Changes Related to Residential Occupancy – for July 1, 2024 Council

Purpose: The purpose of this memorandum is to update Councilmembers on the discussion
that occurred at the Planning & Zoning Commission hearing on June 20, 2024.
Background
On June 20, 2024 the Planning & Zoning Commission conducted a Regular Hearing to make a
recommendation to Council regarding changes to the Land Use Code to conform with
requirements of House Bill 24-1007, Prohibit Residential Occupancy Limits.
Discussion
Following are the notes and points of discussion from the hearing:
The meeting was held in-person with 6 of the 7 members present. Support staff were present in
person and remotely, and the public was able to provide comment in person and remotely.
Amending the Land Use Code Related to Occupancy
This is a request to recommend that City Council adopt the proposed occupancy
ordinances related to compliance with House Bill 24-1007, Residential Occupancy
Limits.
o There was no public comment.
o Commission Discussion included:
Single unit versus single family as well as the use of multi-unit and multi-
family and alleviating frustration when searching through code language. The
change has already taken place to “unit.” Staff commented that there is now
a table in the code to help with the reference and noted that the Commission
would like to see a definition in the next update of the Land Use Code.

There was mention that the State law does not allow jurisdictions to impose
occupancy restrictions on residents, which would include extra-occupancy
and group home regulations.
o A motion was made that the Planning & Zoning Commission recommend that City
Council adopt the proposed Land Use Code amendments to remove the residential
occupancy limits. The motion passed unanimously.
