Box 580 Fort Collins, CO 80522 970.221.6515 970.221-6295 - fax fcgov.com/cityclerk MEMORANDUM DATE: October 21, 2024 TO: Mayor and Councilmembers FROM: Delynn Coldiron, City Clerk RE: Leadership Planning Team (LPT) Meeting Mayor Jeni Arndt, Mayor Pro Tem Emily Francis, City Attorney Carrie Daggett, City Manager Kelly DiMartino, Deputy City Manager Tyler Marr, and City Clerk Delynn Coldiron met on Monday, October 21, 2024. The following summarizes the discussions that began at 8:00 a.m. October 22nd Work Session • Impact Fee Discussion – it was noted that waiving affordable housing fees and other related policies should be a separate discussion since there are so many things to consider. This can be touched on during the discussion, but a separate work session will be scheduled on housing topics during the first quarter of 2025 where more detailed discussion on this could occur in conjunction with Council’s priority on the topic. Six-Month Calendar • Land Use Code Phase 2 – it was noted that in addition to the Work Session on November 12, this work would be coming for additional Council touch points next year. There was a question on if this could be retitled from a communications and marketing standpoint to better reflect for the public the conversation Council would be having, i.e., updating of regulations for commercial corridors and centers. • ADUs – it was noted that this item should be added to unscheduled items or calendared if a date is known for the anticipated work session. City Clerk Delynn Coldiron • Election Code Committee meeting today, 4:00 p.m., Council Information Center, 300 LaPorte Avenue, Fort Collins. Councilmember Canonico will be absent, so Mayor Arndt offered to chair the meeting. • Colorado Municipal Clerk’s Association (CMCA) Conference is occurring Tuesday – Thursday this week. It is being hosted by the City of Fort Collins and will be held at the Elizabeth Hotel. City Clerk Coldiron thanked Mayor Arndt and City Manager DiMartino for their participation in welcoming everyone. Deputy City Manager Tyler Marr • Noted there was a recent CBS Denver story on the City’s trash contract. He added that the Coloradoan also ran an article on the landfill and the County’s solid waste work. City Attorney Carrie Daggett • Noted Jenny Lopez Filkins, Senior Deputy City Attorney, will be covering the work session tomorrow night. • Noted process improvements are underway in partnership with the Clerk’s office to ensure an additional final check of agenda materials, especially for items where amendments were made on first reading or revisions were requested between first and second reading. • Asked about the appeal process slides from the Sanctuary on the Green appeal hearing and if they were helpful. There was agreement that these were helpful and an ask to attach the slides to these LPT notes (see attached). • Noted staff is reviewing a federal court decision issued last week about the Denver Water Gross Reservoir project and will provide follow up to Council on that soon. City Manager Kelly DiMartino • Noted last week a number of SARs were submitted regarding fluoridation of the City’s Water. Tom Gonzales, Larimer County Public Health Director, sent a memo related to this providing the stance of the LCPHD. The City does not plan to make any changes related to current practice based on this. LPT confirmed that no work session is currently needed on the topic. Mayor Pro Tem Emily Francis • Asked about how motorcycle lane splitting is being enforced and whether community education is occurring relating to this. Staff will follow up. • Noted the Sheely Addition neighborhood has a street spur that goes to Spring Creek that has been closed due to construction. Barricade signs are full of graffiti. Staff was asked to follow up and to provide a related follow up to the neighborhood regarding the status of the project. • Housing Catalyst board meeting last week. They are now advising developers on how to make 80%- 120% AMI work. Speaks to how difficult it is to building affordable housing units right now. Talking about cutting back housing vouchers because they are having to make up more of the gap to get the units built. Leadership Planning Team Meeting October 21, 2024 Page 3 of 3 Mayor Jeni Arndt • Noted there is a streetlight on East Prospect Road past Timberline that is flickering creating a safety hazard. Staff will follow up. • Attended CityLab in Mexico with City Manager DiMartino and noted that a lot of great information was learned and exchanged. She thanked Mayor Pro Tem Francis for covering for her while she was gone. • Noted the ballot issue that has been raised and stated all parties involved have some level of responsibility related to this, including Council. She was glad to hear that process changes are underway to help avoid this from recurring. Meeting adjourned at 8:50 am. Attachment: Appeal process slides 1Appeal Hearing Overview •Council will review the Hearing Officer decision of July 24 with July 28 supplement approving the Project. •Review is based on the record before the Hearing Officer (rather than new evidence) and the arguments and responses presented at the appeal hearing. •Only issues raised in the Notice of Appeal may be considered. •The presiding officer (Mayor or Mayor Pro Tem) will resolve procedural issues and set the time for each “side” to present and rebut arguments. •The Council will vote by motion at the end of the hearing. •A Resolution will be presented at the next Council meeting to finalize outcome. 2Parties-in-Interest •Only parties-in-interest are allowed to participate in the appeal hearing and only at the specified time. •The presiding officer will ask all those participating to identify themselves early in the hearing. •The Appellant will control the time for speaking in support of the appeal. •Parties-in-interest include: •The appellant(s); •The applicant; •Any party with a proprietary or possessory interest in the land that is the subject of the application; •Any person to whom the City mailed notice of the Hearing Officer hearing; •Any person or organization that provided written comments prior to or at the Hearing Officer hearing; or •Any person or organization that appeared before the Hearing Officer at that hearing. 3Hearing Sequence 1.Process Overview (City Attorney) and Staff Explanation of Appeal 2.Disclosure of Any Conflicts and Site Visit Observations 3.Identification of Participating Parties and Spokespersons 4.Allocation of Time for Party Presentations and Rebuttals 5.Consideration of Procedural Issues, Including New Evidence Objections 6.Appellant Presentation 7.Opposer Presentation 8.Appellant Rebuttal 9.Opposer Rebuttal 10.Council Questions of Staff or Parties 11.Council Discussion 12.Council Motions on Fair Hearing and Interpretation Issues
