foot radius
should be provide at the entrance to each cul-de-sac to eliminate the possibility of
vehicles driving over the square corner.
• The Cul-de-sacs can be concrete, but shall not incorporate colored, patterned or textured
concrete and shall comply to the City of Fort Collins standards for concrete pavement.

Dear Bob:
We would like to confirm our understanding of the results of our meeting
with you on the referenced project site last Tuesday, August 7, 1984.
The existing patch (cold asphalt application) made by your contractor
on the trench in the center of Horsetooth Road from the New Mercer Ditch
(approximately) westward to the north quarter corner of Section 35, T79,
R69W, 6th P.M. is unsatisfactory. The cold patch is rolling and causing
a traffic hazard. At our meeting, you agreed to replace the trench patch
(and the holes created by the backhoe outriggers) with hot patch material
as soon as possible. The City's crews will repair the potholes and berm
on the north side, again, as soon as possible.
For your information, Bob, Council tabled the formation of the district
to the August 21st meeting due to a lack of proper signatures, so we
still do not have a district which makes the repair of these patches
imperative.

Dear Brett:
I have just received the television inspection logs of the sewer main
in Fairbrook:e S.I,D, I have enclosed a copy, with deficiencies high-
lighted in red, Repairs must be completed before acceptance of this
sewer main.
In addition, the 8" sewer main on Cedarwood and Prospect should be
put in service by breaking into the clay line in Prospect at the drop
manhole. This drop manhole needs a plug installed in the cleanout
line as per the detail on page 13 of 18.

Dear Jack:
I have just completed a tour of the district and would like to call
to your attention some deficiencies which need to be remedied prior
to the setting -in of winter.
1. At the intersection of Cedarwood and Hampshire, the apron pan
on the northwest corner needs replacing.
2. At the intersection of Cedarwood and Hampshire, the shoulder
needs to be graded such that the intersection can drain. As it
now stands, no drainage occurs away from the intersection.
3. Valve box covers need to be straightened throughout the project.
It appears they have been knocked over during the paving process.
These will need to be straightened before final acceptance.
4. The guard rails on the bridge over PV&L Canal look out of proportion.
Can anything be done to correct this aesthetic discrepancy?
5. Adjust the two manholes mentioned in Matt Baker's letter to Brett Hall
dated October 5, 1984.
Jack, I realize Mother Nature has not been kind to us this past month but
you have a beautiful project to date and these little corrections could be
a real "plus" in getting this district finalized prior to the real set-in
of winter.

Re -grading upstream and downstream of 38" x 60" twin RCP
pipes as shown on grading plans.
Erosion control - rip -rap on the storm sewers and curb
chases as per detail on Sheet 13 of 18.
1) 24" RCP outfall on Hampshire Road @ Sta. 4+19
2) Twin 38" x 60" RCP on Hampshire Road @ Sta. 12+00
3) Curb chase on Hampshire Road @ Sta. 12+10, west flowline
4) Curb chase on Hampshire Road @ Sta. 12+13, east flowline
5) Curb chase on Hampshire Road @ Sta. 9+51, west flowline

I am concerned about the drainage improvements in
Fairbrooke S.I.D., specifically the lack of a drainage
swale from the curb chase on Hampshire Road just
south of Cedarwood. This is a low point on Hampshire
with no way for water to drain away from the roadway.
I believe that water ponding in this area all winter
will lead to pavement damage and premature pavement
failure. This is my most serious concern about this
project. However, I am also expecting erosion problems
due to lack of any rip -rap placed on this project.
Earthmoving operations were continued well into the summer
and we did not get the weed growth that was hoped would
control wind erosion and blowing dust problems. If we
experience blowing dust problems this January and February,
I am doubtful that we will get cooperation from the developer
in time to control the problem. I have not been successful
at reaching Mr. Cochran at any time except when I have taken
drastic action. Is there some way we could get a commitment
to have a contractor "on call" or available over the winter
for this emergency work?

Dear Don,
This letter is in responce to your request to waive the Basin Fee for the above
referenced project as was discussed during our meeting on Monday, January 16,
1984.
From what I understood you felt the developer of the site should not have to pay
the Basin Fee and at the same time be required to temporarily detain runoff from
the site. It was decided at our meeting that because the recommended Canal
Importation improvements are not yet constructed downstream of the project
detention would be necessary unless the Pleasant Valley and Lake Canal
Irrigation Company would accept the increased discharge. Based on that decision
you proposed to partially construct the storm drainage channel portion of the
recommended improvements to the PV&L Canal in the form of a shallow swale and to
use this swale as a temporary detention pond which would outfall into the PV&L
Canal. In consideration for the construction of the swale you requested the
Basin Fee be waived.

After talking with Marc Engemoen and Bob Smith we came th the conclusion that
the construction of the swale would not reduce the City's cost for the
completion of the channel enough to justify waiving the entire Basin Fee.
However the additional easement requirement for the future improvements to the
PV&L Canal will qualify for credit against the Basin Fee.
Please call me if you have any questions or would like to discuss this matter in
more detail.
