The following summarizes the discussions that began at 8:00 a.m. 12/20/2022 Regular Meeting: The published agenda for this meeting was reviewed. • This Council meeting will be a hybrid meeting, with Councilmembers present in person in Council Chambers. Public participation for the meeting will be available in three ways: in person, by phone, and online through Zoom. • The items planned for the meeting were reviewed. There are nine second readings, four first readings, five resolutions, one motion for approval of prior minutes, an appeal, and a motion under other business for to provide direction on adding an editor’s note to the City Charter. • Discussion regarding the oil and gas item occurred, including considering ongoing public input. Following first reading, second reading would typically be on January 17. Given the year end schedule, it was noted this will allow a four-week period between first and second reading already and Council can choose to consider additional time after first reading for setting second reading if it is believed to be needed. It was noted the City has been working on this ordinance for multiple years at this point. • Ethics complaints review code amendments are on the discussion agenda. A brief presentation will be made at the meeting and will be provided in Tuesday’s read before packet. 6-Month Calendar: • Upcoming meetings were reviewed with particular attention to any shifts. Leadership Planning Team Meeting December 19, 2022 Page 2 of 3 • City Manager Kelly DiMartino noted at last week’s ELT retreat one of the things that came up was the importance of keeping operational issues in front of Council at a high level. One way this is planned to occur is by using staff reports on Council meeting agendas, such as the upcoming staff report planned for January 17 focusing on volunteer services. City Clerk Anissa Hollingshead: • Shared known timing around the current referendum process relating to the ordinance enacting the Land Development Code. Today is the deadline for petition representatives to turn in the full petition. It is expected that will occur later this afternoon, before 5 pm. The first step performed by the City Clerk’s Office with an incoming petition is determining an initial count of signatures submitted prior to any verification of those signatures. The total number of unverified signatures submitted must at least equal the number of signatures from registered electors required for a successful petition. A receipt will be issued to the petition representatives indicating the number of petition sections and unverified signatures initially submitted prior to any verification process. Assuming the signatures submitted meet the minimum threshold, the petition review process will begin to determine if each signature is from a currently registered Fort Collins voter. Five working days are allowed for the review process, which will end on Tuesday, December 27. There is also a 10-calendar day protest period that will start at the point petitions are turned in, ending Thursday, December 29. Petitions will be certified as either sufficient or insufficient at the close of the protest period if no protest is received or at the conclusion of any protest process. A staff report providing an overview of the referendum process was requested for the December 20 Council meeting to ensure the public has access to as much information as possible about the referendum effort and what to expect. Deputy City Manager Tyler Marr • No additional items. City Attorney Carrie Daggett • New attorney, Heather Jarvis, is starting on December 27. She has a strong environmental background and has been working for the Wyoming legislature most recently. Hoping to finalize a second attorney hire in the next couple of days. City Manager Kelly DiMartino: • Noted the emails that have been coming in with questions and concerns on the clean up outside of the Murphy Center. Assistant City Manager Rupa Venkatesh will be the point on answering any questions, including at tomorrow’s Council meeting. David Rout at Homeward Alliance will also be at tomorrow Leadership Planning Team Meeting December 19, 2022 Page 3 of 3 night’s meeting to assist in answering questions. There is also specific follow up occurring around the Northside Aztlan Community Center. A group is being convened to work on that situation. Mayor Pro Tem Emily Francis: • Requested information about whether it is possible for someone to remove their signature from a petition being circulated. City Clerk Anissa Hollingshead provided details on what is and is not possible in this realm. The City Clerk’s Office has no authority under the State Constitution or the City Charter to remove any signature from a petition. A resident who has signed a petition but wants to remove their signature is best advised to make contact with the petition circulators to strike it themselves if possible. If they are unable to do so, our only other process would be the protest of the validity of their signature. This requires filing a formal protest and then providing testimony to a hearing officer, who would determine whether or not the signature should be considered valid. It is unknown whether such a protest would be successful. • County Commissioner Kristin Stephens reached out on the migrant workers coming into Colorado and to Larimer County specifically, and the work being done by the County on this topic. Kelly DiMartino provided information about what the City has been doing in collaboration with the County to assist in providing housing for individuals the County has committed to taking in. Two churches and a hotel have been identified to work with in support of this effort and provisions have been implemented for ensuring showers are available through shuttles to other facilities for those in churches. • Noted this Thursday the high is forecast to be zero when the Menorah lighting is planned and asked if it is possible to check in on proceeding. It sounds like it will be the Rabbi’s determination. Request to reach out to the presiding Rabbi on plans to proceed. There was also discussion about potential plans for the Gardens of Light in regard to dangerously low temperatures, with it noted as a good touch point with Community Services staff.
