Gertig, Utilities Executive Director RE: City Council Agenda Item #16: Items related to the Resolution of Issues Concerning Josh Ames Water Certificates – Water Board Recommendation City staff presented the two proposals outlined in Agenda Item #16 – Items related to the Resolution of Issues Concerning Josh Ames Certificates, to Water Board at its March 16 regular meeting. The Water Board unanimously supported both proposals. Water Board was provided with a summary of the history of the Josh Ames contract, the proposed Josh Ames agreement, proposed City Code changes regarding the acceptance of Josh Ames certificates, and options for certificate owners. Discussion Highlights Board members inquired about various related topics including details of the proposed agreement and City Code changes, hypothetical scenarios that Josh Ames shareholders may face, shareholders’ opinions of the proposed changes, and staff resources spent since 1984 (and over the past year during negotiations) working to resolve these issues. Approved Motion Board Member Phyllis Ortman moved that Water Board recommend City Council adopt the Resolution authorizing the City Manager to execute the proposed agreement with the Holders of Josh Ames Certificates and recommend that City Council adopt the Ordinance to amend Chapter 26 of the City Code to clarify the Acceptance of Josh Ames Water Certificates to meet Raw Water Requirements. Vice Chairperson Kent Bruxvoort seconded the motion. The motion passed unanimously 7-0.
