Box 580 Fort Collins, CO 80522.0580 970.416.2740 970.224.6134- fax fcgov.com DATE: April 1, 2022 TO: Mayor and City Council THRU: Kelly DiMartino, Interim City Manager Kyle Stannert, Deputy City Manager Caryn Champine, Director of Planning, Development and Transportation Paul Sizemore, Director of Community Development and Neighborhoods Service FROM: Marcus Coldiron, Chief Building Official Kirk Longstein, Project Manager RE: Exception for Permanent Supportive Housing from Electric Vehicle (EV) Charging Building Codes The purpose of this memo is to notify Council of the option to exempt “Permanent Supportive Housing” land developments from EV charging requirements reflected in the second reading Ordinance as published ahead of the April 5, 2022, Council meeting. Background: Affordable Housing is defined by Sec. 5.1.2 of the Fort Collins Land Use Code and Staff included the reference and definition within the published version of the second reading of Ordinance No. 021, 2022. Although the Land Use Code provides a definition for “affordable housing”, the Code does not differentiate a definition for “permanent supportive housing.” Based on stakeholder feedback, staff updated the EV charging definitions to provide clarity and limit the possibility of future reinterpretation of the Code’s intent. Staff have also developed a definition for “permanent supportive housing” and suggested Ordinance language for Council to exempt “permanent supportive housing” from the EV building Code requirements. Should Council desire to select one of the options (attachments 1-4) provided within Council’s packet (including Option 1, which is the published second reading Ordinance No. 021, 2022), then Council may also consider a motion to include a definition and exception for permanent supportive housing. As shown in IBC 3604.2 Definitions and 3604.5 New Buildings - Exceptions set forth in Ordinance No. 021, 2022 published for second reading. 3604.2 Definitions applicable to this Chapter: Permanent Supportive Housing: Land development projects (or portions thereof) that are subject to recorded covenants restricting the affordability for all residents of all dwelling units and which combine the housing with services that help people who face the most complex challenges to live with stability, autonomy, and dignity, such that the dwelling units may be classified as "permanent supportive housing”. 3604.5 Exceptions: 4. All Affordable Housing development classified as permanent supportive housing.
