LAND USE DATA:
1,732 square foot drive-thru restaurant located at 1298 North College (the
old A & W restaurant)
COMMENTS:
1. Provide landscaped islands at the end of each row of parking spaces.
Landscaping is also required in the setbacks on the perimeter of the
property.
2. Loading zones can not be part of a driving.
3. Additional ROW (20 feet) must be dedicated on College Avenue. A
landscaped buffer should still be provided inside the new ROW. Show the
ultimate width on the plan along with the sidewalk.
4. The sidewalk must be 7 feet in width.
5. Note on the plan the type of interior traffic directional signal that
would be provided.
6. Angle parking would help in directing traffic flow. A counter -clockwise
flow around the perimeter would appear to work.
7. A landscaped island should be used to direct traffic from the
drive-thru back onto College Avenue.
8. As was stated previously, it will be very difficult to achieve the
required points for the Land Development Guidance System. You do have
the option to request a variance. This would require you to demonstrate
why this proposal is a special case and how it could be an asset to the
area.
9. Intensify landscaping throughout the plan. Maintain as much of a
landscaped buffer as possible between College and the driveway.
10. Emergency access requirements (such as turning radii) must be
addressed.
11. Indicate which areas will be fenced.
12. Note the previous Conceptual Review comments. Many of these still apply.

Dear Sir or Madam:
We have reviewed the Burger Inn Preliminary and Final P.U.D. and
have the following comments:
1. This development is located immediately north of the future
Ft. Collins Expressway interchange at North College Avenue. The
enclosed preliminary right of way plan sheet shows the anticipated
right of wary line in relation to this property, which has been
shaded red. It is clear from this plan sheet that this line cuts
across the western portion of the proposed restaurant site.
The Burger Inn Site Plan does not recognize the future right of way
which will be needed for the interchange, but it does show an
additional :20 feet of right of way along the east side of existing
State Highway 287. The additional 20 feet would result in a
60-foot width east of the highway centerline, which is consistent
with the City's recommended 120-foot total right of way width. We
support the 120-foot width for S.H. 287 but we ask that the
necessary right of way for the future interchange also be provided
by reservation or, preferably, dedication, as permitted by local
regulations.
2. The location of the access to S.H. 287 at the north end of this site
is acceptable, given the limited amount of frontage this property
has on the highway. However, it should be noted that this access
could conflict with the future acceleration lane extending north
from the Expressway interchange. The taper for this lane is
proposed to occur across this access. We do question the need for
two exit lanes and point out that this access will eventually be
limited to right turns in and out only due to a raised median on
S.H. 287, which is to be built in conjunction with the interchange.
An Access Permit will be required to construct this access. Application
for this permit is made to the City Transportation Department and should
include relocation of the existing light pole in the right of way
and widening of S.H. 287 along this property for a right -turn

deceleration lane and concrete curb and gutter. The design of
the access is not acceptable as shown on the Site Plan, and it
should be revised in accordance with the State Highway Access Code.
3. The Landscape Plan shows a number of trees within the 20-foot new
right of way. These trees must be kept outside of this area and
the additional interchange right of way, since they would conflict
with the future interchange and could obstruct sight distance at
the access. We do not object to low -profile landscaping if it is
maintained by the private property owner.
4. We cannot determine from the Site Plan whether the water and sewer
lines leading from the Burger Inn Building are existing or
proposed. If these are new lines, an Underground and Utility
Permit is required. Application for this permit is made to this
office.

Dear Jim;
Staff has reviewed the Preliminary and Final PUD Submittal for Burger Inn
and has the following comments. Revisions reflecting these comments should
be submitted no later than noon on June 4th to complete the submittal.
Items that can't be shown graphically should be addressed in writing. I
suggest we meet at your convenience to review this information.
1. Additional information on storm drainage is needed. Contact Bonnie
Tripoli on the extent of data needed.
2. A new fire hydrant should be provided on site.
3. The fire access lane must be dedicated as an easement and meet City
standards for turning radii and width.
4. A 10' utility easement should be dedicated on the north and east
property lines.
5. A 3/4" water and 4" sewer currently serves the building on the site.
They must be used or abandoned.
6. A subdivision plat with all legals must be provided.
7. Curb cuts should be concrete to the property line.
8. A 50' setback from flow line to aisle is required. Since you can not
achieve this, a variance should be requested in writing. This vehicular
entrance area does not include an adequate level of detail in terms of
specification for a final plan, as drawn.
9. 20' of additional right-of-way should be dedicated on College Avenue
now.
10. In the Development Agreement, agreement to participate in future
College Avenue and alley improvement districts will be required.

11. Temporary improvements to College Avenue may be required.
12. The sidewalk should wrap around curb returns and include pedestrian
access ramps.
13. Provide a ramp up to the building and designate a pedestrian crossings
from parking to the building.
14. A utility plan should be provided.
15. Show existing buildings on the site plan.
16. Show existing improvements within 150' on the site plan. This includes
curb cuts and access drives on both sides of College Avenue.
17. Comments from the State Highway Dept. are attached. We can discuss
these in detail when we meet.
18. The left turn onto College may need to be eliminated.
19. Peak hour information in the traffic study is incorrect.
20. Indicate the building envelope and show dimensions.
21. Show the distance from the envelope to at least two property lines.
22. A 500 square foot loading space should be designated. This can be done
by restricting hours for certain parking spaces.
23. All signs must comply with the sign code. A freestanding menu board
will require a variance from the Zoning Board of Appeals if other
freestanding or ground signs are proposed.
24. All proposed signage should be shown on the site plan.
25. Signage is a very important aesthetic element. Please provide informa-
tion on the type and appearance of proposed signs.
26. The turning radius at the entrance is not adequate for emergency
access.
27. All landscaping along College Avenue is shown in the right-of-way.
Provide at least 12' of landscaped area on the property. Major
vegetation should not be in the ROW.
28. Show quantities on the landscape schedule.
29. Add at least two clusters of coniferous trees to the College Avenue
frontage.

30. Additional shrubs should be provided. Staff recommends doubling the
amount now shown on the plan.
31. Cluster shrub plantings in groups of three or more for aesthetic appeal
and easier maintenance.
32. Provide deciduous trees along the south property line.
33. Planning objectives should be typed up on a separate piece of paper for
the Board. Go into more detail on why the project merits a variance
from the point charts. Include discussion of City goals and land use
policies.
34. Provide land use data on a separate sheet of paper.
Attention to detail on these points is crucial since you are requesting
preliminary and final approval. Unless all Staff concerns are addressed,
we cannot support the plan. The building design is attractive, but an
outstanding landscape plan and sign system is also necessary to justify the
variance from the point chart.
Colored renderings, PMTs, and ten (10) full size copies of the plan for the
Board are due on June 14th. All mylars and signed documents are due by
June 20th. (Landscape covenants are attached.) If you have questions,
