The following summarizes the discussions that began at 8:08 a.m. 12/19/2023 Regular Meeting: • The published agenda for this meeting was reviewed. • The consent calendar was reviewed. There are three sets of minutes for approval, 12 second readings of ordinances, and 3 resolutions on the consent calendar for approval. • There are three discussion items on the agenda including options for required action regarding Ordinance No. 136, 2023 relating to the Land Use Code as a result of the certification of a petition as sufficient for referendum, approval of an IGA relating to the FAA Contract Tower Program, and a resolution expressing gratitude and appreciation to Shirley Peel. o Chief Deputy City Clerk Knoll summarized the protest hearing held on Wednesday, December 13, regarding the Land Use Code referendum petition. One protest was filed, and private attorney Geoff Wilson served as the hearing officer. The protest contained two individual protests. The second protest, having to do with the same group petitioning again within a year to refer the Land Use Code to the voters was dismissed by the hearing officer because it did not concern the sufficiency of the signatures on the petition. The first protest was then considered, and the protestor and her witness testified and answered questions by the hearing officer. This portion of the protest was also dismissed because the protestor was unable to identify, with particularity, those signatures that should not be counted. Absent a protest affecting the outcome of the review of the petition, the City Clerk certified the results, bringing us to the item under consideration tomorrow night. Leadership Planning Team Meeting December 18, 2023 Page 2 of 3 Discussion Items: • The Mayor will announce that on discussion Council will first consider Item 19, Resolution 2023-117 Expressing Gratitude and Appreciation to Shirley Peel for her Service and Contributions to the Community as City Councilmember, rather than considering that item as the last discussion item. • Item 17 regarding the reconsideration of Ordinance No. 136, 2023: City Clerk Hollingshead (participating remotely) will start the presentation on this item. It was requested to ensure there is a clear message to Council during tomorrow night’s meeting about the reality of special election timing in case of referral of the Land Use Code to the ballot. Following a review by the City Clerk of the options available to Council in reconsidering the ordinance adopting the Land Use Code, PDT Director Caryn Champine and Senior Project Manager Sylvia Tatman-Burruss are prepared to present additional information about the options presented to Council at the point of adoption of the LUC in response to the Other Business request made at the December 5 Council meeting. 6-Month Calendar: Upcoming meetings were reviewed with particular attention to any shifts. February 13 Work Session: Clarity was sought on the Water Efficiency Plan item. It was discussed that this was separate from the Water Supply Requirements item coming in April. It was also requested that this work session item addresses questions brought up about overall water use goals at the Xeriscape Work Session held in November 2023. April 9 Work Session: Concern was expressed about whether there would be enough time for Community Capital and Street Renewal Maintenance ¼ Cent Renewals discussion item and the Water Supply Requirements (WSR) Review scheduled for that night, given that Council Finance requested last week that a capital expansion fee discussion be held the same night as WSR. The Executive Lead Team will discuss this at their weekly meeting. Chief Deputy City Clerk Rita Knoll • No additional items. Assistant City Clerk Amani Chamberlin • No additional items. City Attorney Carrie Daggett • Reply briefs in the Open case are in progress and due on Friday. At that point the case will be before the Judge awaiting a final decision on damages to be awarded. Deputy City Attorney Jenny Lopez Filkins is stepping in as Acting City Attorney over the holiday period, beginning Wednesday afternoon. Deputy City Manager Tyler Marr • No additional items Leadership Planning Team Meeting December 18, 2023 Page 3 of 3 City Manager Kelly DiMartino. A notice will be sent out to customers confirming that there will be no water supply requirements fee increases this year; noting Council consideration of fees will take place in 2024 with likely increases in 2025. Mayor Pro Tem Emily Francis • Requested a minor correction to the minutes that are to be approved on December 19. Mayor Jeni Arndt • A request has been received from the City and County of Denver regarding the possibility of Fort Collins taking refugees again this year. Staff will coordinate this conversation with Larimer County. • Has been elected chair of the Airport Commission with Jerry Stooksbury as selected as vice chair. • Shout out to Jacob Castillo and Honore Depew and their teams for facilitating a discussion about her attendance at the 28th meeting of the Conference of Parties at the United Nations Framework Convention on Climate Change (COP 28.) Was grateful for the open and realistic discussion, as well as for the great job by Raj Singam Setti, Platte River Power Authority’s Chief Transition, and Integration Officer. Reflected that having a debrief of this conference was valuable. Meeting adjourned at 8:47 a.m.
