RE: ITEM #13, Resolution 2022-027 Authorizing the Execution of an
Intergovernmental Agreement between the City of Fort Collins,
Colorado, and the Colorado Department of Transportation for the
Laporte Avenue Multi-Modal Improvement Project
Last month, the City learned that the Colorado Department of Transportation (“CDOT”)
changed the federal funding source of the $1,437,500 Revitalizing Main Streets (“RMS”)
grant that the City was awarded for the Laporte Avenue Multi-Modal Improvement
Project in the fall of 2021. The new funding source, made in accordance with the
Legislature’s direction under Senate Bill 21-260, are funds released to the State of
Colorado under the American Rescue Plan Act (“ARPA,” or the “Act”). CDOT’s switch in
the underlying federal source of funding for the RMS grant requires the City to certify as
part of the proposed Intergovernmental Agreement (“IGA”) that it will use the federal
funds in accordance with Section 602(c) of ARPA and comply with federal award
reporting requirements under 2 CFR 200. This means that the City must certify, as a
Subrecipient of ARPA funds, that it will use the funds to provide a “governmental
service” to ensure the State’s compliance with Section 602(c)(1)(C) of the Act. (31 CFR
35.6(d))
After review and consideration of this unanticipated change to the source of federal
funding to the RMS grant and the associated certification and reporting required, the
City’s Engineering and Finance departments have determined that the Subrecipient
certification and federal reporting requirements required under the CDOT IGA can be
fulfilled.
The government service provided by the Laporte Avenue Multi-Modal Improvement
Project is the provision of transportation infrastructure improvements, namely the
design, any necessary property acquisition, and construction of roadway improvements
along Laporte Avenue from Fishback Avenue to Sunset Street.
As the name and type of grant awarded by CDOT (Revitalizing Main Streets) otherwise
has not been changed, Staff do not anticipate a need to revise or amend the
appropriation Ordinance approved by City Council on December 7, 2021 (Ordinance
No. 155, 2021).
