Mason, 2nd Floor Fort Collins, CO 80522 970.221.653 MEMORANDUM DATE: October 24, 2023 TO: Mayor and City Councilmembers THRU: Kelly DiMartino, City Manager Teresa Roche, Human Resources Executive FROM: Kelley Vodden, Total Compensation Director RE: FAMLI update for non-benefit eligible employees _____________________________________________________________________ Bottom Line: Staff recommends the City facilitate the participation of non-benefit eligible employees in the Colorado State-sponsored Family and Medical Leave Insurance (FAMLI) program. As an opted- out employer, employees can still voluntarily opt in at the cost of 0.45% of their wages. We recommend that the City cover these employee costs funded by the Benefits fund. This recommendation was reviewed and supported at the Council Compensation Committee on October 16. Background: On November 15, 2022, in Resolution 2022-113, the City Council approved the staff recommendation to decline participation in the FAMLI program as an opted-out employer. The State informed us that an 'opted out' employer can choose to contribute the employee's share on their behalf without having to contribute the Employer's share. Employees become eligible to take paid leave after earning at least $2,500 in wages within the State for four consecutive quarters. An employee who voluntarily elects to participate must do so for a minimum of three years. FAMLI can be used for the following purposes: 1. To care for one's own serious medical condition 2. To care for a family member with a serious medical condition 3. To care for a new child during the first year 4. When an employee or their family member needs to take safe leave because they are a victim of domestic violence, stalking, sexual assault, or abuse 5. When an employee needs to take qualifying exigency leave because an employee's family member is on or being called to active-duty military service DocuSign Envelope ID: ED6A48FA-D59F-463D-B6D3-4B70EC8C41C2 2 Financial impact: Timeline: Non-benefit-eligible employees can voluntarily enroll in FAMLI as of January 1, 2024. Staff are developing communications to reach the non-benefit employee population and will begin proactive outreach on December 1. Funding will occur quarterly and be submitted the month following quarter end; our first filing will be in April 2024 for Q1 2024. Impacted employees: At the committee meeting, Councilmember Peel requested a list of non-benefit eligible employees whom these efforts will impact; please see the attached document listing all positions.
