Public comment will be taken at tonight’s meeting. The second item for Council’s consideration is authorizing the conveyance of a non-exclusive utility easement to Public Service Company of Colorado for a 16- inch high pressure gas transmission line within city limits. The third item on the April 29 agenda is a possible Executive Session to discuss potential litigation and related legal matters. May 7 Regular Meeting Mayor Pro Tem Horak requested that an overview be given by Platte River Power Authority (PRPA) regarding their annual report. After “Good News” reports are heard, the order for this agenda will be as follows: 1. 2 nd Reading of Ordinance No. 065, Designating the Jessup Farm Property as Fort Collins Landmark; 2. 621 South Meldrum Appeal; 3. Mall-related items; 4. Urban Renewal Authority (URA) items. A URA meeting is scheduled to be held immediately following the Regular Council meeting. Planning Calendar The City Council Retreat will be held May 3-4. City Manager Atteberry stated all members of Council are not available to start at 4:00 p.m. on Friday; therefore, dinner will start at 5:00 p.m. and the session will conclude at 9:00 p.m. Saturday’s session will begin with breakfast at 7:30 a.m., and the retreat starting at 8:00 a.m. Leadership Planning Team Meeting April 29, 2013 Page 2 of 3 Mayor Pro Tem Horak suggested that one goal for the retreat would be to have a two-year schedule of upcoming Work Sessions and Regular Meeting topics. Deputy City Manager Jones suggested a timetable could be created that would insert topics into a schedule that is broken up into quarters: 2013 2014 Key Initiatives 1 Qtr. 2 Qtr. 3 Qtr. 4 Qtr. 1 Qtr. 2 Qtr. 3 Qtr. 4 Qtr. A. Initiative XYZ B. Initiative ABC C. Initiative 123 It was suggested that a schedule would help clarify expectations. Mayor Weitkunat stated the importance of defining the purpose of public engagement for a particular project or initiative and including the time involved for public engagement in this process. Staff is requested to include a copy of Resolution 2003-117 that describes the process for initiating staff work (generally referred to the “three-council person rule”) for Council’s discussion at the retreat. It was suggested that in addition to the Council Retreat that follows Council elections (such as the upcoming May 3 and 4 retreat) other “mini-retreats” be held periodically to review the Council work plan and provide adjustments as needed. A Work Session for late summer will be added to the “Unscheduled Items” portion of the Calendar to review the Innosphere Report and how the work and results relate to the City’s Economic Health Strategic Plan such as the Business Incubator Strategy. A Work Session on the topic of Amendment 64 and Retail Marijuana will be scheduled for May 28. An overview of Amendment 64 will be provided, and City Council will be asked to explore the options involved, including not banning retail marijuana, banning retail marijuana, adopting a moratorium on retail marijuana until the State promulgates Retail Marijuana Rules and Regulations, permitting private marijuana smoke shops, etc. Other Discussion Items/Questions City Clerk Nelson reported staff met with Kathie Guckenberger, the City’s Medical Marijuana Authority. After discussing the possible option of issuing temporary licenses to those businesses who are unable to operate due to the length of time it is taking for CBI background checks to be returned, Ms. Guckenberger stated that it is her opinion that the local issue passed by Fort Collins’ voters (301) and the State’s Medical Marijuana Code do not give her the authority to grant conditional medical marijuana licenses. She will issue this opinion in writing this week. CBI fingerprint results are taking 6 – 9 months to process. It was suggested that Leadership Planning Team Meeting April 29, 2013 Page 3 of 3 citizens could contact the Governor and/or State Representatives to voice their concerns and encourage resources be directed to address the backlog. City Manager Atteberry reported that there will be a public meeting tomorrow night with the Board and Commission Chairs and Vice Chairs to provide an update on the Foothills Mall. Assistant City Manager Williams noted that, with the Senior Center Expansion, an inquiry has been raised about naming rights within the facility. For example, a new dance studio could be named for a certain sponsor who donates at least 75% of the cost to build the studio. Ms. Williams will be bringing forth a memorandum that describes the current policy on naming rights and details about a proposal. A Work Session to discuss the City’s policies, the proposal and a staff recommendation will be scheduled. Mayor Pro Tem Horak stated that the International City Manager’s Association (ICMA) is going to offer a session on train noise in communities, and a survey is being sent by the Colorado Municipal League (CML) to Colorado City Managers on this issue. Last Friday, a citizen sent a request that staff provide answers to almost 100 questions related to the Foothills financial package. Staff will try to respond to as many as possible and provide references to the available information. City Manager Atteberry reported that staff successfully utilized an Automated External Defibrillator (AED) on a resident who had a heart attack at a City recreation center. The citizen is recovering at a local medical facility. A discussion was held regarding the recent parties, crowd and neighborhood issues that arose last Saturday night. Staff is asked to take an in-depth and systemic looks at the issues and approaches related to these types of incidents. With party registrations and the chatter of social media sites, staff often can identify “hot” weekends. Staff is asked to work with CSU as to how we can improve identifying and anticipating potential problems, what we can do to prevent or deploy resources to mitigate negative impacts? Regarding the Collective Bargaining bill currently being considered by the State Legislature, a letter from Mayor Weitkunat is being sent today. Meeting ended at 9:51 a.m.
