Dear Mark:
The City is willing to establish a reimbursement agreement for the 12-inch water main which
must be built in Prospect Road as a part of the above referenced development. This
agreement will enable you to collect half of the costs associated with the 12-inch water main
from anyone on the north side of Prospect who connects to the water main at some future
date. I have enclosed a copy of the section of the City Code which deals with reimbursement
agreements so that you are aware of all of the requirements which must be met in order to
create the agreement.

Dear Dave:
Enclosed please find a copy of Stewart and Associates final certification for
the stormwater utility for my Fairbrooke P.U.D. 7th Filing project.
Previously, I furnished them an as built (copy attached) for the drainage
facilities with the exception of the Prospect Road curb and gutter and walk.
That work is now complete.
The only uncompleted work in the development is the 12 foot walk between Lots
9 and 10, which my development agreement ties to the first certificate of
occupancy on either of these lots, and the Prospect Road landscape
improvements. The walk will be done with the flatwork of the first house on
either of these lots to avoid breakage. I have provided Peter Barnes a letter
of financial guarantee for 125% of the cost of the landscape improvements
(this came up due to a site plan note concerning certificate of occupancy) to
assure completion. The fence, columns and landscaping are all contracted for
and scheduled to be done in October/November to coincide with the building of
the first home on one of these Prospect lots, which will provide a water
source for the ''andscaping. I realize that when the landscaping is complete a
final city inspection and acceptance is required per the development
agreement.
I have made my payments to the water department for the 121, line and to Matt
Baker for the paving on Prospect Road (copies enclosed).
Please make your final inspection and release me for all 20 permits in the
development. Please consider this as my request for return of the applicable
portion of my $5,037 escrow that I posted. If you have any questions
concerning any of this, please call.

Dear Basil:
This is to follow up my letter and red lined plan for Fairbrook P.U.D.,
7th Filing, dated September 7, 1994.
At this date the curb and gutter on Prospect Road has been completed.
The pan across Cedarwood Drive at Prospect Road and the Prospect Road sidewalk
have also been completed. The postal pad has also been poured. The Swale
from the East end of the Prospect Road curb and gutter has been graded to
drain Easterly along the Bauder School portion of the Prospect Road right-
of-way.
Therefore all of the drainage facilities and public improvements have
been completed in substantial compliance with the approved utility plans and
the City of Fort Collins Standard Specifications.

RE: variance for changing the lot side yard set back and side yard
easements from 5 feet to 4 feet on lot 7, Fairbrooke 7th Filing.
As the adjacent property owner on Lot 6, Fairbrooke 7th Filing, I hereby
support the proposed variance of changing the side yard set back and
easement from 5 feet to 4 feet. Since this proposed change is only 1
foot, I feel there is no implications to my property with this proposed
variance.

RE: Request for variance for changing the lot side yard set back and

As the architectural control committee for Fairbrooke 7th Filing, I
hereby support the proposed variance. Since the adjacent property is
offset by 9 feet, this proposed change still allows for 13 feet between
structures, which maintains the side yard standards of the filing. Since
this variance affects only lots 6 and 7, I feel there is no implications to
other properties.
