The following summarizes the discussions that began at 8:03 a.m. Notes: 12/12/2023 Work Session: • The published agenda for this meeting was reviewed. The order of items was confirmed with no additional changes. • A read before memo is expected prior to the work session to include an edited version of the Larimer County Public Health Update Presentation. 12/19/2023 Regular Council Meeting – • The initial draft agenda for this meeting was reviewed, including the items planned for the consent agenda, discussion items, and other business items including calling a special meeting for January 9, 2024, and conducting an executive session for the purpose of the annual evaluation of the city Manager. • The consent agenda includes approval of minutes, 12 second readings, no planned First Readings, and potentially four Resolutions. It was noted that the resolution approving an Intergovernmental agreement with Poudre School District and Poudre River Library District for acquisition of land and construction of the Southeast Community Center is a good news item that should be highlighted. This can be done during Consent Calendar follow-up rather than moving the item to discussion. • A resolution approving a Tower Operating Agreement with the FAA for the Northern Colorado Regional Airport will be moved to discussion. This will allow Airport staff to share the reasons it is important for this action to be taken at this time. Ryan Malarkey has been working on this item with Airport staff, and someone from the Airport will be identified to speak to the item in front of Council. • Also on discussion is a Resolution recognizing Councilmember Shirley Peel for her service at her final regular meeting. This will be the final discussion item on the agenda. Leadership Planning Team Meeting December 11, 2023 Page 2 of 3 • It is possible the referendum petition may also be presented to Council at this meeting. If so, it will be the first discussion item. o It is not yet known if the current protest of the determination of sufficiency of the petition will be complete in time for a sufficient petition to be presented at this meeting. If the protest hearing scheduled for this Wednesday, December 13, concludes quickly and the hearing officer issues findings in time, a petition certified as sufficient would need to be considered by Council at the December 19 meeting. o A petition certified as insufficient would end the referendum process and would not be presented to Council at all. o A certification of sufficiency after December 19 would need to be presented to Council at the January 9 Special Meeting. If that is the case, the call of the special meeting under Other Business on December 19 would need to include that subject matter as well. o If the petition is certified as sufficient, at whichever meeting it comes forward to the decision Council will need to make is whether to a) repeal Ordinance No. 136, 2023, or b) refer the ordinance to the voters at an election. The request from Council under Other Business on December 5 will be reflected in this item by including an overview of the options that were presented to the Council for its consideration when adopting this ordinance. 6-Month Calendar: Upcoming meetings were reviewed with particular attention to any shifts. February 6 Regular Council Meeting: • Appeal has been scheduled for this date regarding the POLESTAR Development. Assistant City Clerk Amani Chamberlin • No additional items. City Clerk Anissa Hollingshead • The protest hearing for the protest filed Wednesday, December 6, relating to the referendum petition against Ordinance No. 136, 2023 has been set for Wednesday, December 13. The City Charter requires a hearing be scheduled to begin within seven days of the time the protest is filed. The City Manager has appointed a hearing officer who will be conducting the hearing. The hearing officer provided via email on Sunday evening, December 10, the parameters for the conduct of the hearing, including for presenting evidence and testimony by the protester, as well as the planned order of the hearing. • The hearing is public, and the public is welcome to attend. However, no public comment or testimony will be taken. The protester will be able to provide evidence and testimony in support of the protest, including from witnesses. • Information about the protest hearing has been shared with Council and City staff and is posted on the City’s website on the referendum page at: fcgov.com/elections/referendums. Assistant City Manager Rupa Venkatesh • Asked for a decision on cancelling LPT on December 26. That date will be cancelled. Leadership Planning Team Meeting December 11, 2023 Page 3 of 3 City Attorney Carrie Daggett • Briefs filed last week in the Open case will be sent out today regarding how much the court should award in damages and addressing other outstanding issues in the case. There is a 10-day period for filing replies to these briefs, after which it will be in the judge’s hands for a determination. • There was a hearing on Friday in the Stacy Lynn records case Regarding Internal Affairs records. City Manager Kelly DiMartino • Reminder that tonight is the City employee appreciation night at the Garden of Lights at Gardens on Spring Creek. Mayor Pro Tem Emily Francis • No additional items. Mayor Jeni Arndt • Attended last Wednesday’s Downtown Development Authority Holiday Celebration and found it very nice and a reminder this is a time to potentially slow down, celebrate and show gratitude. • Will be participating in tonight’s Menorah lighting in Old Town Square. Meeting adjourned at 8:42 a.m.
