Re: Staff response to Councilmember inquiry on what is vested with the proposed Mulberry &
Greenfields PUD Master Plan.
The purpose of this memo is to provide the Mayor and City Councilmembers the same information that
staff shared on Friday, February 11 during the East Mulberry Corridor Plan Update site tour with
Councilmember Ohlson and Mayor Pro Tem Francis. This is regarding the Mulberry & Greenfields
Planned Unit Development (PUD) Master Plan, and the proposed fifteen-year vesting period for the
modified standards in the PUD Overlay. The inquiry included if current Land Use Code (LUC)
environmental requirements would be locked in with the vesting request, versus future phases of
development being required to comply with any new code requirements adopted during the vesting
period.
The PUD Master Plan does not include any modifications or requests to vest LUC Section 3.4.1 - Natural
Habitats and Features. As such, all current environmental requirements in Section 3.4.1 are applicable for
subsequent filings, without modification. Any future code changes to Section 3.4.1 would be enforced with
future filings (development phases) of the PUD Master Plan.
In addition, the PUD Master Plan recognizes and protects the natural habitat and features currently
present on the overall site, including the Cooper Slough and its approximate buffer, Lake Canal and its
approximate buffer, and the existing tree grove (American Plums).
