May, Chamber Of Commerce, Re: Agenda Item #6 � Poudre River FloodplainMarch 18, 2013 Fort Collins City Council 300 LaPorte Fort Collins, CO 80521 Dear Mayor Weitkunat, Mayor Pro Tem Ohlson and Council Members Horak, Kottwitz, Manvel, Poppaw and Troxell; The Fort Collins Area Chamber of Commerce would like to thank the City Staff and the Working Committee for their months of work relative to amendments to the City Code Relating to Development in the Poudre River Floodplain. This has been an extensive process and the proposal moving forward is much more business friendly than those concepts, including No Adverse Impact, which were presented early in the evaluation process. We are pleased to see that Stormwater and PFA Staff will be available to provide technical assistance and support to the 232 potential applicants in preparing the Emergency Response Preparedness Plans (ERPP). We are hopeful that regular training and outreach will be provided for these businesses as we move past the first implementation of the ERPP. We would also like to see the Code updated to include an indemnification clause for the business owners and individuals completing the ERPP to address the issue of liability. We are strongly opposed to the Water Board recommendation to prohibit any new structures in the 100-Year Floodplain and hope that the Council will honor the extensive 27 month process that led our community to the ERPP solution being presented to Council on March 18.
