RE: March 30, 2020 Leadership Planning Team-Marijuana Store Emergency Rules
Request:
Staff is asked to provide Council with an update on pandemic emergency rules related to
licensed marijuana businesses and what contact staff has had with the owners.
Bottom Line:
The State-wide COVID-19 related emergency declaration has included licensed medical and
retail marijuana businesses as Critical Businesses and they may remain open as long as they
maintain physical distancing requirements.
To help ensure and facilitate the safety of employees and customers, the state Medical
Enforcement Division issued emergency rules on March 30, 2020 addressing protocols for both
medical and retail stores. Rules include allowing for both in-store sales and curbside pick-up. All
tracking requirements, ID checking (ensuring customers are of age), and video coverage
regulations remain in place. Adherence to social distancing protocol is also required.
The City of Fort Collins Marijuana Enforcement Officer has been monitoring local compliance
several times a week since the orders went into effect. He is in frequent telephone and email
contact with business owners and has also responded to questions from residents and nearby
businesses. Compliance checks will continue throughout the emergency order, with an
emphasize on education and voluntary compliance.
