Dear Clarence:
Since our discussion the other day concerning the frontage road at your
property at Thunder'aird and College, we have had a more definite indication
frore tI)e City Council as to the requirement for the full 50 feet dedication
of frontage road. They have informally said at a recent work session that
the full frontage road should be dedicated adjacent to your property in
conjunction witIi the. development of the property.
This may affect whether you wish to proceed further with taking plans to
thu June Planning and Zoning meeting. Please let me know.

Dear Bob:
In connection with the plat of Arthur Subdivision, I met with Gene
Fischer and we agreed on a short agreement obligating the owner of the prop-
('1t_v to eventually redo the frontage road when the other properties also put
in .� frontage road and acknowledging that the curb cut is revocable at the
option of the City when the frontage road is installed. I enclose herewith
this agreement which, if acceptable to you, should be recorded along with the
plat of the subdivision. I assume that in addition to this there will be a
normal utility plan and agreement which may or may not be completed. If you
need something further before this can be approved, please let me know.

On April 10, 1974, The Sherwood Irrigation Comnany granted to
Triple Tee an easement and right -of. -way over and across the ditch
of said company for purposes more fully set out in said actrnement.
It was contei-plated by the agreement and attached

RE: z Arthur Subdivision Landscape Plan
This is to clarify the status of the "Landscape and Development Plan of the
Arthur Subdivision".
The proposal is for a B-L, Limited Business use on less than two acres in the
H-B, Highway Business zone. The requirements in the: ordinance are:
a) The yard and parking requirements of the B-L, Limited Business Zone shall
be applicable.
b) A plot plan showing proposed landscaping and screening shall be presented
to the Planning and Zoning Board and approved by the Planning and Zoning
Board. In the event the Planning and Zoning Board fails to approve such
plan, the matter may be appealed to the City Council.
(see SS.118-62, zoning ordinance)
A building permit for tno Arthur Subdivision would be issueu on the subdivision
plat in conformance with all the requirements of the B-L zone. The "Landscape and
Development Plan of the Arthur Subdivision" is the "plot plan" showing landscaping
as required above.
Since. the Arthur Subdivision is not a Planned Unit Development, its landscape
plan should not be construed as a "unit development plan" which is the document
upon which building permits are issued in a P.U.D.
The City Council voted its approval of both the "final plat and landscape elan"
upon several conditions which were subsequently fulfilled. (See minutes of Council
meeting attached). They approved the landscape plan because it was presented to
them by us to depict the curb cut onto S. College Avenue which was at issue, not
because their approval of the landscaping per se was required. This approval does
not super.cede the fact that a building permit is to be governed by the plat as per
requirements of the B-L zone. The Zoning Board of Appeals, therefore, is
empowered to grant a variance on the issuance of a permit if it feels there is
justificati.cn. If such a variance would not affect the plantings shown on the
landscape plan, then this plan reed not be amended. If planting changes were required,
a new landscape plan would have to be approved by the Planning and Zoning Board,
unless those changes were minor.

This letter serves as written confirmation that the Walters Subdivision,
1653 South College, is in an H-B Zone. The use proposed on the site is an
indoor restaurant. Indoor restaurants are an alloweu use in the H-B zone,
subject to the following requirements:

Re: Taco Johns on South College
Dear Mr. Parsons:
This is to confirm our agreement as discussed December 29,
December 30, 1977, and January 3, 1978, including the discussions
with the corporate attorney, Kenneth C. Wolfe.
By February 15, 1978, the vertical curb on College Avenue
as shown on your drawing, plus the two radii on either side, plus
the 20 foot concrete driveway will be completed.
The work will be completed in accordance with the City's
utility plan that has previously been provided to me or my architect.
An escrow account with United Bank has been established in the
sum of $5,000 to secure completion along the frontage road adjacent
to the property, removal of any temporary paving, and the cost of
landscaping. We have the right to substitute a bond in lieu of the
escrow account.. The bond or escrow account will be in an amount
equal to 150 per cent of the estimated cost of the above items neces-

We will attempt to keep people from parking adjacent to the east
side of the curb on College in front of Taco Johns.
Owner agrees to maintain all temporary improvements including
A.C. drive and temporary A.C. pavement.

RE: Taco John's improvements
Dear Mr. Carr,
In your letter to Don Parsons dated January 3, 1978, you stated that "by
February 15, 1978, the vertical curb on College Avenue as shown on your drawing
(the utility print), plus the two radii on either side, plus the 20 foot concrete
driveway will be completed". This work was to be completed in conjunction with
our issuance of a Certificate of Occupancy for your property and was not included
in the bonding of the additional frontage road improvements.
We have found that the improvements on College Avenue have not been instal-
led as you indicated. Please make arrangements as soon as possible to complete
this work. If you have any further questions in this regard, please feel free
to contact our office.
