Agreement of all member entities to the issuance of Debt (CWCB Loan), according to Section 2.05 (f) of the Original IGA 2. Adoption of the revised Service Area Boundary (based on the BBRSA Board of Directors Meeting of December 16, 2010) which includes: a. Areas identified as “Non –Tributary Area” are not to be included. b. The “2-Year Historic Release Area 100 percent fee credit” area is to be designated as the area from which runoff is effectively mitigated by irrigation reservoirs. c. Includes a recommendation for a policy on the effect of irrigation ditches within the Boxelder Basin 3. Agreement that the Authority is allowed to make minor adjustments to the Service Area when, at the request of the property owner, new information is brought forward regarding non-tributary areas (i.e. grant waivers) 4. Agreement amended to decrease the lower end of the Stormwater Service Fee from $0.03 to $0.0277 per square foot impervious surface per year to be consistent with current billing procedures. 5. Determination of a sunset date for the Authority, considering the term of CWCB Loan, repayment of the PDM Grant Matching Funds, and resolution of operations and maintenance issues. Attachments: 1.
