Councilmember Troxell called the meeting to order at 4:06 pm.
Adoption of the minutes from the February 24, 2015 meeting were moved for
approval by Councilmember Cunniff and seconded by Councilmember Poppaw.
Minutes were adopted without amendment.
Dan described new Colorado General Assembly bills for LRC consideration:
HB15-1038 – concerns the creation of Flexible Water Markets which could be
used as an alternative to buy-and-dry practices related to agricultural water rights.
This bill was postponed indefinitely in the Senate Agriculture Committee
before LRC could consider. Dan noted this bill was carried by Rep. Arndt (Fort
Collins), had previously been introduced by Rep. Fischer (Fort Collins) and might
be back in 2016 when LRC could consider adopting a position.
HB15-1115 – addresses restrictions to the Use of Unmanned Aerial Vehicles
(UAVs) and would prevent their use for personal surveillance. LRC adopted a
monitor position.
HB15-1236 – seeks to create a Tax Credit for Improving Energy Efficiency.
The bill creates an income tax credit for construction or improvements to
affordable housing, multi-family or commercial buildings that attain certain
standards of energy efficiency. LRC adopted a support position.
HB15-1257 – seeks to Eliminate the Penalty to Increase Compliance at
Cigarette Sale. This bill eliminates the prohibition on local governments that levy
fees or taxes on selling cigarettes from receiving a portion of state cigarette tax

revenue. Dan asked that LRC not adopt a position on the bill pending additional
information. LRC adopted no position.
HB15-1259 – concerns allowing Residential Precipitation Collection Rain
Barrels. If approved, the bill would allow residences to use rain barrels to store
and utilize small amounts of precipitation at their property. LRC adopted a
support position.
HB15-1264 – is the Homeless Persons’ Bill of Rights and concerns allowing
“rest” or camping at public spaces and sets up a process limiting harassment of
homeless persons who are resting. Dan stated this bill will do little to address
homelessness and rather creates a two-tier system giving camping rights to
homeless persons in City parks or natural areas that are currently restricted for
camping. Dan noted that he has reached out to Senator Kefalas, the Senate
sponsor, to arrange a meeting on the bill. LRC adopted an oppose position.
SB15-183 – is a bill to Quantify Water Rights Historical Consumptive Use.
The bill concerns the adjudication of water rights and requires that the
measurement of historical use of water be based on the actual historic use for its
designated purpose over a representative study period. Utilities staff has indicated
that this bill could impact the Rigden Reservoir project and possibly other future
projects. LRC adopted a support position.
SB15-212 – would have an impact on emergency situations concerning Storm
Water Facilities not Injure Water Rights. The bill specifies that storm water
detention and infiltration facilities and post-wildland fire facilities do not injure
water rights and so would not need to secure water rights for retention purposes.
The bill is aimed at clarification of the State Engineer’s interpretation that has
concerned the storm water community. LRC adopted a support position.
The LRC then briefly discussed the March National League of Cities
conference in Washington DC. Dan briefly summarized the meetings and
follow-up from the March 2015 NLC trip. Dan asked for feedback and process
improvement opportunities and stated he would circulate some ideas via email
after the meeting.

suggested in this bill should not result in any injury to the City’s water
rights. Most of the City’s Water Utility service area is built out, making
precipitation harvesting less important. However, there is some concern
that if precipitation harvesting becomes widespread as a result of these
pilot programs without adequate replacement obligations it could
potentially injure the City’s water rights.

Summary: This bill expands the definition of first degree criminal trespass to
include the intentional use of an unmanned aerial vehicle (drone) to
observe, record, transmit, or capture images of another person when that
person has a reasonable expectation of privacy. The definition of
harassment is also expanded to include using a drone to track a person's
movements with the intent to harass, annoy, or alarm that person. These
definitions do not apply a peace officer or other government official
acting in his or her official capacity. The bill also modifies state law
concerning retention of records to include information captured by
drones.

rights. Based on initial analysis, the effects of rain barrels on the City
would likely be minor, but more information/study would be needed to
assess potential impacts.

large measure, impinges on business interests in providing the right to
rest in shopping centers, plazas etc as part of the definition of public
space. What I am thinking about is Safeway's story of folks trying to
camp in their elevator and in their underground parking. The business
needs to keep these spaces available for their customers. This bill might
put them at risk of civil damages for sending security to manage these
conflicts of use. How does this protection interact with trespassing laws?
That is not addressed in the Bill. No thought is given to public welcome
centers or day shelters to offer to those without housing. The inclusion of
disparate impact could be opening the door to possible liability too. Do
you think homeless individuals get urinating in public tickets, or
trespassing more, less or the same as the general public? My guess is
more. Could that on it's face put cities and others at risk?

attached to CRTs to be disposed of in any landfill in the state that meets
Subtitle D standards (landfills built based on RCRA requirements). The
City is concerned because disposing of CRTs in landfills releases toxins
into the atmosphere when crushed in collection or compacting on the
landfill face and may leach toxins into soil and water. This is an
unacceptable risk to citizens of our community, which City Council
evaluated in 2007 and elected to act upon by adopting local restrictions
on electronic waste disposal (in advance of state-wide action).

recycling in Fort Collins for the past 10-15 years. These are robust
economic enterprises that would be damaged if a state bill was passed
allowing exemptions for CRTs to be properly recycled. E-waste recyclers
have collected and recycled many millions of tons of e-waste in
Colorado (and Fort Collins) since the ban was put in place and are
creating jobs and revenue while at the same time providing an important
service that helps protect human health and the environment.

Summary: The bill states that when the governing documents of a common interest
community require mediation or arbitration of a construction defect
claim and the requirement is later amended or removed, mediation or
arbitration is still required for a construction defect claim. These
provisions are in section 2 of the bill. Section 2 also specifies that the
mediation or arbitration must take place in the judicial district in which
the community is located and that the arbitrator must:
* Be a neutral third party;
* Make certain disclosures before being selected; and
* Be selected as specified in the common interest community's governing
documents or, if not so specified, in accordance with the uniform
arbitration act. Section 1 adds definitions of key terms. Section 3 requires
that before a construction defect claim is filed on behalf of the
association:
* The parties must submit the matter to mediation before a neutral third
party; and
* The board must give advance notice to all unit owners, together with a
disclosure of the projected costs, duration, and financial impact of the
construction defect claim, and must obtain the written consent of the
owners of units to which at least a majority of the votes in the association
are allocated. Section 4 adds to the disclosures required prior to the
purchase and sale of property in a common interest community a notice
that the community's governing documents may require binding
arbitration of certain disputes.

because (if passed) the bill would likely limit the State from
requantifying water rights that the City owns and is depending on for
future use. Currently, the Utilities is hesitant to file a change of use for
our Southside Ditch (SSD) rights to include Rigden Reservoir as an
alternate point of storage in fear that the State would require
requantification of those rights that could reduce the yield of them.
Planning our water resources to meet future demands of the Utilities
water service area is predicated on the yields of the SSD rights that have
already been established. A requantification of our SSD rights could
reduce the yields available to us in the future and most likely require
additional water supplies to meet future demands. For these reasons, we
should be supportive of this bill. Please let me know if you have any

(26-Feb-15) The Fort Collins Natural Areas Department (NAD) has
taken the lead on providing instream flows through the urban stretch of
Fort Collins. One approach underway involves working with the
Colorado Water Conservation Board to identify and define an instream
flow segment and to quantify the flows necessary to both protect and
enhance the natural environment. This process allows NAD to better
understand and define stream flows necessary to protect the Poudre and
adjacent conserved lands; however acquiring the necessary water
portfolio to achieve these flows is difficult at best. Efforts underway
focus on finding more innovative ways to keep water in stream and will
rely more on cooperative agreements and less on traditional methods.
Several water rights within the Poudre River have undergone a
quantification of historic consumptive use in a previous change decree.
Rarely, however, does the beneficial use include instream flow or other
environmental purposes and may require a change in the decree for use
in channel. Owners of these water rights will be reluctant to open a
previous decree and risk a reduction in the historical consumptive use.

(16-Mar-15) Utilities (Fire recovery): We did not have the opportunity to
pursue sediment catchment basins after the HPF due to geographical and
land ownership constraints, but they still remain a potentially viable and
effective option for future fires, including those that occur in the C-BT
System. Given the magnitude of impact should debris enter HT reservoir,
I think we should advocate to preserve the option to use these temporary
catchment systems.

Division is generally supportive.
