Commercial Corridors and Centers Land Use Code Updates During First Reading of the Land Use Code, Councilmembers requested additional specificity around the definition of boat sales.  The Land Use Code updates prohibit the use ‘Boat Sales with Storage’ within the Transit Oriented Development Overlay (TOD).  At First Reading, Councilmembers asked whether language could be included that would not prohibit sales of smaller watercraft.  Prior to Second Reading, staff prepared a definition for ‘Boat Sales with Storage’ (Boat sales with storage shall mean the use of any land for the (1) sales of watercraft or (2) the display, storing, or repair of new or used watercraft outside of an enclosed building. This use does not include temporary sidewalk, tent, or open-air sales of watercraft, any of which are accessory to a retail store and have, as applicable, been City approved.) o It is considered best practice to have a definition for all listed uses within the Land Use Code. For this reason, and the request from Council, this definition was provided. o The above definition specifies that the term does not include watercraft sales that are accessory to a retail store sold in a sidewalk, tent, or other temporary setting. Docusign Envelope ID: CCD3228F-5613-42D6-B92C-4F6650EC4981 2 Specifically, this would not preclude a retail store from selling and displaying canoes, kayaks etc. indoors at any time, or outdoors in a temporary display.  There is currently no Boat Sales with Storage in the TOD Overlay and no development applications in review. The impact of this definition is intended to add clarity on what is prohibited by the proposed code change. It will not have impact on current retail establishments in the area.
