Hello Mayor and Council Members
I'm writing in support of the municipal immigration legal pilot program. I'm simultaneously attending
another meeting so may not be able to provide oral comments.
I support the funding of this program because:
The US is a country of laws and due process is provided to those involved in our legal system.
My understanding is that immigration law is federal law and those who object to this program should
look to the federal government for changes in immigration law.
It's a pilot program
It's a discrete amount of funds.
It's a grant program in which the City provides funding to immigration legal services and the City will
not be providing these services. Immigration law seems complicated and its best left to experts.
The program is only for immigration legal services.
The clients will have a variety of immigration issues that the City will learn about as part of data
collected about the program. Some will be parents of US citizens.
In all likelihood the individuals using the program are the City's essential workers.
We can't bury our heads in the sand and think that these individuals don't provide vital services to the
residents of Fort Collins.
These individuals pay taxes, both sales tax and payroll taxes and are not eligible for most taxpayer
funded programs.

I am writing regarding the proposed Ordinance No. 064, 2021 to establish a legal defense fund for
illegal immigrants in our city you will be voting on today. I am asking you to please oppose this
ordinance as well as express my concern as a long time legal resident of this community why this
proposal would even be considered by our City Council. I confess that I am mostly unaware of the
process for introducing ordinances before the City Council and I do not understand how such a
proposal would even be introduced let alone considered by our Council and where would the money
come from to pay for it? I find ordinances such as this one highly irresponsible and an extremely
inappropriate use of tax payers money, particularly when these kind of services are not available or
equitable to tax paying citizens. The idea of spending a quarter of a million dollars on unlawful
immigrants, as unfortunate and even terrible as their situations may be, is not and should not be our
responsibility. There are more pressing concerns of the tax paying citizens you all were elected to
represent. There are many needs in our local community not currently being addressed, some more
urgent than others. One in particular is mental health which has always been an issue but particularly
now as a result of the COVID lockdowns and restrictions. People have lost jobs, businesses, freedoms,
education etc. which has had a highly negative impact on their physical, emotional and mental well-
being. I am extremely concerned about the mental health of our city’s children who were denied in
person education, social activities as well as participation in most sports. This has had a profound
impact on their lives and sadly no one has been as vocal for them as they have for the needs of the
illegal immigrants. Children’s Hospital of Colorado recently sent an email declaring a State of
Emergency for Pediatric Mental Health and that suicides are now the leading cause of death for
children aged 10+ in Colorado, their emergency room is overrun with suicide attempts from children
as young as fourth grade. Can you imagine the hopelessness that a little fourth grader must feel to
even consider taking his or her own life? This is a tragedy with our youth that needs to be addressed
by our leaders instead of spending time, money and resources on an issue would more appropriately
be funded by citizen donations directly to the nonprofit. A legal defense fund for immigrants should
not be a program funded by the city so please vote no today.

Greetings City Council Members,
I'm writing to you to express my firm opposition to the proposal to create a "Municipal Immigration
Legal Fund Pilot Program" that is intended to provide legal services for legal and illegal aliens residing
in our city. To begin with, I don't believe this is an area that our city has any business getting involved
with and in addition, it involves spending city funds that have nothing to do with the needs of Fort
Collins citizens. It appears to be an expenditure of $$$s to various immigration activist groups in an
attempt at "virtue signaling" by "woke" members of city council and other city representatives. You
can do that on your own Dime! If private charities, companies, churches, clubs, or any group of citizens
want to donate to this cause, they are free to do so. But to spend our tax dollars on unnecessary
proposals such as this is an irresponsible use of valuable revenues that are needed more elsewhere. I
recently was notified by the city that Fort Collins was eliminating the property tax rebate program for
seniors (that I had qualified for recently) along with rebates to lower income residents on utilities.
How do you justify eliminating these programs to actual Fort Collins Citizens, while at the same time
proposing expenditures for people here illegally? Are there free legal services provided by the city to
its legal residents? I'm unaware of any.
Currently, our southern border is in chaos as illegal aliens are coming across in numbers that equate to
roughly the population of Fort Collins....every month! That's about 175,000 people! There is a
tremendous problem with drugs, human trafficking, disease, and potential terrorists coming across the
border every day because of an administration that seems to place little value on enforcing existing
border laws. Americans are footing the bill for ALL of the expenses to intercept, house, feed, clothe
and educate every one of them. It's crazy, irresponsible nonsense and a terrible waste of revenues
that would be better spent on our own veterans and homeless populations! It almost seems as if this
chaos is the desired intent of the Biden administration. Have you considered the effect that your
proposal might have in encouraging some of these people to come here? Is that a good idea?
Maybe you should consider postponing a vote on this misguided proposal until you get more feedback
from the citizens of Fort Collins. I have a pretty good hunch that the majority would strongly oppose
this measure if they were able to get all the FACTS!
If you do pass it, I believe that the next step for citizens is to put a proposal on the ballot to overturn
your decision as quickly as possible, and to hold everyone who has pushed for this poorly conceived
piece of legislation accountable in the next election.

Dear Council Members,
Before you vote on the proposal to provide taxpayer funds for legal cost by legal and illegal
immigrants, please consider the following:
*Immigrants are granted due process under the law in that they are entitled to an immigration hearing
before a judge. They are NOT entitled to free legal representation.
*This is a misappropriation of our tax revenue particularly at a time when individuals and businesses
are hurting financially from government restrictions related to COVID-19.
*Keep in mind that once a government-funded program is set up, it rarely goes away. Is Fort Collins
really prepared to commit to this funding on an on-going basis?
*Where are these funds coming from? Is another program being reduced because of it?
*Note that if Fort Collins sets up this fund, our city will become a magnet for unlawful immigrants. If
you build it, they will come.
The bottom line is this is a gross misappropriation of our tax dollars. Please think carefully about what
you are doing and how divisive this issue is.

I’ll be brief. I don’t think it is appropriate to allocated $250,000 towards a legal defense fund for
immigrations when, #1 there is access for legal fund for them through private foundations and other
resources.
#2 There are too many other items that are not being funded that taxpayers need for services, which
is our primary duty to serve the taxpayers. We’ve cut back hiring emloyees and other services because
of the pandemic. Let’s get caught up with the initial responsibility that we have first. Let’s don’t do
what feels good, but let us do what does good.

Dear Fort Collins City Leaders,
My schedule has prevented my contacting you before this. This subject of using municipal tax dollars
to cover these legal costs is extremely important to many, especially those city/municipal taxpayers
and as such need to share my thoughts with you as one of those city/municipal taxpayers.
Those of us who pay city taxes do so for streets, alleys, safe water to drink, to allow safe power into
our city, as well as for our safety – for municipal needs and to do otherwise you are not being a trustee
to these needs. This tax money is not supposed to be a pot of money that people can come in and use
for their external cause(s). Fort Collins has many fine charities that can handle this without asking the
Fort Collins City/municipal taxpayer to take this on.
Along with that:
- immigration is a federal issue
- Joe Biden created a border crisis
- this will make it worse
- Mayor Arndt wants FOCO taxpayers to pay immigration lawyers to sue the federal govt
- it's this simple: this idea worsens the border crisis & we get to pay for it
bottom line
- immigration is a federal issue
- not a state issue
- not a local issue
- before Mayor Arndt takes on the whole world, maybe
- maybe try being mayor of Fort Collins, first
- I think that is why people voted for Mayor Arndt - to be mayor
- not to be an immigration czar
- we have a border crisis
- that is the kind of problem where, you're in a deep hole
- to solve that, the first thing you do is stop digging
- Mayor Arndt:
- immigration isn’t your job
- illegal immigration isn’t your job
- I ask that Mayor Arndt and the other members of the Fort Collins City Council not support this.

At last nights City Council meeting I encouraged a no vote on the Immigration Defense fund. After
hearing the discussion by the Mayor and Council I am even more against this Ordinance and
concerned.
I was alarmed by the fact that this did not follow the usual budget process. Instead it is being crammed
forward. It begs the question, why? At the very least why not wait and have it go through the normal
budget process. Respectfully, based on the discussion I don’t believe any of you clearly understand the
Ordinance, how it will be implemented and work (or not). Shocking. It was repeatedly stated that this
is a “pilot program”. Trojan Horse may be a better description. I don’t believe this will receive an
objective review as it proceeds. The deck appears to be stacked so that regardless of what happens it
will be touted as a success. It’s in several Council members best interest for it to be seen as a success.
There are no pre understood or identified measures of success or failure. I’m sorry but having staff
report back on a regular basis is simply not good enough.
Given the above, Council members that are for this Ordinance are not being good stewards of the tax
payers dollars.
I was further alarmed by the fact that at the very least means testing could not be applied and that
some Council members would not let the program be focused on certain areas, such as youth.
I encourage all of you to vote no and at the very least delay this until the next budget cycle where it
can be looked at in the context of all the needs of the community.

signatures on the petition for a Fort Collins Legal Services Fund for Immigrants. Tricia Canonico is still
listed as the Secretary of the Board of Directors on their website as of this morning. Her stated
resignation from this Board during the June 15th Council Meeting appeared to be so she would not
need to recuse herself prior to voting.
Emily Gorgol, our Mayor Pro Tem, is the Partnership and Grants Director employee of The Family
Center La Familia. In my opinion, and in the opinion of many other Fort Collins residents, our Mayor
Pro Tem should recuse herself from voting at the second reading of this proposed ordinance.

Hello:
I am extremely disappointed with the Council Members that saw fit to spend our hard earned tax
dollars in support of Illegal Aliens instead of Legal CITIZENS of this community. As one Council Person
previously said $200,000 + is a drop in the bucket which gives me an insight into the mindset you have
concerning the taxes we pay. Instead of putting these funds to use on such for projects as the correct
railroad crossing system on Mason to stop the need for railroad locomotives sounding their horn or to
support our business base you give it away to people that are here illegally.
I sent all Council Members an email previously in opposition to this tax giveaway and I also reside in
Emily Gorgol’s district. The only response I received was from our previous Mayor, my own Council
Representative didn’t even take the time to respond. The only reason for this lack of response is most
likely that my position was contrary to Ms. Gorgol’s. When a Council Member surrounds themselves
with like minded people instead of a those with a diversity of thought you have the results we
witnessed on this vote. This council just acts on their own personal desires and not that of their
constituents who they are entrusted to represent. This is the reason that small but vocal groups can
sway this Council and the silent majority gets lip service. The only way we the silent majority can
change this lack of accountability is at the ballot box. In the future I will be more active in all Council
Districts through contributions and support.

I attended the June 15 city council meeting and frankly, I was quite appalled at what I saw. Input from
the community is asked for but little to no response is given. I know it would be impossible to address
each and every comment or question but to address basically none is inexcusable.
In regards to the Defense Fund for Immigrants, there are several points that are very disturbing. First,
the fact that this is being put forward outside of a normal budget process is wrong. Kudos to Kelly
Ohlson for speaking up on this point. Second, the mayor pro tem repeatedly stated that much time
had been taken in the preparation of this Fund, however, by standards of the length of time it takes
other items to come to a vote, it was much abbreviated. What is the rush and who is pushing this??
Third, if cuts were made because of Covid 19 to any programs or projects, there is every reason to
weigh funding them to prior levels against a new project like the Defense Fund.
Fourth, it is referred to as a pilot program and that it will be evaluated to determine if it should be
continued. Having a masters degree in planning and administration and having worked in several
positions where I was responsible for the evaluation of programs, this "pilot program" is not set up to
be fairly evaluated. If you are to rely on city staff who have been instrumental in the establishment of
the program, there is an inherent bias already. You need to determine now, with very clear cut
expectations, what data needs to be collected and what will determine success or failure. You cannot
wing it and any qualified researcher knows this. Finally, the question that was raised numerous times
by citizens at the meeting needs to be more closely examined, is it truly the function of city
government to give tax dollars to a defense fund for non-citizens who apparently cannot be means-
tested. Public defenders and defense funds exist to help those who don't have the money to defend
themselves. To think that only those with limited financial means will seek to use this fund is naive at
best.
I sincerely hope that Fort Collins city leaders have the sense to step back and take a closer look at how
they are trying to move this forward. Although I strongly disagree with the entire concept of using tax
dollars for this, if you do decide to do this, at least have the sense to do it in a manner consistent with
how other projects are approved and to set out the evaluation study to begin with and not wing it.

To the City of Fort Collins Council Members regarding the pilot legal defense fund grant programs for
immigrants seeking citizenship or establishing a lawful presence:
I am a proud child of a Sicilian Immigrant. My Father entered the United States through Ellis Island in
1921 as a nine-month-old and was not even granted citizenship until he had completed an honorable
discharge from the Army Air Corp after his distinguished service during WWII. He and my grandfather
worked numerous jobs, sold vegetables, and poured concrete sidewalks in Union City,
Pennsylvania. My grandparents were finally granted citizenship in the 1960’s after many years of hard
work, contributions to their community, and tax paying.
From this humble background I strongly ask you to unanimously support this legal defense fund. From
my perspective these community members are human beings who deserve our respect and support as
they strive for a better life. The biases we see in 2021 are no different from the biases my father and
his family experienced in 1921 and for many, many years. In 100 hundred years have we not
discovered we are one human race?
The Coloradoan Opinion Piece by Elizabeth Kiehne on Sunday June 6, 2021 certainly articulates the
support of this fund from a heartfelt and just argument.
For those of you who have already stood in support of this, I give my deepest gratitude. To the three of
you who did not, I ask you to reconsider. A unanimous vote would send the clear message that we are
more than an economy, we are an inclusive community committed to liberty and justice for all.

Let me get straight to the point. The idea that our Fort Collins City Council members are even
considering allocating our tax dollars to an Immigration Defense Fund, is a complete dereliction of
their duties to the tax payers of Fort Collins, Colorado or any other part of these United States. The
crisis at our Southern Border, is a great threat to every American and to the world. If you consider
anything at all regarding our border and immigrants, please consider allotting funds to help Texas and
border states to "continue building our border wall". Under our current administration, our border is
a threat to every America. The people are coming across our border illegally, and include drug cartels,
criminal gang members, rapists, and also include all manners of diseases. Children are being trafficked
and used many times over, women are raped, and our people living at the border are being
threatened.
When we the people of the United States have been going through shut-downs, lock-downs, wearing
masks that are proven to carry in them the diseases the body is trying to expel, many loosing their
businesses, because of this COVID scare, it seems like the need of the tax paying Americans are the
first consideration, when it comes to figuring out where "Dollars should be spent and allocated".
Children and families have suffered greatly with the unconscionable shut-down of schools, wearing
face masks that are only used normally for a few hours safety during a surgery, etc. Masks that block
the bodies ability to get rid of the body waste it normally gets rid of through breathing them out the
nose or mouth are a worse health risk. It's time you considered real science rather than political
agendas.
Do you politicians actually care at all about the people of Fort Collins, the people you are in office to
serve?? Please consider that we are the people paying your salaries. I expect you to be wise in the
use of our tax dollars. Helping out the police and the protectors of our communities would be a good
option for extra funds, also.

Council members,
I am writing as a concerned citizen about your recent move to created a legal defense fund for
immigrants. I have been a resident of Fort Collins my entire life (33 years) and so has my husband. This
is the first time I have read something that is concerning me enough to write. I am writing to ask you
to vote against this. You have caught the attention of many residents who were asleep at the wheel
and not paying attention to where our hard earned money is going.
We are small business owners and property owners in Fort Collins and have worked very hard to
become a middle class family in this city. It is becoming increasingly difficult as the property taxes and
cost of living increase. We are extremely thankful we had the wisdom to buy a small home in 2013
before the cost became too high for middle class families. 2020 was hard. The governor of CO shut our
business down for almost two months. We had to shut down multiple other times as well due to
“outbreaks”. We never received help from the city of Fort Collins. There wasn’t one opportunity for us
to catch a break. We weren’t large enough to qualify for PPP loans yet our property taxes increased
TREMENDOUSLY this past year as well as the year before. Where is the help for average families who
have worked really hard to make it in this city?
I would encourage you to put money back into small business or into water conservation. We are
going to be in a severe water crisis soon. Would the fund not be better spent on the citizens who live
here and a basic need. I respect and understand that there is a need for immigrant legal funds, but
not from public funds.
This is highly concerning and I will be watching to see how each of you votes. I am encouraging my
friends and family to as well. I regret the ballot I cast in November already and will plan to make a
change next time around should this pass.

I am writing in reference to ordinance No. 064, 2021, Appropriating prior year reserves for a municipal
immigration legal fund pilot program. In reading the ordinance I am confused as to who you believe
you are working for? This fund is much more in line with Foreign Aid as you are defending none US
citizens with US taxpayer money. I love having legal immigration into this country and support it
100%. It's what makes this an amazing country. What you are doing is supporting people who are
here illegally.
I worked overseas for many years in Europe, Asia and the Middle East for the federal government and I
have never heard of anyone, outside a foreign ministry or state department, funding other country's
citizens to stay in their respective country after entering illegally. If I enter Italy illegally, I am
deported. Simple. It is the same here and in every country I've ever been in (which is a lot). You are
using our money to defend someone against ourselves - sounds pretty stupid when you say it out loud
doesn't it?
You're not doing anyone any favors by doing this and you are, in fact, taking money from other local
programs that could use the funding. Or, you are taking money from taxpayers that could be returned
through current/future year taxes being reduced.
I do not approve of our tax dollars being used to defend people who are in our country illegally. I have
no problem if you have a fund to support defending US citizens, but not none US citizens - that is a job
for their home country if it is even necessary.

I am writing as a former paralegal to ask you for your support on the Fort Collins Immigration
Legal Defense Fund. Where our federal laws state that un-authorized immigration is a civil
offense, we tend to add the wait of criminal offenses where they are not warranted onto our
immigrant families and at the same time deny them the right to due process that all other
residents have. Every citizen is afforded a free public defender for any criminal case because it
is our "right to due process"; however, cases fought before an immigration court (that have
merely made civil offenses) are not offered the same right and for this simple reason they lose
their cases in court, tearing apart hundreds of families that make-up essential fabric of our
community. Our legislators at the state capitol have recognized that this is fundamentally unjust
and have recently written into Colorado state law that a Legal Defense Fund will be established
to offer Colorado immigrant residents fair due process. They have passed this new law because
they recognize that immigration proceedings are incredibly complex and difficult to navigate on
your own, that the vast majority of immigrants facing deportation and detention go before a
judge alone and that we have hundreds of cases like these in Colorado that involve local
families that have children and have been established in our communities for many years.
Having access to a lawyer means families can stay together and ensures Fort Collins residents
are guaranteed due process.

American Immigration Reform (FAIR). FAIR is a non-profit, non- partisan organization of concerned
individuals who believe that our immigration laws must be reformed to serve our nation’s interests.
FAIR advocates for immigration policies that reduce the harmful impact of illegal immigration on
national security, public safety, the economy, jobs, education, healthcare and the environment.
Founded in 1979, FAIR has approximately three million members and supporters nationwide. On
behalf of our members and supporters, I am writing to express FAIR’s opposition to Ordinance No.
064, 2021, Appropriating Prior Year Reserves for a Municipal Immigration Legal Fund Pilot Program.
FAIR opposes state and local immigration defense funds like this propsal for the following reasons:
THE CONSTITUTION OF THE UNITED STATES GUARANTEES THE RIGHT TO LEGAL
REPRESENTATION ONLY FOR CRIMINAL PROSECUTIONS.
Most immigration proceedings, including removal proceedings, asylum petitions, and adjustment of
status, are civil, not criminal proceedings, and therefore do not trigger the Sixth Amendment right to
free legal counsel. In fact, the Supreme Court has ruled that deportation is not a punishment, but
rather a civil administrative procedure whereby an alien is returned to their homeland.
ILLEGAL ALIENS CHARGED WITH CRIMES ARE ALREADY GUARANTEED REPRESENTATION THROUGH
PUBLIC DEFENDER PROGRAMS.
While many illegal aliens are guilty of criminal violations associated with their unlawful status – such
as identity theft, failing to enter the country properly or without inspection, or failing to properly
register with the federal government – most of these violations go unprosecuted. Those aliens who
are charged with criminal violations, however, are already provided access to legal representation
through state and federal public defender programs. No additional legislation or funding is required
to guarantee this right.
PROVIDING TAXPAYER-FUNDED CIVIL REPRESENTATION TO ILLEGAL ALIENS IS UNFAIR.

Free legal representation at taxpayer expense is generally unavailable to citizens or legal immigrants who face civil legal
issues, such as foreclosures, eviction proceedings, child custody cases, or divorce proceedings. Perhaps of particular
note, citizens and legal immigrants also typically do not have access to taxpayer-funded legal representation when they
face civil administrative enforcement actions by government agencies, such as for zoning, code enforcement, or tax
collection.
Taxpayer-funded legal representation for illegal aliens is therefore unfair to citizens and legal residents who are required
to pay out of pocket for their own civil legal proceedings.
PROVIDING TAXPAYER-FUNDED CIVIL REPRESENTATION TO ILLEGAL ALIENS FRUSTRATES FEDERAL LAW.
The federal immigration scheme, as devised by Congress, expressly prohibits governments from funding the legal
representation of aliens in removal proceedings. Aliens who wish to be represented by legal counsel are free to do so, but
federal law stipulates that it must be at no cost to the government. See 8 U.S.C. 1229a(b)(4); 8
U.S.C. 1362.
PROVIDING TAXPAYER-FUNDED CIVIL REPRESENTATION TO ILLEGAL ALIENS INCREASES THE ALREADY HIGH FISCAL
BURDEN OF ILLEGAL IMMIGRATION ON THE UNITED STATES.
Using taxpayer dollars to prevent illegal aliens within our borders from being deported tells the world that our
immigration laws are not meant to be taken seriously. With more than 14.5 million illegal aliens currently residing in the
United States, FAIR estimates that the annual fiscal cost of illegal immigration to U.S. is roughly $133 billion. Allocating
additional taxpayer resources specifically for the benefit of illegal aliens' legal fees is further unnecessary drain on U.S.
taxpayers.

We are writing to express our disapproval of a proposed action to establish an Immigration Legal Defense Fund that draws

However, even if legal counsel has reviewed and approved this program, we still disapprove the use of the taxpayer dollars
for this purpose, especially when the City faces more serious problems such as creating railway over/underpasses,
addressing deferred infrastructure maintenance, and meeting sustainability goals.
Instead, we suggest referring this matter to the newly created Office of Equity and Diversity to explore grant programs for

My name is Elizabeth Becker. I am a resident of Fort Collins, Larimer County. I am 83 years young. What you are proposing
may sound good to you and you may think it is the right thing to do. But believe me it is not.
We are all descendants from immigrants. Mine immigrated from Ireland and the UK. But they did it legally. They registered.
They did not enter his country illegally. Also no funds were allocated for their immigration or legal defense.
There are several issues that raise my awareness to this:
1. Why was this not referred to the voters and put on a ballot?
2. Where is this money coming from? I live on SS. I also still pay
Income tax on it.
3. This proposal does not include a residency requirement.
4. This proposal will allow more funds for illegal/ legal immigrants
per case than a citizen in Fort Collins who is entitled to legal
representation.
This seems unfair for undocumented people to receive a higher
rate than a legal citizen of Fort Collins.
Our immigrants do contribute to our community by providing a source of labor for our businesses and they do need help
with our broken immigration system but this is beyond the scope of city responsibilities.
I believe this is a mistake for the City of Fort Collins. I believe we should be taking care of our own citizens and not entering
into an outside area of social services. If you do word will spread like our wildfires and we will have an influx of unlawful
immigrants like you never imagined. We do not need to become a magnet for illegal immigrants.

There is not even a residency requirement, which means the city will be inundated with requests for assistance, and
immigrants will flock here overnight.
I urge you to please consider the negative impacts for Fort Collins that this fund will bring. It is a wonderful place to live --

As a 3rd generation member of a family of LEGAL immigrants and veteran of the U.S. Navy, who came to the states almost
50 years ago from the Philippines, I find it appalling that our state/local government, let alone the federal government,
would want to establish funding for both legal/illegal immigrants at tax payers' expense. My grandparents were always
keen of reminding us how important it is to never take for granted what we have in being here in the states because their
journey was far from easy. Everything done via mailed correspondence and sometimes paperwork being lost while in
process, but they never gave up and saved everything they could to move themselves, my mother and her siblings to the
U.S. so they could have a better life. They did so legally and on their own dime!
My heart goes out immigrants looking to seek citizenship here in the U.S., but this is a vetting process for a reason and they
have to do it legally and on their dime as others before them have. If we just let anyone come here without being vetted,
we have no idea what they're about, their history or intent. If things like this are freely provided (not free, again at tax
payers' expense), then more will be expected to just be given to them. What kind of message does that send to those
immigrants who have gone through all the red tape using the legal methods of becoming citizens here, only to be by passed
because of the influx of immigrants coming into the states? Furthermore, we cannot ignore the fact that much of the
violent crimes going these days are done by illegal immigrants and repeat offenders who are sent back to their country only
to come back again.
Tax payer money should be used to improve our counties, cities, states and assist our homeless veterans before providing

Why is something important as this not being given a vote by ballot? An action important as this should be given to a vote

I like Fort Collins just the way it is. It is clean and comfortable. The crime rate isn't that bad, and jobs can be found to some
extent. I don't want Fort Collins to become a sanctuary city like Denver with all it's crime and tent cities.
Besides, the citizens of this city and this country have worked hard to make Fort Collins and this country what they are
today. Our citizens need to be taken care of first.
Fix immigration at the federal level if it needs fixing, which it does. Allow the county to disburse funds for the immigrants,

As a resident of Fort Collins, I have a very strong concern regarding the proposed Immigration Legal Defense Fund.
Let me begin by first thanking Shirley Peel, Kelly Ohlson, and Susan Gutowsky for voting NO on this proposal. I appreciate
their wisdom and reservations about this matter which is under discussion.
Many red flags surround this fund--not least of which is the failure to follow procedural process by going through the
normal city protocol for grant processing like it does with other nonprofits. Something stinks here. This issue to my mind is
not one that the City Council has any business moving forward. In fact, it is one that should be referred to voters as a ballot
initiate. The money for this fund would come out of our general reserves. Really? Is this an appropriate use of our
funds? Aren't these funds for emergencies and for economic turndowns? How does that justify using our funds for
individuals who are undocumented immigrants?
Why is there no residency requirement? How can a rational mind consider this without having the ability to foresee that
this fund would soon overwhelm us? Why is there no checking of applicants' financial status? Equality of opportunity is an
American standard. All immigrants are entitled to an immigration hearing, but they are NOT entitled to free legal
representation. This proposal asks the city to fund undocumented people at a higher rate than legal citizens. Really?
This is a socialistic proposal and certainly is NOT ONE FOR OUR CITY TO ACCEPT. Fort Collins should not initiate funding for
illegal immigrants...to do so would open Pandora's box with unimaginable results.
No matter how worthy the cause, it's always easy to spend someone else's money on it. Once a government program is set
up, it's almost impossible to discontinue it. City Council needs to think carefully about what they are doing and how divisive
this issue is. They should encourage people to donate directly to these nonprofits or to Fort Collins Gives and designate a

Providing defense funding through public means is not appropriate. Regardless of the justification, the process of by-passes
public notification and approval through the voting process is circumvented.
After doing a little research I found the "2017 National Drug Threat Assessment" document that was published by the US
Department of Justice/Drug Enforcement Administration. This document was also co-authored by the DOD, DOJ,
Homeland Security and US Border Patrol and government representatives in Mexico. According to the document, the
majority of illegal drugs are being transported through the southern border regardless of the cartel that is in control at the
moment. Upon passing through the border to major distribution points including Denver and Colorado Springs the flow of
drugs is increasing. It is obvious through the increase in gang activity, the flow of drugs in Fort Collins is also increasing.
On a personal note my sister had a ranch down by Stephenville, Tx. A local friend and his family were murdered by the
cartel. The family had opened water and food stations set up for immigrants which did not deter their murder. According to
my sister who lives outside of Phoenix, these events happening in her area as well.
Although caring for immigration is appropriate, setting up Fort Collins essentially as a sanctuary city is not the answer.

At the July 6th City Council Meeting, please clarify why the 2nd reading of the proposed Legal Defense Fund Ordinance is
near the bottom of the Consent Calendar. During the discussion related to the 1st reading, Representative Ohlson and
Mayor Arndt expressed their dismay that it was so far down on the calendar, causing some to need to leave the meeting
before they had the opportunity to speak.
The July 6th Consent Calendar has the 2nd reading at #17! Also..."The Consent Calendar consists of those of no perceived
controversy". If this proposed Ordinance is not controversial, then how does the City define "perceived controversy"?
Governor Polis recently signed into law four bills to support immigrants and refugees, including the creation of a state fund
to help with legal representation.
Given the controversial use of mid-cycle reserve funds for legal representation in Civil Cases, please remove this item for
consideration. The State took action. Please move on to decision making that reflects the prioritization of community needs
during this critical recovery period.

persons cannot be means tested according to state law. Why not drop the unlawful immigrants from this proposal?
Then means testing could be added to the ordinance. Otherwise, low- and middle-income citizens of Fort Collins
could possibly be funding the legal defense of well-to-do immigrants, which makes no sense.

We particularly urge all city leaders to oppose this proposed use of city funds. We do heartily thank council members
Shirley Peel, Kelly Ohlson, and Susan Gutowsky for their previous "no" vote.
We now have learned that the process by which this proposal has moved forward is heavily flawed:
* This proposal did not go through the City's normal budgeting process. Why not?
* This proposal did not go through the City's normal grant process as happens with other non-profits. Why not?
* Given the controversial nature of this issue, it should be referred to the voters as a ballot initiative. This was done with
the plastic bag issue. Surely, if voters needed to approve the plastic bag ban, their opinion on a controversial legal defense
fund for immigrants is fully warranted!
* The money to fund this program is coming out of our general reserves. Is this an appropriate use of those funds? Aren't
they for emergencies and economic downturns?
* According to the First Hearing this proposal will not include a residency requirement such as needing to have lived in Fort
Collins for at least a year before applying. But doesn't this make sense in order to avoid being overwhelmed by recent
immigrants?
* Why is equity a core value of our city and why is it being used to justify something like this proposed ordinance? Equality
of opportunity, not results, is the American Way.
In conclusion, immigrants are granted due process under the law in that they are entitled to an immigration hearing before
a judge. They are NOT entitled to free legal representation.

remaining council members to vote against this fund at the on July 6th.
Like many citizens of Fort Collins, I am concerned and do agree that unlawful immigration needs addressed. I feel that an
issue as important as this should be addressed through the city's normal budgeting process or grant process like other non-
profits. The best way to move forward with this and determine if it is truly what the citizens of Larimer County desire, is to
refer it to the voters as a ballot initiative. We cannot spend tax payers money on a program that they have not approved,
particularly one that by many is deemed controversial and are unaware of.
Even if one is in agreement with the fund, aren't we overlooking several important requirements to qualify for the fund? If
people feel that we are helping the residents of Larimer county with these funds, it would seem logical that those
benefiting would be residents of Larimer County (having residing in the county for a year or more). Shouldn't the funds be
going to those that most need it? My understanding is there is no current financial requirement for the funds? Creating a
blanket fund with no requirements does not seem equally beneficial to all immigrants. While the idea of a defense fund
sounds great to those wanting to help with the immigration crisis, there are currently too many loopholes to have this be a
program funded by our city with taxpayer dollars. I noted there are multiple organizations behind this fund, the best way is
for these organizations to solicit funds from citizens wishing to donate to such causes and not requiring those that do not
support this to pay for it.
I am concerned that approving this fund will draw more immigrants, and not all are hardworking people looking for a better
life. We could see an increase in crime and placing more burden on our resources already impacted by the pandemic.
Is this really the most pressing issue and best way to spend our reserves? What about the many local businesses and
families in Larimer County going through hardships following COVID 19? Why are we contemplating supporting unlawful
immigrants over long-time citizens trying to recovering from these hard times? As a mother, mental health and the rising
suicide rate of children in Larimer County is paramount over a person facing deportation. Suicide rates among youth have
doubled since 2007, wouldn't these reserve funds be better spent on saving the lives of our young people? We are in dire
need of increased mental health supports.
I encourage you, our city's leaders to not move forward with this fund. Send this issue to the ballots and use these funds to
help the taxpayers and citizens that have paid into the reserves. Please consider the greater needs of the community, and

I would also ask you all to REMOVE THE ONE YEAR RESIDENCY requirement from the Immigration Legal Defense Fund pilot
program. While it is important to ensure that funds are serving Fort Collins community members, a one-year residency
requirement could prevent people seeking asylum or facing other imminent legal processes from receiving timely help.
In the last Council session, there was discussion of prioritizing some immigration cases over others. I applaud Council for
not voting to do this and ask that you CONTINUE TO RESIST THE TEMPTATION TO PRIORITIZE SOME IMMIGRATION CASES
OVER OTHERS. Immigration law is incredibly complex and does not fit nicely into the boxes we try to create. For instance, a
young person that has arrived to the U.S. as a minor, has been abandoned or neglected or abused, and cannot return to
their home country, may be in deportation proceedings while seeking relief through the Special Immigrant Juvenile Status
(SIJS) Visa. They are seeking this relief through the proper legal pathway, and still could suffer deportation if they do not
win their case. Another example: An adult that has been in the U.S. for decades and is not eligible for any type of
affirmative immigration relief could finally be eligible for some forms of relief like Cancellation of Removal if placed in
deportation proceedings. Funding only "affirmative" cases would not help this person, but funding all immigration cases
would ensure that they, too, receive legal representation and give their family a shot at staying together and remaining in
our community permanently. All of this is to say that it's important that we fund representation for all kinds of immigration
cases whether people are placed in deportation proceedings or applying for relief independently of a pending immigration
case. We need to fund all kinds of cases since the intent of this program is to support families staying together, employees

July is the month we celebrate our nation—a nation built in large part through the work of immigrants. It is in that national
tradition that I urge your support for the Fort Collins Legal Services Fund for Immigrants.
After reading the documents prepared by JC Ward and Caryn Champine, it is clear that this initiative supports several of the
city’s strategic outcomes and policy agendas and meets pressing needs within our community. It is also, it should be
emphasized, a program necessary for recognizing the fundamental humanity of immigrants.
I am an educator and I have taught immigrant students in Fort Collins. However brilliant they are, they also face
intersecting challenges that make it difficult for them to thrive and reach their full potential (which not only carries
personal benefits for them, but also enriches our city). This fund, supported by a wide swath of organizations that know our
community, would help make sure that people like my students are supported if they need to navigate complex and
sometimes scary legal issues. It is a wise use of city monies that I whole-heartedly support.

Dear Council members,
I am writing to ask you for your support on the Fort Collins Immigration Legal Defense Fund! With your YES vote on
July 6th, you will be making history and showing your support for all immigrants in Fort Collins!
City Leadership states that “the City of Fort Collins is an organization that supports equity for all, leading with race” and
understands “the role of local government in helping create systems of oppression and racism and are committed to
dismantling those same systems in pursuit of racial justice.” The creation of a Fort Collins Legal Defense Fund is an
opportunity for our city to stand proudly by our values of equity and racial justice by building due-process and local
legal resources for our immigrant neighbors and residents who have no guaranteed right to an attorney in immigration
proceedings, even if they are a child or an asylum seeker.
Immigration proceedings are incredibly complex and difficult to navigate on your own, however, the vast majority of
immigrants facing deportation and detention go before a judge alone. Everyone, no matter who they are, should have
the opportunity to present their case in a fair and just manner, by having someone who can advocate for their interests.
Having access to a lawyer means families can stay together and ensures Fort Collins residents are guaranteed due
process.
Please vote YES on July 6th for a Fort Collins Immigration Legal Defense Fund to guarantee due process and
universal legal representation for all Fort Collins residents in immigration court.

I do not believe that the city council should be involved in abrogating the laws of the United States. It appears that city
council is turning Fort Collins into a sanctuary city. If you truly intend to take such misguided actions, it should be done
by popular vote. The council was not elected to pursue such things. The upstanding way to do it would be a referendum.

Dear Mayor Arndt and City Counsel Members,
Thank you for your service to Fort Collins and our community. We appreciate you and pray you will have great wisdom
and understanding to lead our city now and in the days ahead.
Things to consider:
1) We want to express our continued concern on the using of our tax dollars and City Emergency Fund for the purpose of
giving money to immigrants both illegal and some legal for their legal costs for immigration issues. Many people we have
talked within Fort Collins have been very concerned as well. Since this issue is bringing great controversy in our city we
feel it is only right to have a community vote on this issue. Since it does not go along with the budget decisions that have
been made for FC or focuses that are most important to the community it would only be right and fair to have a citywide
vote. Many less important issues have been voted on like the use of plastic bags in FC. Certainly this legal funding issue
is much more important and should be considered something citizens would have the right to decide on.
2) This proposed ordinance goes against the core values of our Constitution and does not represent equality of
opportunity for all people. The results will not further our community or help the immigrants on a city level. The federal,
state or county governments are responsible to make changes to the issues of immigration and they should be the ones
to fund any social programs of this type.

Dear City Councilmembers and City Manager,
I do not believe that the majority of Fort Collins residents have any idea about this proposed fund. I just found out
about it. Why is this not a ballot initiative? We should have the right to vote on something so significant. As residents
and businesses are trying to recover financially from the pandemic, should we not be spending taxpayer dollars to help
them, instead of unlawful immigrants?
If this passes, Fort Collins will become a magnet for unlawful immigrants.
I am very much against this Immigration Legal Defense Fund. I do want to thank Shirley Peel, Kelly Ohlson and Susan
Gutowsky for voting against this at the First Hearing. I certainly hope more of you will do the same this weekend.

I urge you to vote AGAINST the issue on your docket this evening. “APPROPRIATING PRIOR YEAR RESERVES FOR A
MUNICIPAL IMMIGRATION LEGAL FUND PILOT PROGRAM.”
I and my family have lived in the Fort Collins area for 45 years. Both of our children are graduates of CSU. The past 2
years have been most difficult for many of our tax paying residents. Many are having to dig deep to survive the financial
hardships due to the pandemic. Many have had to close their businesses, lay off employees, apply for government
assistance to stay afloat, draw unemployment, etc.. Why are these funds not being used to help those who have lived
here, worked here, paid taxes, worked hard contributing to our community?
Our family personally has paid many taxes into the city coffers during the years we have lived here. Why are we
supporting, with our hard earned tax dollars, unlawful immigrants who have not contributed? Where was our free legal
assistance when we needed it? We are legal residents, with our ancestors immigrating legally thru Ellis Island many,
many years ago. They did not illegally come to this country. They followed the law and became legal citizens.
Consider the number who are currently infiltrating our country thru the southern border. At last count there are around
180,000 per month that have been caught. At present rates its projected that around 2 million illegal immigrants will
come into our country illegally in 2021. And that’s not counting those who are not caught. By offering this free
Immigration legal fund, Fort Collins will become a magnet for illegal immigrants. Many will flock here to seek free legal
assistance in order to stay. Paid for by the taxes of residents who have been here legally for many years. If anything,
these funds should go to help secure our southern border so legal immigrants can come into our country the way they
are supposed to.

P.S. Even though our address is Windsor, in Larimer County, we own a number of rental properties in the City of Fort
Collins. We lived in the city for 43 years prior to our move east of I‐25. Our rental homes contribute much in taxes
accumulated by the City of Fort Collins and your decision will affect us as a result.
