RE: Leadership Planning Team (LPT) Meeting
Mayor Karen Weitkunat, Mayor Pro Tem Gerry Horak, City Manager Darin Atteberry, Deputy City Manager
Jeff Mihelich, Assistant City Manager Kelly DiMartino, Interim City Attorney Carrie Daggett, and City Clerk
Wanda Nelson met on Tuesday, February 17, and the following summarizes the discussions that began at
7:33 a.m.
February 17 Regular Meeting
Under City Manager Review of Agenda, City Manager Atteberry will report that Mayor Weitkunat will make
a statement during Councilmember Reports regarding the legal opinion that was requested for tax
extension ballot questions.
For Consent Agenda Item #2 concerning the On-Bill Utility Financing ordinance, staff reported that a 2.5%
fixed interest rate for loans initiated in 2015 will be offered, based on the current source of capital coming
from Utilities reserve funds.
Staff is asked to provide the following information regarding Discussion Item #12 Smoking in Public Areas:
1. How will unintended consequences of the ban be addressed, such as bar patrons who wish to
smoke? Where will cigarette butts be disposed?
2. Can smoking be allowed on patios after a certain time, such as 10:00 p.m.?
3. What information has been gleaned from Boulder’s experience or other communities with a similar
smoking ban? Does staff intend to visit Boulder to see how the public is dealing with the ban?
A Read-Before memo will be prepared to address the following related to the Lincoln Corridor
Improvements - Discussion Agenda Item #14:
1. When will staff be coming back to discuss the additional $2 million of needed improvements?
2. What is the timeline for completing these projects?
Regarding the items relating to Marijuana Code Amendments (Agenda Item #15), staff is asked to further
describe the term “enclosure” used in Ordinance No. 29. Why is staff recommending an enclosure rather
than something such as a tape outline on the floor? Also, what hours of operation for medical and
recreational marijuana businesses are mandated by the State, and what hours are mandated by Fort
Collins? Finally, the table on page 3 of the AIS states that it would be “difficult for law enforcement without
access to State tracking system. Would be reliant on out-of-town agencies.” Is this something Council
needs to help address with State representatives?

Discussion Agenda Item #17 concerns the City Attorney position. Assistant City Attorney Jenny Lopez Filkins
participated in this portion of the meeting. Staff is asked to amend the resolution to remove the terms
“recruiter and City staff” from negotiations and add “two Councilmembers are authorized to begin
negotiations.” The amended resolution will be projected on the screen and copies will be available on the
table in the hallway.
Due to the need for a possible Executive Session on February 24, Council will consider a motion adjourning
tonight’s meeting to February 24.
Six Month Calendar
The order of items for the February 24 Work Session/Adjourned Meeting will be:
1. CSU Stadium IGA Update. This update will include an overview on major agreements, a timeline,
and preliminary sketches.
2. West Nile Virus Update. Members of the Technical Advisory Committee may be present to hear
this discussion. Staff will be attending the Board of Health meeting on Thursday to discuss
thresholds and predictability for the community.
3. Social Sustainability Strategic Plan.
4. Possible Executive Session.
Other Discussion Items:
Assistant City Manager DiMartino noted:
1. Negotiations with Comcast are nearing completion. A confidential update with the status of
specific negotiation points will be emailed and provided in tonight’s Read-Before packet.
2. Progress continues on an agreement with FCPAN for the additional funding approved through BFO.
Deputy City Manager Mihelich reported on:
1. APP projects used to come to LPT for consideration. After a short discussion, it was stated that the
expectation is that staff not bring APP projects to LPT for review.
2. An MOU is forthcoming between Martin Marietta, the Citizens Against Asphalt Toxins (CAAT), and
the City. Staff will be recommending a Code amendment to require that asphalt truck loads be
covered. Also, all City vehicles will enter or exit the MM plant from the north. As part of the City’s
commitment to Plan-Do-Check-Act (PDCA), staff will prepare a two-page memo about how this
process can influence future purchasing agreements with asphalt suppliers.
3. An unplanned closure at Vine and Lemay today in order for BNSF to repair broken rails.
City Manager Atteberry stated:
1. After 35 years of service, Deputy Police Chief Don Vagge announced his retirement effective May 1.
2. Based on the discussion held with the City of Loveland last week about the Police Training facility,
staff will be bringing forward an appropriation ordinance for design and engineering on March 3.
Also, he is recommending an MOU that authorizes the City Managers of Fort Collins and Loveland
to sign future agreements. Staff is asked to address the following questions related to the
proposed facility:
a. What is the correlation between the costs of the facility and the services received?
b. What is the business plan for paying off the facility?
c. What revenues are we expecting to receive to help pay off the facility?

3. He attended the Simply Red Event sponsored by Team Fort Collins. This community event focuses
on the efforts of non-profits to address substance abuse in teens.
Mayor Pro Tem Horak inquired:
1. He attended a forum last week that concerned vehicle-bicycle collisions. Have other communities
been successful in reducing crashes and serious injuries? If so, what did they do? What is the plan
for Fort Collins - for example, would eliminating bikes on sidewalks reduce the number of
collisions?
2. Can a left turn lane be installed near the Walmart at 12th Street and Lincoln?
Mayor Weitkunat noted:
1. She attended the Poudre Fire District awards ceremony.
2. Representatives from our Sister City San Cristobal were in Fort Collins last week. They are working
on a linear park to go along with one of their natural areas. In April, the City participates in a
cultural exchange with a marimba band. A staff report on the City’s Sister City effort will be
scheduled in March.
A discussion ensued on recent graffiti in midtown, which led to a request for an update on the City’s “Eyes
and Ears” program.
