As our City pulls out of a general financial contraction, our concern is that by issuing any outright ban on hydraulic fracturing or “fracking” in any areas within city limits, Council will subject Fort Collins to costly litigation not only because of State oversight rights, but also because such a ban will be an illegal taking of personal property. The Board recognizes that questions exist on the long term safety of hydraulic fracturing, and suggest that Council continue the present moratorium while studying the safety issue in depth. During this period of study, the Board again urges Council not to reject existing studies that support the use of fracking as a technology used in oil and gas development. The Board worries that a general hysteria about this issue is preventing an open and fair review of the issue. Respectfully Submitted, Dean Hoag Dean Hoag, President NFCBA
