Box 580 Fort Collins, CO 80522.0580 970.416.2740 970.224.6134- fax fcgov.com Planning, Development & Transportation Services MEMORANDUM DATE: July 30, 2020 TO: Mayor Troxell and City Councilmembers THRU: Darin Atteberry, City Manager Kelly DiMartino, Deputy City Manager Caryn Champine, Director of PDT Paul Sizemore, Interim Director, CDNS FROM: Justin Moore, Lead Inspector- Code Compliance RE: LPT Follow-Up on Nuisance Enforcement The purpose of this memo is to provide City Council information following the Leadership Planning Team meeting on July 27, 2020, in which Mayor Troxell noted recent receipt of nuisance complaints for 2331 Coventry Court and another address on East Swallow. Staff was asked to follow up regarding proactive nuisance enforcement efforts across the City. Following the LPT meeting on July 27, 2020, Code Compliance staff received notification of a Service Area Request (SAR# 56721) on the same date that was initiated upon receipt of an emailed complaint from the owner of 2331 Coventry Court, Kathy Cardona, in which she expressed her general concerns with various ongoing nuisance issues she has been observing in her neighborhood. A response was provided to Ms. Cardona on July 29, 2020, addressing her concerns. The Code Compliance Inspector that is currently assigned to addressing municipal code nuisance violations in the neighborhood in which Coventry Court is located proactively patrols this area on a 4-5 week rotation. Upon observation of nuisance violation(s) by the Inspector in their assigned area, property owners are notified and afforded a period of time to correct the violation(s) and bring the property into compliance. This is typically seven (7) days, depending on the nature of the nuisance. After the cure period has passed, the Inspector will re-inspect the property for compliance. If the violation has not been cured within the timeframe afforded by the Inspector, enforcement action is then taken by either issuance of citation or abatement of the nuisance by a contractor hired by the City. The enforcement action taken is also dependent on the violation type. DocuSign Envelope ID: DABBAF8D-DD89-4852-AE97-D3B9E1C8E8FC - 2 - To date, Code Compliance staff have issued notices for approximately 4,555 nuisance code violations citywide in 2020. Of the cases generated so far this year, approximately 2,897 (64%) have been on a proactive/patrol basis, and 1,655 (36%) cases have been generated reactively, pursuant to receipt of founded complaints. With respect to Coventry Court specifically, Code Compliance staff have addressed no less than sixteen (16) nuisance code violations in 2020 on that street alone - primarily on a proactive basis. Violation notices have been issued to property owners on Coventry C ourt for nuisances including rubbish accumulation, outdoor storage, tall weeds/grass, forestry encroachment, inoperable vehicle(s), and failure to remove sidewalk snow. Code Compliance will continue to proactively monitor Coventry Court and the surrounding neighborhood to ensure ongoing compliance. Any observed future violations will continue to be promptly addressed by Code Compliance staff. Additionally, Code Staff have addressed approximately twenty four (24) nuisance code violations along East Swallow in 2020- both proactively as well as following receipt of complaints. Code Compliance is happy to follow up with and address any observed violations occurring at a specific address or location on East Swallow upon receipt of additional information.
