Approval of minutes from April 25, 2023 a. Attached: April 25, 2023 minutes b. Shirley moved to approve. Tricia Seconded. Passes 2-0. 2. Review of the session (Jenn and Ed) a. Plan for TABOR refunds contingent on voter approval this fall b. Property tax subject to voter approval in the fall - These will both be on the ballot in November c. Rent control: passed house, died in the senate d. Relevant to Fort Collins: i. Senate Bill 175: extension of Downtown Development Authorities (DDA) good for Fort Collins DDA ii. SB-150: Labeling of disposable wipes as "do not flush" iii. Support HB1190 first right of refusal bill - multi-family residence to promote affordable housing uses e. Failed: i. HB1169 - didn't make it out of first committee ii. HB1282 - additional layer on municipal utility regulation layer iii. Worker compensation bill - that didn't pass iv. No micro-trenching bill not introduced v. CORA bill - would have given a cost exemption to the members of the media vi. SB213 - was not brought up for action in the Senate - need to prepare for a land use 2.0 for next year - maybe go the route of an incentive approach. CML and CCI conferences coming up and this will be on the agenda f. Updates on other bills: i. Work comp bill - may not come up again ii. Micro-trenching - may not come back - Crown Castle moved that forward iii. Hospital Facility Fees - data collection to tell the story of hospital facility fees 1. Tricia: NPR story when a local hospital becomes part of a larger hospital system the facility can then charge these fees iv. SB111 protection bill - has not been signed yet by Polis. Jenn will check - is CML pushing for a veto? g. Budget: i. Was passed and signed by governor's office - prioritized funding for k12 2 ii. Meeting soon to hear revenue projections. TABOR revenues continues to decline. The more we reduce TABOR refunds could lead to fewer prop 123 dollars going to affordable housing initiatives. h. CC4CA: i. SB1294: Interim legislative committee around the bill addressing emissions i. CAMU: i. SB198: issues with energy plan j. Most effective ways to engage with delegation over the summer: i. Recommend individual meetings - meet in August for coffee ii. Talk to them about what we see on the forefront. May or may not have legislative ideas at that point. Having an informal discussion in August is smart. k. CML events and board openings: i. Applications are open for CML board positions ii. Shirley may apply iii. June 6th meeting if Council needs to make any decisions l. Potential Legislative ideas into next session & Session Debrief: i. Potential legislation: 1. Minimum wage, exempt small businesses and tipped wage earners 2. Radar vans: speed radar vans, traffic stops is the highest risk encounter for officers. Expansion of that program makes sense. Catch is, cannot do it on roads over 35 miles per hour. College and shields, can't automate tickets. Suggestion to state law lifted up to 50mph. a. Tricia: linking traffic violations to public health - speeding is a huge issue. b. Tyler: continue to see major accidents so there's a push for these mechanisms 3. Body worn camera: if an officer is completing activity where audio and video are available be able to turn off body camera. Looking to undo the redundancy in systems and storage. m. Other items: i. Feedback on informing Council: Request for Councilmembers to sign on to petitions. Flow-chart, refer to LRC, can continue to do that, but can feel messy. Option can be that we don't sign up on lobbyist petitions and they should go to full Council for a decision. 1. John Duval: Councilmember can sign a legislative petition as an individual Councilmember 2. Shirley: rather it go through other business with Council and councilmembers can choose to sign on if they want to 3. John Duval: LRC can also always refer something to Council. Can pass with a motion to get input on it, though things do move fast ii. Tricia: has been nominated for legislative representation for CC4CA iii. Ginny: another LRC mtg is not set up. Look to set up another one in August iv. Tyler: CDOT willing to give $2million to college and trilby. A number of opportunities this year to get us across the finish line - down to $1.6million needed. More MPO money available. v. Review of the Legislative Policy Agenda (LPA) a. Bulk of meeting was spent on reviewing the LPA with an eye for any desired changes and items that have been addressed and can be removed. Discussion included: i. Adjusting “pandemic” language to “health emergencies.” ii. Ensuring language included on matters of statewide concern. iii. Consolidating language regarding opposition to mandates. iv. Changing “Marijuana and Hemp” category to “Regulated Substances.” v. Adding a heading addressing “Accessibility.” vi. Staff confirmed that the following policy statement has been addressed and can be removed: Supports de minimus exemptions to Verification of lawful presence CO ST § 24-76.5- 103 by adding a new section (3)(f) to the State law that exempts the City from following the verification process for any particular local public benefit that is valued at less than $500.00, or that is not provided directly to the beneficiary by the City. 2. Other Legislative Ideas a. Discussion on topics that may be areas of legislation to recommend/pursue: i. Special Districts/Water Districts ii. Vision Zero focused ideas 1. Speed limits and distracted driving options. 2. Conversations on cautions regarding primary offenses and the concern of profiling. 3. Discussed compound ticketing. 4. Discussed car registration fees based upon vehicle weight. 5. Suggestion to work some of these through a Transportation Commission Interim committee. iii. Further discussion on adding permissions for officers to turn off body cameras when other/better video and audio recording is available. iv. Possible inclusion of language addressing abandoned/plugged wells.
