The following summarizes the discussions that began at 8:00 a.m. 1/10/2023 Work Session: The planned agenda for this work session was reviewed. • This work session will be conducted in person with hybrid remote participation options. Councilmembers will be present in person in the Colorado Room at the 222 Building. Remote participation by staff as needed will be via the regular Zoom link for the meeting. Dinner will be available for Councilmembers beginning at 5 pm at the meeting site. • The items planned for the work session were reviewed. It was determined the Connexion update, as a primarily informational item, will be heard first. 6-Month Calendar: • Upcoming meetings were reviewed with particular attention to any shifts. • The reconsideration of Ordinance No. 114, 2022, adopting the Land Development Code, will be coming to the January 17, 2023, regular meeting as the next meeting of the Council following the certification of the sufficient referendum petition. Council will need to either repeal the ordinance or refer it to voters. There was a request for staff to put together a memo outlining what is required of Council on the 17th and also some options for what potential paths forward could look like if Council proceeds with the repeal option, such as considering future modifications in pieces instead of as a single adoption, and also potential outreach strategies. In addition, either in the same memo or an additional memo, Mayor Pro Tem Francis requested information about additional affordable housing guardrails that could potentially be put into place. Leadership Planning Team Meeting January 3, 2023 Page 2 of 3 • City Attorney Daggett shared additional information would be coming to Council regarding the implementation of Proposition 123 relating to affordable housing passed by Colorado voters in November of 2022. There is a November 1 certification date for municipalities who wish to participate in this initiative and this forthcoming information will focus on what would be needed for Fort Collins to be able to participate. • Discussion occurred of the three appeals filed in the final weeks of December. Two separate appeals were filed from the decision of the Planning and Zoning Commission on the 636 Castle Ridge Group Home decision. The person who filed the first appeal has requested it be heard independently from the second appeal filed. That determination will be up to the Council to make at the time of the hearing. It was decided to look to schedule both appeals on that matter for March 7. The other appeal filed is of the 1901 and 1925 Hull St Historical Landmark non-eligibility determination of the Historic Preservation Commission. There is a question as to whether the individual bringing that appeal has standing to do so. It appears possible the appeal will need to come before the Council to make that determination. City Attorney Daggett will be doing additional research into that question. If that is the case, the February 21 regular meeting was identified for considering this appeal. • It was noted that the work sessions on March 14 and March 28 both have potential scheduling conflicts that could impact participation. March 14 falls during spring break week for both Poudre School District and Colorado State University. Two Councilmembers are currently planning to be unavailable that week. March 28 overlaps with the National League of Cities spring conference. Several Councilmembers and members of the City Manager’s office will be attending that conference. It was noted remote participation may be possible that evening. It was agreed that the 28th is the more likely of the two meetings to be cancelled given logistical challenges with the NLC conference, and it was requested to see if staff with items on the 28th could accommodate the 14th. Deputy City Manager Marr indicated he would follow up with the staff teams. City Clerk Anissa Hollingshead: • No additional items. Deputy City Manager Tyler Marr • No additional items. City Attorney Carrie Daggett • New attorney, Heather Jarvis, started on December 27. Another new attorney, Chris Hayes, will be starting in a few weeks. The hiring process will be starting to fill Mary Donaldson’s office manager role ahead of her March retirement. There will also be additional hiring starting soon to fill other upcoming attorney vacancies.
