Dear Chair Elson, Vice Chair Cunniff, and Board Members:
On behalf of City Council, thank you for providing us with the June 13, 2022 memorandum
regarding “Adoption of 1041 Regulations” wherein you summarized the Board’s strong support
for the Council to expeditiously implement the 1041 regulations to protect City Natural Areas
from risk of large infrastructure projects.

Subject - Adoption of 1041 Regulations
The Land Conservation and Stewardship Board would like to take another opportunity to share its
perspective with City Council on the 1041 regulations, given the long-term nature of their
development. The LCSB appreciates the efforts by Kelly Smith to keep individual Board members
informed and involved. The Board continues to believe that adoption of comprehensive 1041
regulatory powers in the Fort Collins Land Use Code will provide a critical layer of protection for the
Natural Areas.
The LCSB understands the City is developing potential regulations for two of the Activities of State
Interest – water supply and wastewater, and highways. Without stronger local regulatory authority,
Fort Collins Natural Areas are at risk from large infrastructure projects anticipated in the next few
years. The Natural Areas of particular concern include Running Deer, Arapaho Bend, Kingfisher
Point, Riverbend Ponds, and others along the Cache la Poudre River.
Strong local permitting authorities for Natural Areas are necessary to protect investments of millions
of dollars made by Fort Collins taxpayers. This requires the City to adopt 1041 powers for the
Activities of State Interest identified above.
The LCSB strongly urges City Council to continue the steps necessary to expeditiously implement
the 1041 regulations and stands ready to review and advise during this important regulatory
development process.
