Gertig, Utilities Executive Director RE: Fort Collins Stormwater Criteria Manual Updates This memorandum is to provide the Leadership Planning Team (LPT) an update on the status of the Fort Collins Stormwater Criteria Manual and its proposed adoption into City Code. The Fort Collins Stormwater Criteria Manual (Manual) is being updated to replace, in its entirety, the previously adopted “Fort Collins Amendments to the Urban Drainage and Flood Control District Criteria Manual” dated December 2011. The objective is to create a single, stand-alone document that incorporates all key design guidance and more effectively communicates the criteria for Fort Collins and its Growth Management Area (GMA). The document will be more user friendly and easier for users to navigate, interpret and apply. The final draft of the Manual is posted on the City of Fort Collins website, and can be found by navigating to fcgov.com/department directory/utilities/business/build & develop/development forms, guidelines & regulations/stormwater criteria manual. Stakeholder engagement started in 2015 with the LID Roundtable Committee to inform and direct the LID Implementation Manual. Additionally, significant stakeholder outreach on the Stormwater Criteria was conducted in late 2017; however, staff determined that additional engagement was needed on some specific Erosion Control Requirements stated in the Manual. Consequently, the Manual adoption was delayed, allowing time to complete this engagement. To date, stakeholder engagement related to the Erosion Control Requirements has included:  Electronic distribution of proposed language to key stakeholders for written comment;  Presentation to key members of the development community; and,  Presentation to the Chamber of Commerce Local Legislative Affairs Committee. DocuSign Envelope ID: 0F08EA82-49C0-4F04-9EA0-9D3233178720 2 Staff received very constructive feedback during the outreach and has recently conducted follow up research and analysis on the more significant topics including:  70% vegetation density requirement  plan/report certifications  erosion control escrows – phasing  individual lot protection requirements and treatment train approach  costs associated with erosion control implementation Staff has recently generated a response document that provides detailed responses for all the key erosion control topics listed above. This document discusses analysis, recommendations moving forward and/or action items. The 70% vegetation density requirement and escrows requirement, however, are two topics that are going to require further analysis and research. Staff is committed to continuing work on these items in the future but is still proposing to include these in the Manual for adoption later this year. Please note that these two topics are not changes to current policy, but were noted to be of significant importance to the development community, so have been deemed to need further analysis after adoption of the Manual. This analysis may include additional outreach to different stakeholder groups, comparison to other similar sized municipalities (i.e. other NPDES Phase II MS4 jurisdictions and State requirements) and cost analyses. Next steps are:  Follow-up with stakeholders with responses and action items  Present the proposed Stormwater Criteria Manual to the Planning and Zoning Board (9/20), Water Board (10/18) and the Development Review Advisory Committee (11/13)  Present the proposed Manual for City Council consideration and action (on consent agenda12/4) If it is determined that a key topic requires significant additional consideration that may delay presentation of the Manual to City Council, Staff will inform Council and propose an appropriate course of action.
