Box 580 Fort Collins, CO 80522.0580 970.221.6376 970.224.6111- fax MEMORANDUM Date: June 12, 2023 To: Mayor Arndt and City Councilmembers Through: Kelly DiMartino, City Manager Tyler Marr, Deputy City Manager Caryn Champine, Director of Planning, Development, and Transportation From: Paul Sizemore, Director of Community Development and Neighborhood Services Clay Frickey, Interim Planning Manager Re: June 6, 2023 Work Session Summary – Water Adequacy __________________________________________________________________ At the June 6 Work Session, staff sought feedback on a new Land Use Code provision establishing a process to assess the adequacy of water supplies for new development. Jenny Axmacher and Paul Sizemore provided the staff presentation. Mayor Pro Tem Francis and Councilmember Ohlson were absent. All other Councilmembers were in attendance. Summary of Feedback Staff presented an overview of the proposed Water Adequacy Land Use Code section. Staff sought specific direction on three decision points and outlined the pros and cons of these decision points for Council to discuss. Staff received the following feedback from Council:  Councilmembers expressed concern with adopting a policy where the Planning & Zoning Commission unanimously recommended denial of the Water Adequacy policy as written  Councilmembers support the current Water Adequacy policy as written with respect to Decision Points 1 and 2 regarding timing of the determination and review of water supply plan documents.  Due to the potential impact of Decision Point 3 regarding private water service providers within existing water districts, Council requested staff go back to the Planning & Zoning Commission for a new recommendation based on the current iteration of the Water Adequacy policy Next Steps  Present the current iteration of the Water Adequacy process to the Planning & Zoning Commission in July and receive a recommendation for City Council.  Bring Water Adequacy process back to City Council for consideration on first reading in August or September contingent on agenda schedule planning.
