Introduction to City's New Contract Lobbyists Policy and Project Manager Sawyer introduced Ed Bowditch and Jennifer Cassel to the LRC. She explained that Ed and Jennifer will be working with throughout the session, providing weekly reports, and participating in LRC meetings by phone when appropriate. Jennifer Cassel has experience in Governor Hickenlooper's administration. Ed Bowditch has been in the Colorado Capitol since the 1980s. Worked for CSU System as CFO when Al Yates was chancellor. In 2006, he left CSU to begin a lobbying firm. Both expressed excitement to be here and represent the City General Assembly Session Update Bowditch explained the 2017 legislative outlook: 2016 Elections: • Key outcome is that the legislature remains in split control and bills will require bipartisan support to pass • About 20 new legislators, 5 new leadership positions Federal considerations on state policy: • Affordable Care Act, Sanctuary Cities funding, federal position on marijuana all stand to alter the state activities and policies. Big items in front of the legislature: • Transportation funding, both the Speaker and Senate President have expressed a willingness to work together. • Hospital Provider fee — exemption from TABOR. • Construction defects — bill already introduced to try and remedy some of the issues. Not viewed as a substantial and critical fix that is needed. Fort Collins o Councilmember Campana noted the City's past actions on construction defects and noted the City's hope to see substantial reform passed. • Affordable housing, possible solutions include the dollar processing fee, Governor may ask for funding related to homeless -related projects. The budget situation continues to look as it has in the past. Challenges include: • TABOR refunds of around $250M. • Refill statutory reserves. • Possible cuts to capital construction and transportation. • Potential Gallagher issue. State's residential assessment rate could decrease by over 1%. Would have large implications on school finance ($150-$250M.) o Asked if County automatically adjusts mill levy to make up for change in valuation and assessment. (No, however increasing property values help to decrease the gap.) Economic Development has seen many tax credits in previous sessions. This year, one of the bigger items in this sphere is the renewal of the State's Economic Development Commission. Governor's office is asking for a 5 year, $5M annual renewal. Environment and Energy has not seen substantial traction in recent years. Will likely see continued debate on fracking and an introduction of a climate bill of rights, which is not expected to go anywhere. Local government issues include TIF/URA, and affordable housing. Transportation items apart from funding include attempts to make public private partnerships more transparent. Ed offered the suggestion of, having a midsession breakfast or lunch to hear legislators perspectives and share the City's take on specific bills or the session as a whole. • LRC expressed interest in exploring this idea. Ed and Jennifer will look at dates that may work well for the three members of the Fort Collins delegation and all of Council. If Council desires, they can explore adding other members of the Northern Colorado Delegation. LRC agreed to poll other council member about whether breakfast or lunch is preferred. Standing Agenda Item: CC4CA Update Lindsay Ex explained that the group is developing a 2017 work plan with associated metrics and outcomes. She shared that a Policy committee has been formed to evaluate bills. • Councilmember Campana expressed a sentiment that staff should ensure alignment between all of these systems operating. Bills of interest to the LRC Fort Collins • PUC bill by Representative Hansen requiring Utilities to store a certain portion of their peak load, e.g., in batteries or other storage options, by a certain date (to allow time for Utilities to phase in this storage). This bill is under consideration and, to staff s knowledge, has not been submitted yet. • Bill related to CDPHE allowing them to pursue a sustainable materials management plan (related to recycling/waste reduction). Councilmember Campana expressed concern about the direction that CC4CA has taken in terms of having a non-profit run the coordination of the group. • Councilmember Martinez agreed with these sentiments • Councilmember Cunniff noted that he expressed similar concerns during the initial conversations about the group. He suggested we moved forward with this year and see how the session goes. o The rest of LRC concurred with this approach. Ex noted that LRC and larger Council has influenced CC4CA at multiple stages and actions, including the decision by the CC4CA steering committee to not pursue a letter signed by all CC4CA Mayors asking the Governor for an Executive Order to establish statewide goals. The CC4CA Steering Committee also expressed appreciation for the LRC's feedback on the importance of establishing goals first and then establishing implementation items. Other Business Councilmember Campana expressed concern that the citizens who helped review the Paris Agreement were all on the same side of the issue. In the future, he stated a desire to include more balance, if possible. • Councilmember Cunniff stated that he thought this is a fair point. He expressed a desire to have a broader Council conversation about what the committee and Council's process is for calling non -staff members to the table. Mason PO Box 580 Fort Collins, CO 80522 970.221-6600 970.224-6177 - fax fcgov.com Re: CC4CA (Colorado Communities for Climate Action) Update Purpose: The purpose of this memo is to provide additional background for the standing Legislative Review Committee (LRC) agenda item on CC4CA in two areas: • Policy updates: To provide brief updates on the bills that CC4CA is or is considering supporting. • Organizational updates: To follow up on LRC discussions regarding how the organization is managed and associated 2017 work planning. Policy Updates: Three bills are currently being considered for support by CC4CA: • Bills that overlap with the Citv's Tracking System: • House Bill 1116 — Continue Low -Income Household Energy Assistance • CC4CA Position (Pending): Support, as it aligns with CC4CA policies, has bipartisan support, and success is likely. • City Position (Pending): Support, as it aligns with supporting low income utility customers as part of the Utilities Affordability Portfolio and City's climate goals. • Senate Bill 089 — Allow Electric Utility Customers to Install Energy Storage Equipment • CC4CA Position (Pending): Support, due to alignment with CC4CA policies. • City Position (Pending): Monitor, as this bill does not apply to municipal -owned Utilities, but staff did suggest potential amendments (see comments online). • Bills that do not overlap with the City's Tracking System: • House Bill 1018 - Extend Voter Approval Window for RTA Regional Transportation Authority Mill Levy • CC4CA Position: Support, due to alignment with CC4CA policies. 11 City Position: N/A, as this region does not have an RTA. • Additional Information: • Staff added a column to the City's bill tracking spreadsheet to indicate CC4CA positions. • The CC4CA lobbyist and staff are attending the Legislative Climate Caucus meetings, both to establish relationships and ensure understanding of related bills. If bills arise out of this caucus, staff will report back to the LRC.
