Re: Transmittal of Historic Preservation Commission Resolutions for 528 W.
Mountain Avenue
The purpose of this memo is to formally transmit two (2) resolutions passed by the
Historic Preservation Commission (HPC) regarding the involuntary Landmark
designation request for the property at 528 W. Mountain Avenue.
Background:
On April 20, 2021, in response to a demolition notification, four residents of Fort Collins
submitted a Landmark designation request for the property at 528 W. Mountain Avenue,
also known as the Samuel & Jessie Moore Property. The owner did not support the
designation request. Staff subsequently initiated the process in Municipal Code 14-33(b)
and scheduled the first code-required hearing before the HPC for May 19. At that
meeting, the HPC voted 7-0 (1 absence, 1 vacancy) finding the property eligible for City
Landmark designation and proceeding to the second hearing in June. The second
hearing was delayed twice upon request by both the owners and the applicants. The
applicants requested the hearing be delayed from the June date to allow for public
access to the meeting in-person, either via an in-person meeting or a hybrid. The
owners requested a further continuance of the matter from the July meeting to allow
time to gather additional evidence. At the HPC’s August 18 meeting, the Commission
voted 6-0 (1 absence, 2 vacancies) to recommend the property to City Council for
designation, finding that the designation would meet the Policies of 14-1 and Purposes
of 14-2 in a manner and extent sufficient without the owner’s consent. The resolutions
for both meetings are being transmitted to Council pursuant to Municipal Code 14-33(d).

Recommended Next Steps:
After transmittal, Municipal Code 14-35 requires that a quasi-judicial hearing before
Council occur within 75 days of Council’s receipt of the resolutions, allowing for an
extension upon majority vote of the Council if needed. Staff has requested placement of
this item on the September 21 Council agenda to provide the property owner a timely
decision on the matter.
