Re: Two-Year Report Respectful Workplace Policy
The purpose of this memo is to provide a two-year report regarding training and complaints under the
Respectful Workplace Policy (RWP), which City Council adopted in February 2019.
In 2019, the Mayor, all City Councilmembers, and Council-appointed employees attended training
related to the RWP, its requirements, and the implications of failing to comply with the RWP. After the
April 2021 election, the new Mayor, all Councilmembers, and Council-appointed employees will receive
RWP training, which is required every two years.
2019 Complaints
A community member notified staff of a complaint alleging two Councilmembers' conduct was
problematic and that he was not sure whether it fell under the RWP. A screening process
interview was conducted with the community member to determine whether the alleged
misconduct fell under the RWP. A determination was made that the alleged conduct did not fall
under the RWP, and the community member was notified of this in writing. The community
member took no further action on this matter.
A City management level employee verbally notified a complaint contact that two community
members notified her that a Councilmember's conduct made them uncomfortable and may
violate the RWP. A screening process interview was conducted with the two community
members, and it was determined that if the allegations made by the two community members
were taken as true, the alleged conduct did not violate the RWP. The City management level
employee and the two community members were notified of this determination.
2020 Complaint
A community member alleged discrimination and retaliation in a selection decision for
participation on a community advisory committee. A screening process interview was conducted
with the community member. A determination was made that the alleged conduct was not
committed by any person subject to the RWP, but that alleged conduct may violate City
personnel policy prohibiting discrimination and retaliation. An external investigation ensued,
and a determination was made that the conduct alleged by the community member did not
occur as alleged, and the conduct that did occur did not violate City personnel policy. The
community member was notified of this determination in writing and took no further action.
