EXECUTIVE SUMMARY This item has been amended for minor wording edits in the Resolution. The purpose of this item is to authorize the City to enter into an Intergovernmental Agreement (IGA) with the City of Loveland, Larimer County, and the Larimer Emergency Telephone Authority (LETA) concerning services of a GIS Analyst to be provided by Larimer Emergency Telephon e Authority. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. BACKGROUND / DISCUSSION Effective July 17, 2018, the City, Loveland, and Larimer County (the “Signatories”) entered into an intergovernmental agreement entitled CRISP Master Intergovernmental Agreement related to the Combined Regional Information Systems Project. This included a shared CAD system, which requires the continual aggregation, loading, manipulation, coordination, maintenance, editing, verification, and manage ment of layers of geographical information system (“GIS”) data. The City Information Technology Department employee providing part -time GIS support has departed. LETA and the Signatories have determined that it is in their interest to hire one full-time employee - a shared GIS Analyst - to perform GIS functions for the Signatories and LETA. LETA and the Signatories have determined that the GIS Analyst should be an employee of LETA, that three-fourths of the GIS Analyst’s time and duties should be dedicated to GIS data for the shared CAD system and GIS data for the shared records management system (RMS), and the cost of having that person on LETA’s payroll should be shared among LETA and the Signatories equally. LETA and the Signatories have drafted a proposed IGA in which LETA agrees that it shall use best efforts to hire a qualified, full-time employee as the GIS Analyst to start in May 2022, and three -fourths of the GIS Analyst’s time shall be devoted to fulfilling the duties set forth in the job descript ion attached hereto as Exhibit A to the Resolution. Agenda Item 21 Item # 21 Page 2 CITY FINANCIAL IMPACTS Under the IGA, the Signatories would each pay LETA one fourth of the annual cost LETA will incur as Payroll Costs and General Administrative Costs up to a cap of $35,000 per Signa tory, but the cap shall increase each calendar year starting in 2023 by the percentage increase actually incurred by LETA, but by no more than 5% each year. LETA will prorate the invoice for 2022 and will send the invoice to the Signatories after the date LETA hires the GIS Analyst. Fort Collins Police Services would use an existing allocation for funding its share of the costs for the GIS Analyst position. -1- RESOLUTION 2022-050 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF FORT COLLINS, THE CITY OF LOVELAND, LARIMER COUNTY, AND THE LARIMER EMERGENCY TELEPHONE AUTHORITY CONCERNING GIS SERVICES WHEREAS, the Combined Regional Information Systems Project (“CRISP”) network is a joint effort of the City and partner agencies City of Fort Collins, City of Loveland and Larimer County (the “Partners”), and other associated public safety members within Larimer County, to share in the use and cost of various law enforcement-related computer systems pursuant to the CRISP Master Intergovernmental Agreement dated July 17, 2018 (the “CRISP IGA”); and WHEREAS, the CRISP IGA set forth the Partners’ desire to share in the use and cost of purchasing, operating, and owning a computer aided dispatch system (“CAD”), a records management system (“RMS”), a jail management system (“JMS”), as well as their respective rights and obligations concerning the purchase, maintenance, operation and use of the System as defined therein, including their agreement that each was responsible for one-third (1/3) of any shared ancillary costs arising from the management, operation, maintenance, and upgrade of the System; and WHEREAS, the Larimer Emergency Telephone Authority (“LETA”) is a political subdivision located in Larimer County, created in 1990 pursuant to Colorado law by an intergovernmental agreement between the Partners and other municipalities, fire protection districts, and hospital/health services districts located within Larimer County; and WHEREAS, the current version of the that intergovernmental agreement, dated November 1, 2021, (“LETA’s IGA”), charges LETA with the responsibility for the installation, administration, management, operation, maintenance, upgrade, and enhancement of emergency telephone service and emergency notification service within Larimer County; and WHEREAS, as contemplated by the CRISP IGA, all five of LETA’s Public Safety Answering Points (“PSAPs”) and its backup PSAP migrated to the shared CAD system to customize workflows, respond, and share information with the various law, fire and emergency medical response agencies that are dispatched; and WHEREAS, the shared CAD system requires continual aggregation, loading, manipulation, coordination, maintenance, editing, verification, and management of layers of geographical information system (“GIS”) data; and WHEREAS, LETA and the Partners have determined that it is in their interest for LETA to hire one full-time employee, a shared GIS Analyst, to perform these duties, along with other LETA duties; and WHEREAS, LETA and the Partners have determined that LETA should employ the GIS Analyst and that three-fourths of the GIS Analyst’s time and duties should be dedicated to GIS -2- data for the shared CAD system and GIS data for RMS, and they have further agreed to share equally the costs to LETA of the GIS Analyst; and WHEREAS, the Partners and LETA have drafted a proposed Intergovernmental Agreement Concerning Services of a GIS Analyst, a copy of which is attached hereto as Exhibit “A” and incorporated herein by reference (the “GIS IGA”); and WHEREAS, under the GIS IGA the Partners would each pay LETA one fourth of the annual cost LETA will incur for payroll costs and general administrative costs, up to a cap of $35,0000 per Partner per year, with the cap to increase each subsequent annual term of the agreement starting in 2023 by the percentage increase actually incurred by LETA, not to excee d 5% in any year; and WHEREAS, Article XIV, Section18(2) of the Colorado Constitution, and Section 29-1- 201 et seq. of the Colorado Revised Statutes authorize governmental entities to enter into intergovernmental agreements, and to cooperate or contract with one another to provide any function, service, or facility lawfully authorized to each of the cooperating or contracting units; and WHEREAS, Section 16 of Article II of the City Charter provides that the Council may, by ordinance or resolution, enter into contracts with other governmental bodies to furnish governmental services and make charges for such services, or enter into cooperative or joint activities with other governmental bodies; and WHEREAS, Section 1-22 of the City Code requires that, with some exceptions, intergovernmental agreements or cooperative activities between the City and other governmental entities be submitted to the City Council for review and approval by ordinance or resolution.
