Councilmembers Present: Councilmember Canonico (chair), Councilmember Pignataro (virtual),
Councilmember Ohlson

1. Approval of minutes from March 26 meeting. Canonoico moved, Ohlson seconded. Minutes
approved unanimously.
2. Bill review
a. HB24-1460 Law Enforcement Misconduct
i. Bill is in the Senate and review should begin soon.
ii. Whistleblower protection. Just about to start.
b. Land Use Bills: HB24-1152, Accessory Dwelling Unit (ADU) Bill and HB24-1313, Transit
Oriented Communities (TOC) Bill:
i. CML is requesting an amendment on the ADU bill trying to grandfather in
municipalities that have an ADU policy in place.
c. HB24-1173, Amendment to the EV Charger bill:
i. Places more restrictions on local governments, tighter timelines, projects bumped
to top of queue.
d. HB24-1107, Local Land Use:
i. Passed the Senate and onto Governor’s desk.
ii. Protecting City in recouping court costs and attorneys’ fees was the basis for the
City’s support of the bill.
e. HB24-1296, Modifications to the Colorado Open Records Act:
i. Rep Kipp made modifications to this bill. Bill passed the house, was scaled back a bit.
ii. Provision removed to identify a “vexatious requester” – still gives some flexibility for
compliance with the requests.
f. HB24-1454, Digital Accessibility Bill:
i. One year delay in the digital accessibility bill. Maintains the deadlines and moves
penalties back a year – until July 1, 2025.
ii. Passed out of committee unanimously and now goes to house floor.
iii. Municipalities must show they are making clear progress to avoid penalties. City of
Fort Collins is in a support position.
g. Property tax bill: Calls for a decrease in the non-property tax assessment rate. No bill
number yet. Task force will discuss the bill on Friday.

h. HB24-1168: Equal Access to Public Meetings:
i. Bill is unlikely to move forward.
i. HB24-1018, Textbook bill:
i. This bill is not moving forward. Bill may be brought forward during the next
legislative session. Rep Boesenecker will be part of those discussions.
j. SB24-106, Right to Remedy construction defects:
i. Passed Senate two weeks ago and hasn’t been introduced in the house – is unlikely
to pass.
k. Councilmember Ohlson asked about the vulnerable road user bill:
i. Jennifer Cassell response: postponed indefinitely, first bill died.
ii. Established a fee on all medium and heavy-duty cars in populous counties.
iii. Confusion over where local jurisdictions will have authority. Collaboration on this
one will be important.
l. HB24-1334, Broadband Service for Multiunit Buildings:
i. Rep Boesenecker’s bill. Scheduled for committee on Thursday.
ii. Will be rescheduled as soon as senator Hanson is ready.
iii. Allows public broadband to put infrastructure in mobile home parks and multi-
dwelling units.
m. Councilmember Ohlson questions:
i. ADU Bill: Expressed interest in scale and mass requirement, and interest in
grandfathering existing ADU rules in municipalities.
ii. Jennifer Cassell response: Bill was pulled from the calendar. Perhaps more
amendments are coming.
iii. HB24-1313, Housing and transit-oriented communities: concerned about the ½ mile
from transit corridors.
iv. Jennifer Cassell response: Housing opportunity goal 89,000. Still concerned about
HUTF funding and want to be sure that we’re close to compliance. Penalty will likely
be removed from the bill.
n. HB24-1304, Parking minimums bill:
i. Has yet to have first Senate hearing.
o. SB24-166, Air Quality and Enforcement:
i. Risk of civil action to the City.
ii. City holds a number of these air quality permits.
iii. Has been in the Senate finance committee and has not moved.
iv. Part of a larger negotiation for ballot measures that have been submitted.
p. Megan DeMasters, CC4CA bill:
i. Draft renewable energy bill. Standards statewide on how local governments permit
and would be complex to comply with. Could be turned into a study bill and waiting
to hear more.

ii. Legislative wrap-up: May 28th work session is the Legislative Wrap-
up. At minimum, bring Jacob to LRC for a deeper dive on these things. May 28th is
meant for highlights that will impact Council’s policy work plan as a result.
q. HB24-1379: Two bills on dredging.
r. SB 174, Affordable Housing assistance:
i. CML bill.
ii. CC4CA moved to a support position on that bill.
iii. Has passed the senate and will start its house journey.
s. HB24-1436, Sports Betting Tax Revenue:
i. Might be referred to the ballot.
ii. Would allow to “debruce” the sports betting revenues.
t. SB24-194, Special District taxing ability:
i. Fire chiefs are supporting.
