KNOW ALL, MEN BY THESE PRESENTS: That the undersigned being the
owners cf property east of and immediately adjacent to Clarendon
Hills Third Filing, City of Fort Collins, County of Larimer, State
of Colorado do hereby agree to the following:
1. The irrigation ditch currently located on the Clarendon Hills
Third Filing property shall be abandoned. The irrigation ditch
shall be replaced on our adjacent properties with an enclosed
irrigation pipe system to be provided and installed by the owner
of the Clarendon Hills Third Filing.
2. The storm drainage runoff from the Clarendon Hills Third Filing,
as designed and shown on the Utility Plans for Clarendon Hills Third
Filing, is acceptable to us as the adjacent property owners.
This is the extent of our agreement as to these matters.

Chloride (PVC) pipe conduit of schedule 200 at each crossing at
a depth of 2 feet below pavement grade.
D. PURPOSE OF THE ENCROACHMENT To accomodate irrigation (sprinkler) lines
(2% inch or less) and controller wiring crossings.
E. SPECIAL CONDITIONS At the time of installation the low end of the
conduit, or sleeve shall have a vertical 2 inch conduit filled
with pea gravel extendinq to the surface. The conduit crossi
shall extend from back of easement to rack of easement.
Permission is hereby granted for the indicated encroachment upon a public right-

CERTIFICATION OF STORM DRAINAGE IMPROVEMENTS
FOR
CLARENDON HILLS SUBDIVISION - THIRD FILING
This LETTER OF CERTIFICATION is provided by the undersigned
Registered Professional Engineer as required by the Subdivision
Agreement for the Third Filing of Clarendon Hills to establish
that the storm drainage improvements contained within the Third
Filing have been completed in substantial compliance with the
project plans and specifications.
Further it is certified that the improvements will function
properly during minor and major storm events essentially as
required by the City of Fort Collins and by the Final Storm
Drainage Report prepared by the undersigned. The 100 year design
storm will be passed through the storm drainage system as now
constructed with negligible chance of any damage to property or
persons resulting.
It is recommended that this certification allow for Engineering
Releases to be granted relative to storm drainage requirements so
that building permits can be issued by the City of Fort Collins
for all lots except Lots 4, 5, 84 and 85. These lots have minor
improvements that have yet to be completed. A separate
certification will be provided upon completion of the required
improvements on the excepted lots. The un-completed
improvements do not affect the other Tots and their is no reason
to restrict permits to any lots other than those identified here.
The storm drainage improvements on Lots subject to the
subdivision agreement place a hold on Certificates of Occupancy
from the City until the final site grading, after home
construction, has been certified to adequately contain and pass
the 100 year design storm.
This CERTIFICATION is provided this bth day of December, 1989.

This LETTER OF CERTIFICATION is provided by the undersigned
Registered Professional Engineer to certify that the storm
drainage improvements on the referenced Lot are, as of this date,
still in substantial compliance with the project plans and
specifications. This remains true after completion of the final
grading and as of today's request by the lot owner for a
Certificate of Occupancy for the home constructed on said Lot.
Further it is certified that the improvements will function
properly during minor and major storm events essentially as
required by the City of Fort Collins and by the Final Storm
Drainage Report prepared by the undersigned. The 100 year design
storm will be passed through the storm drainage system as now
constructed with negligible chance of any damage to property or
persons resulting.
It is recommended that this certification allow for an
Engineering :Release to be granted relative to storm drainage
requirements so that a Certificate of Occupancy can be issued by
the City of :Fort Collins for the referenced Lot.
