Mayor Jeni Arndt, Mayor Pro Tem Emily Francis, City Manager Kelly DiMartino, Deputy City Manager
Tyler Marr, City Attorney Carrie Daggett, City Clerk Delynn Coldiron and Deputy City Clerk Heather Walls
met in person on Monday, July 1, 2024. The following summarizes the discussions that began at 8:01
a.m.
July 2, 2024, Regular Meeting
• Item 3 Appropriating Prior Year Reserves in the Redlight Camera Fund Within the General Fund for
Additional Staffing for Municipal Court and City Attorney’s Office to Support the Increased Police
Enforcement Cases appropriates additional funding for attorney and court staff to support the current
increase in police enforcement cases.
• Item 7 Relating to the Repeal and Reenactment of Certain Ordinances was added due to the failure
of the Coloradoan to publish the second readings adopted on June 18.
• Item 8 Calling a Special Election to be Held in Conjunction with the November 5, 2024, Larimer
County General Election is required when the City anticipates including questions for the ballot during
an election that is not a regular municipal election.
• Item 10 Relating to the Appointment and Reappointment of Assistant Municipal Court Judges will
approve 3 reappointments and 5 new appointments of assistant judges.
• Item 11 Relating to Residential Occupancy Ordinance is on discussion due to the split vote. No
presentation is planned.
• Items 12-14 Relating to a City Initiated Charter Amendment will begin with a general overview
followed by a presentation on each proposed Charter Amendment with a pause after each item for
public comment, Council discussion, protest hearings where applicable, and Council vote.
o A protest has been filed on Items 13 and 14 relating to Article IX, Recall provisions, and Article X,
Initiative and Referendum, which protest is attached for reference.
The protestor makes 4 main points relating to Item 13: 1) the required timeframe for Council
Action and the timeframe allowed for the election on the recall should be adjusted to 120 days;
2) the period of time to file a protest should not be shortened; 3) the allowance to cure a
petition insufficiency should not be removed; and 4) petitions should be allowed to be
circulated via electronic means.

For the protest to Item 14, the protester similarly protests the revisions to the required
timeframe for Council setting of the election, the removal of the allowance to cure a petition
insufficiency; and suggests that petitions should be allowed to be circulated via electronic
means.
Related to election timeframes, it was noted that the current provisions for Council action are
generally not workable with today’s election rules and timeframes.
The current protest process is included as an attachment to both items noting the current
Charter language since the items are proposed as a repeal and reenact item.
o The Public Hearing process for the protest is included in the Council rules and will be added to
the Mayor’s script.
o The July 2 agenda will be amended to add the protest and presentation updates.
• The July 2 agenda will also be amended to add a possible executive session relating to a legal matter
concerning ECMC and local oil and gas matters. (Since the meeting it has been determined this will
be shifted to the July 16 meeting to allow information to develop further.)
• At the time of the meeting, eight members of the public were signed up to speak on various topics at
the July 2 Council meeting.
July 9, 2024, Work Session
• Halligan Water Supply Update to inform Council of current status. Staff will likely have submitted the
1041 permit application to the County.
• Water Supply Requirements will discuss cost estimates based on Council feedback given to date.
• West Elizabeth Corridor update will be highlighted outside of other capital projects to discuss current
status and funding needs.
Six-Month Calendar
• 7/16 Staff report on the Police Explorers Program has been added to highlight recent
accomplishments.
• 7/16 An Executive Session relating to Collective Bargaining Agreement has been added. (New since
LPT: the Executive Session regarding the ECMC and the Fort Collins oil and gas field will be shifted
to this date from 7/2 to allow information to develop further.)
• 8/20 Added Prohibit Retail Sale of Puppies and Kittens. It was noted that a memo was requested
relating to staff research on the measure.
• 10/22 Equity Indicators Update – Originally scheduled for October 8, this item has been moved to
October 22. A memo will be provided with the report next week.
• 10/22 – Added Water Efficiency Update

• 10/15 Urban Forest Strategic plan should be on Discussion and At a Glance
o Staff is not recommending a work session. Council will be provided with a draft and highlights of
where Council input has resulted in specific language for review well in advance of adoption in
case a change in course is desired.
• 7/16 Airport item relating to a grant agreement for the Taxiway Project has been removed because it
does not meet the threshold that requires Council approval.
City Clerk Delynn Coldiron
• Sr. Deputy Clerk position closed on Tuesday, June 25 with 13 applicants. Interviews will be
conducted in the next couple of weeks.
Deputy City Manager Tyler Marr
• Public comment is expected on the concrete batch plant located at 287 and Highway 1 which is in
our GMA but not annexed into the City so under the jurisdiction of the County. A read-before memo
will be provided to give background on City organization involvement to date, which has included a
comment letter. If Council wishes to have staff engage further, staff welcomes that direction.
City Attorney Carrie Daggett
• Jenny Lopez-Filkins will cover the Council meeting on July 16.
City Manager Kelly DiMartino
• Connexion is celebrating its 20,000th customer and would like to do a community promotion at the
work session on August 27. A random drawing will be held to select 20 customers to receive free
service for a year.
Mayor Pro Tem Emily Francis
• Kudos to the Laporte Project Team for the efficient work on the project and ongoing communication
to Council and residents.
Mayor Jeni Arndt
• The Interim Airport Director’s last day was last week. Francis Robbins is acting until a permanent
director is hired.
• July 4th activities are set and Council participation instructions will be confirmed. Kudos to the staff
team working to ensure a fun and safe community day of festivities.
• This afternoon at 4:30 pm is the 9/11 Memorial opening. All Councilmembers plan to be in

I would like to protest the ballot language as follows:

Item #13 Items Relating to a City Initiated Charter Amendment Relating to Recall
ARTICLE IX. RECALL
I oppose the removal of the maximum duration of time in the revised Article IX Section 1 The
Recall, Section 3 Action by Council item (b). I suggest a reasonable 90 or 120 days should be
the maximum.
The revised Article IX, Section 2 Petitions, item (h) Protests, item (1) has incorrectly
decreased the original time from 10 days to 7 days.
The revised Article IX, Section 2 Petitions, item (h) Protests, item (7) has removed the entirety
of the original text that stated “In case the petition is deemed insufficient, whether following
the initial determination by the City Clerk, or following protest proceedings, it may be
withdrawn and amended within fifteen (15) days from the filing of the City Clerk's certificate
of insufficiency. The City Clerk shall, within five (5) days after such amendment, examine the
amended petition and the registration books and certify the result. If the petition is still
insufficient, or if no amendment is made, the City Clerk shall return it to one (1) of the
designated petition representatives without prejudice to the filing of a new petition for the
same purpose.”
With today’s technology for signing lawful documents including the Federal IRS and
Colorado income tax, the requirement under the revised Article IX, Section 2 Petitions, item
(c) Circulation of Petition, item 4, is not relevant and prohibits the efficient means that are
available to gather required signatures. Changes should also be incorporated into section (d).
The voting information should include the above details so that the voter can readily
understand the differences between the original and proposed revision.
I suggest the Ballot Language to include:
Totally removes the maximum duration of time in the revised Article IX Section 1 The
Recall, Section 3 Action by Council item (b).
Article IX, Section 2 Petitions, item (h) Protests, item (1) has decreased the original

Removes the entirety of the original text Section 2 Petitions, last paragraph
starting with “In case the petition is deemed insufficient, whether following the initial
determination by the City Clerk, or following protest proceedings ….

Item #14 ItemsRelatingtoaCityInitiatedCharterAmendmentRelatingtoInitiativeandReferendum
ARTICLE X. INITIATIVE AND REFERENDUM
The revised Article X Initiative and Referendum, Section 3 Action by Council, does not
include the original text that states”if the initiative petition proposing such measure requests a
special election, the proposed measure shall be submitted to a vote of the registered electors at
a special election to be called by the Council within one hundred twenty (120) days of the
presentation of the certified petition to the Council, unless any other regular or special city
election is to occur within said period, in which case the proposed measure shall be submitted
at such other regular or special city election.”.
With today’s technology for signing lawful documents including the Federal IRS and
Colorado income tax and contracts, the requirement under the revised Article X, Section 2
Petitions, item (c) Circulation of Petition, is not relevant and prohibits the efficient means that
are available to gather required signatures.
The revised Article X Initiative and Referendum, has totally eliminated the original text of
Section 5 Petitions, (f), (2) Insufficient petition; amendment, This is a gross change that
should not have been done, and the original text should be included.
I suggest the Ballot Language to include:
Removes original text Section 1. Initiative, (e), starting with the sentence section “if the
initiative petition proposing such measures …..
Removed entirely the original text Section 5 Petitions, (f), (2) Insufficient petition;
amendment.
