Other business • NLC Trip – highlights • Legislative Lunch reminder- April 3, 11:30-1, at CML Legislative Review Committee Meeting Minutes March 6th, 2019, 4:00 p.m. Council Information Center, 300 Laporte Ave Councilmembers Present: Ken Summers, Ray Martinez, Ross Cunniff Staff Present: Ginny Sawyer, Tyler Marr, Jeff Mihelich, Carrie Daggett, Jeanne Sanford, John Phelan, Lindsay Ex, Joe Wimmer Meeting convened at 4:00 p.m. Approval of Minutes from February 20th, 2018 Meeting Councilmember Martinez moved to approve the minutes from the February 20th meeting. Councilmember Cunniff seconded. Bill Review CML highlights of new/killed bills and updates on bills previously discussed Bill # Position Comments HB19- 1086 Oppose Plumbing inspections journeyman requirement bill was stripped and now a continuous education bill. CML mildly opposed. HB19- 1143 Plastic Straws and Styrofoam: Bill will be postponed and brought back as a statewide ban. Recommendation from Councilmember Cunniff for staff to consult with Representative Arndt to have more information and express support for or local control over single use plastics. If the bill proposes a statewide ban he would like to monitor; CML would likely oppose. HB19- 1221 Monitor E-scooter regulation bill. Staff is evaluating. Bill excludes electric scooters from the definition of “toy vehicle”. HB19- 1157 Oppose Modify Specific Ownership Tax Rates. Bill is going to die. SCR19- 001 Oppose GoCo designation bill. Postponed Indefinitely SB19-96 Support Collect Long-term Climate Change Data. Bill is not currently on the calendar and amendments are being drafted. Staff anticipates it is still moving forward and will provide more information. SB19-181 Monitor Oil and Gas Regulatory Authority. Councilmember Summers recommends monitoring the bill. Councilmember Cunniff would like to monitor whole bill but support local control aspects of the bill and methane continuous monitoring aspect. Councilmember Summers agreed. Comments from Councilmember Cunniff about local pooling providing a competitive advantage. Suggested we do not support that aspect of the bill. Also commented about COGCC mission statement change to include health. City Attorney reviewed the sections of the of City’s Legislative Policy Agenda pertaining to Oil and Gas. Discussion about City resourcing for activity in oil and gas. City has staff designated for these issues. Attorney Highlights Bill # Position Comments SB19-166 None Post board and obligations related to police officers. City Attorney suggest CML evaluates. FOP pressing to get third party added to the review board. Overall CML supporting. Recommendation from City Attorney for City legislative staff to reach out to CML. This bill creates additional statutory requirements. Not yet introduced Food truck bill. Preempts local regulation on food trucks. Concerns from City Attorney’s Office. The City currently have provisions for food trucks to get licenses. Councilmember Cunniff opposes if the bill regulates the City’s abilities. CC4CA Highlights • Tracking three energy related bills • Bill related to statewide goals around climate action Mercury Standards Discussion Residents voiced concerns at last nights Council Meeting about the federal administration rescinding the EPA’s Mercury and Air Toxics Standards. Councilmember Cunniff authorized staff to comment on rulemaking and provide feedback based on City’s policy agenda. • City Attorney confirmed the Legislative policy allows for staff commenting regulatory rulemaking. • Concerns expressed about impacts on aquifers and Poudre watershed affected by mercury carried from other states. Update from Matt Zoccali, Environmental Regulatory Affairs Manager: PRPA had advanced technology installed since 2009 and no plans on turning it off. The technology to mitigate mercury also provided other consequential benefits. Councilmember Cunniff recommended that City staff comment on the City’s interest in protecting our water from mercury as a contaminant and that we don’t increase the potential for mercury in the Fort Collins water supply. • Staff to comment on how rescinding the rule will impact water quality as well as air quality. Direction to share with PRPA and that no resolution is needed. • LRC would like to have a draft to Council by the next City Council Regular Meeting if possible. Legislative DC Trip Topics to be discussed include: • I-25 • Housing • Train Horn Committee expressed support to share bill tracker with representatives. Next LRC meeting is scheduled for Wednesday, March 20th.
