The following summarizes the discussions that began at 8:00 a.m. 11/28/2023 Adjourned Meeting: • The published agenda for this meeting was reviewed. This meeting will not offer remote participation or be televised on FCTV. Participation will be live in Council Chambers prior to when City Council adjourns to executive session in the Council Conference Room. December 5 Regular Meeting: • The consent calendar was reviewed. There are 12 second readings, 10 first readings and 9 resolutions along with two sets of minutes planned for the consent calendar for approval. • Ordinance No. 157, Making A Supplemental Appropriation, Appropriating Prior Year Reserves, Authorizing Transfers and Authorizing the City Manager to Enter into an Agreement for the Zero Carbon Performance Code Project will be on discussion due to the split vote on first reading. Further detail in the AIS was requested regarding the intent behind the term “vested interest” relating to the makeup of the development code committee. 6-Month Calendar: • Upcoming meetings were reviewed with particular attention to any shifts. • The Land Swap between the Bohemian Foundation and Utilities was moved to unscheduled and will likely be scheduled for the first quarter of 2024. • Scheduling the January 9, 2024, Special Council Meeting will be added to the December 19 agenda under Other Business. This will allow capturing potential additional items of business that may arise before then in the call of the meeting. City Clerk Anissa Hollinshead • Larimer County certified the final election results last week, including for the municipal election. The certified results were shared with all of City Council as well as all municipal candidates. Of note, the County is now reporting results by district instead of by precincts, which allows for breaking down actual totals of ballots cast by City voters as well as registered voter totals, allowing calculation of voter turnout. This shift is much appreciated. • Provided an update on the referendum petition process. The circulation period ends tomorrow, Tuesday, November 28, at 5 p.m. It is anticipated the petition representatives will turn in the complete petition materials at some point late tomorrow afternoon. All aspects of procedures have been reviewed and updated to ensure preparation for the exhibit book as part of the petition for the first time. When submitted, all petition materials will be secured in locked totes with seals applied, similar to how ballots are handled, to ensure the security and integrity of the process. Chain of custody requirements include ensuring at least two people review all totes to verify seals remain intact when removing any petition materials from totes for review, as well as at all times when working with sections or books. • An update memo will be shared with Council at the point the petition is submitted with complete details regarding the verification period and protest period. Both these periods begin at the point the petition is submitted and run concurrently. A valid petition must be found either sufficient or insufficient by the end of the 5 working day period the City Clerk’s Office has to verify the signatures, ending Tuesday, December 5. The protest period is 10 calendar days, ending Friday, December 8. If no protest is filed, the petition can be certified as sufficient or insufficient at that point. If sufficient, the petition would be presented to Council at its December 19 meeting. If there is a protest filed, the full protest hearing process and final determination must be complete within 30 days of the date the petition is submitted, by Thursday, December 28. A sufficient petition at that point would need to go to the next regular or special meeting of Council called for any purpose. • Mayor Arndt suggested keeping a list of code and statute issues that may arise from the petition process that could be addressed in the legislature or otherwise. City Clerk Hollingshead noted the referendum process in Fort Collins is governed by City Charter and has a substantially shorter verification period than is allowed under state statute. This is a result of the shorter time frame Fort Collins has instituted for ordinances taking effect and is an issue that Council could choose to look into changes to the process schedule. Deputy City Manager Tyler Marr • No additional items. City Attorney Carrie Daggett • Noted a lawsuit was filed against the City last week seeking Fort Collins Police Services internal affairs records. Mayor Pro Tem Emily Francis • Thanks to Parks for grooming City Park, noting a ton of people there enjoying a great city amenity. Mayor Jeni Arndt • Also chimed in with thanks to City snow removal crews, noting she always knows trails will be ready for the early morning runners/walkers/riders. Meeting adjourned at 8:30 a.m.
