Re: Transmittal of Historic Preservation Commission Resolutions for 323 S. Loomis
Ave.
The purpose of this memo is to formally transmit two (2) resolutions passed by the Historic
Preservation Commission (HPC) to City Council. These resolutions document the HPC’s
decisions concerning an involuntary Landmark designation request for the property at 323 S.
Loomis Ave., including the termination of the designation procedure.
Background:
On October 18, 2022, in response to a demolition notification, three residents of Fort Collins
submitted a Landmark designation request for the property at 323 S. Loomis Ave., also known
as the A.J. Hood/Thompson Property. The owner did not support the designation request, as
documented in correspondence received by staff on October 27, 2022. Staff subsequently
initiated the process in Municipal Code 14-33(b) and scheduled the first code-required hearing
before the HPC for December 14, 2022. At that meeting, the seven-member (two vacancies)
HPC found the property eligible for City Landmark designation on a vote of 5-2. The second
code-required hearing to weigh the public benefits of the designation against the factors
contributing to the owners’ objections was delayed until March to accommodate schedule
requests from both the owners and applicants. Due to a lack of quorum at the March 15, 2023
regular meeting of the HPC, the second hearing was continued to March 22,2023, a special
meeting date agreed on by the owners and applicants . At this meeting, the Commission voted
6-0 (3 vacancies) not to recommend the property to City Council for designation, finding that the
designation would not meet the Policies of 14-1 and Purposes of 14-2 in a manner and extent
sufficient to outweigh the owner’s objection. The designation procedure has consequently been
terminated per code requirements, and any related holds placed on building or demolition
permits have been removed. The resolutions for both meetings are being transmitted to Council
pursuant to Municipal Code 14-33(d).
Recommended Next Steps:
Because the designation procedure has been terminated, there are no required next steps.

RESOLUTION 1, 2023
OF THE CITY OF FORT COLLINS
HISTORIC PRESERVATION COMMISSION
RECOMMENDING THAT THE A.J. HOOD/THOMPSON PROPERTY LOCATED AT
323 SOUTH LOOMIS AVENUE, FORT COLLINS, COLORADO
NOT BE CONSIDERED FOR DESIGNATION AS A FORT COLLINS LANDMARK
PURSUANT TO CHAPTER 14 OF THE CODE OF THE CITY OF FORT COLLINS
AND THE LANDMARK DESIGNATION PROCESS IS TERMINATED
WHEREAS, pursuant to the Municipal Code of the City of Fort Collins (City Code) Section
14-31, three residents of Fort Collins initiated the Fort Collins landmark designation procedure for
the property located at 323 S. Loomis Ave. (the Property) by submitting an application to City
Historic Preservation staff; and
WHEREAS, the owners of the Property, Jacqueline Zipser and Holger Kley (the Owners), do
not consent to or support designating the Property as a Fort Collins landmark; and
WHEREAS, the Historic Preservation Commission passed a written resolution pursuant to City
Code Section 14-33(b)(1) on December 14, 2022, finding that the Property is eligible for
designation as a Fort Collins landmark under Standard 3, Design/Construction, contained in City
Code Section 14-22(a); and retaining sufficient historic integrity under the seven aspects, as
described in City Code Section 14-22(b); and
WHEREAS, the Historic Preservation Commission has determined that designation of the
Property does not meet the Policies of City Code Section l4-1 and Purposes of Section 14-2 in a
manner and extent sufficient to justify designation without the Owners’ consent; and
WHEREAS, the Historic Preservation Commission is adopting this written resolution pursuant
to City Code Section 14-33(c).
NOW, THEREFORE, be it resolved by the Historic Preservation Commission of the City of
Fort Collins as follows:
Section 1. That the foregoing recitals are incorporated herein by the Historic Preservation
Commission as findings of fact.
Section 2. That the Property is more particularly described as located in the City of Fort Collins,
Larimer County, Colorado, described as follows, to wit:
S 20 FT OF LOT 12 & N 30 FT OF LOT 13, BLK 278, LOOMIS, FTC
ALSO KNOWN BY STREET AND NUMBER AS 323 SOUTH LOOMIS AVENUE

Section 3. That based upon the information and testimony provided for and at the December 14,
2022, and March 22, 2023, hearings and the Commission discussion, the Property is not
recommended to City Council for designation as a Fort Collins landmark in accordance with City
Code Chapter l4, because the designation will not promote the policies and purposes of the City
as specified in City Code Sections 14-1 and 14-2 in a manner and extent sufficient to justify
designation of the Property without the Owners’ consent. Specifically:
•That the proposed designation would not satisfy Section 14-1(b) of the Municipal Code
because the “economic, cultural and aesthetic standing of this City” would still be
“maintained” by many other examples of homes with similar architecture if the
Property were not protected by landmark designation and subsequently demolished;
•That the objection of the Owners outweighs the public benefit of preserving the
Property given the barriers to reasonable rehabilitation, which would include hazardous
materials mitigation and foundation repair;
•That “civic pride” under City Code Sections 14-1(a) and 14-2(b) would not be fostered
by designating this Property as a landmark despite the many barriers to rehabilitation
of the property and over the objections and concerns of the Owners and other parties in
interest; and
•That the condition of the Property and expense to rehabilitate the Property according
to landmark designation standards would be prohibitive and would not promote the use
of the historic resource under City Code Section 14-2(e) and would not promote and
encourage private ownership and utilization of the historic resource under City Code
Section 14-2(g).
Section 4. That pursuant to City Code Section 14-33(c) the landmark designation procedure is
terminated and is not subject to appeal.
Passed and adopted at a regular meeting of the Historic Preservation Commission of the City of
Fort Collins held the 22nd day of March, 2023.
