Mayor Wade Troxell, Mayor Pro Tem Ross Cunniff, City Manager Darin Atteberry, Deputy City Manager Kyle
Stannert, City Attorney Carrie Daggett, and City Clerk Delynn Coldiron (all by video -conference call) met on
Monday, March 8, and the following summarizes the discussions that began at 7:35 a.m.
March 9, 2021 Work Session:
Agenda items for the meeting were reviewed.
• This Council work session will be remote. As is customary for work sessions, no public participation for
the meeting will be available.
• Mulberry Corridor —An unprecedented amount of work is occurring for this area on community
planning, fiscal impacts, visioning, etc. A thoughtful, staged approach for annexation over several years
will likely be recommended. Discussions with the County are occurring related to associated
intergovernmental agreements, on the potential for the City to be more involved in planning efforts for
properties in the county that are within the City's growth management area, and on the benefits of
partnering.
March 16, 2021 Regular Meeting:
Draft agenda items for the meeting were reviewed.
• This Council meeting will be remote. Public participation for the meeting will be available in three ways:
by phone, online through Zoom and by email.
• Disposition of Land Bank Property —There was a question about whether this code change would still
allow for the City to seize assets. The focus of this item is to ensure ongoing affordability of the
properties versus a requirement that the City preserve the right to retake the property. Barriers of the
existing code were discussed. Staff is asked to provide more detail about how often the existing code
has created barriers and what other tools are available to enforce rent and other related requirements.
• Our Climate Future Plan —There was a question about whether this item will stay on consent. If there is
indication that it will be pulled, this item should be moved to the discussion calendar. Alternatively, if
the item stays on consent and is pulled, the Mayor may ask Council to suspend the rules and place this
item after the scheduled appeal.

• Master Lease Agreement with Crown Castle USA for Small Wireless Communication Equipment —This
item creates an overall arrangement for this company similar to what has been done for other
providers. It pertains to both 4G and 5G service. There is no specific location request associated with
this agreement. City Manager Atteberry noted that this provides opportunities to leverage Connexion
facilities in this space.
• Other Business —The question was asked how Council should proceed if any Councilmembers want to
revisit the decision on whether or not to appeal the camping ban. Council does not give "Other
Business" direction at work sessions; however, if there is interest in discussing this again under "Other
Business" on March 16, this can be added as a note on the agenda.
6-Month Calendar:
• March 23, 2021:
o Will include an adjourned meeting if Council is not able to consider all items at the March 16,
2021 meeting.
o Municipal Immigration Defense Funds —There was discussion about broadening the scope of
this proposal to include funding for general low-income legal aid. It was noted that a program
for immigration legal defense would be self -defining and limiting because of the specific
program focus. The need to evaluate funding scope for either kind of program was noted. It was
also suggested that staff think about ways to more effectively be a clearing house for
information about legal aid services.
• April 27, 2021:
o An item for Resolutions of Appreciation for outgoing Councilmembers was added to the
calendar.
• May 4, 2021:
o Metro District Policy Amendment Adoption was added to the calendar (Moved from March 16,
2021). This item was rescheduled because staff received feedback from the development
community, as well as the Planning & Zoning Board, that the items included in the proposed
point system were not feasible. Additional work and engagement are needed. Mayor Pro Tem
Cunniff would like to see this item come forward on April 20 to ensure the existing Council gets
to weigh in on the outcomes.
• May 25, 2021:
o Visit Fort Collins Destination Master Plan was added to the calendar.
• Other:
o Council Retreat — Both May 7/8 and May 14/15 have been cleared with possible participants and
current Councilmembers. May 7/8 is the preferred date; however, if there is a recount
associated with the April election this may not be plausible. Both dates will be added to the 6-
Month Planning Calendar as proposed dates for the upcoming Council Retreat.

City Clerk Coldiron:
• Noted election activities continue. Several related items were discussed:
o Election signs in the right-of-way have been observed along the Mason and College corridors.
Staff is asked to follow up. Related to this it was reported that some signs do not include paid
for by statements. Paid for by and other election requirements are enforced based on citizen
complaints that are received. The complaint process was reviewed. It was suggested that staff
provide Council with an update on the number of election signs that are removed from the
ROW, which campaigns they relate to, and whether the signs include paid for by statements.
o Some campaigns are receiving anonymous donations of $.01. There was discussion about
reporting requirements, and it was suggested that future Code updates include instructions on
appropriately processing and disposing of anonymous contributions that come in.
o Requests have been received from interested watchers. There was mention of making a camera
feed available for the sake of transparency. Staff is asked to follow up.
City Manager Atteberrv:
• Noted that he will be meeting with the Poudre Fire Authority Board to discuss the Chief candidates. The
process for finding a new Chief has generated a lot of dialogue from the community, stakeholders, and
employees. Semi-finalist and finalist rounds of interviews have been completed. A decision on the new
Chief is expected soon.
• Noted he reached out to County Manager Linda Hoffman regarding his email on signs and billboards. A
response is expected soon. On a related note, the City Manager reported that a County Commissioner
approached him at an event to let him know the Commissioners are talking about this item.
• Noted the memo included in Thursday Council packets related to the trash hauler who is requesting a
delay for business recycling. The memo is attached. Staff is looking for Council feedback on this item. If
Council desires to give staff direction in this regard, this should be brought up under Other Business at
the March 16 Council meeting.
• Noted that County Manager Linda Hoffman has reached out about scheduling a summer barbeque with
the commissioners and elected officials.
Mayor Pro Tem Cunniff:
• Noted a resident shared concerns about the commuter permits allowed under the Residential Permit
Program (RP3). A commuter permit allows, under very specific circumstances, a customer (non-
resident) to park in a neighborhood with an RP3. Based on the current number of commuter permits
issued and available on -street parking capacity, there are no issues that need to be addressed.
However, staff is engaging in on -going dialogue about the long-term impacts and unintended
consequences of the policy. Mayor Pro Tem Cunniff reinforced that the purpose of this program is to
assist residents in areas that have these programs in place.

• Noted that science is saying that ventilation and appropriate air handling are key to managing COVID in
enclosed areas. He asked staff to evaluate ventilation and look at any improvements that need to be
made to Council Chambers as decisions are made to possibly move back to hybrid meetings.
• Received a citizen email related to police officers who were not wearing face coverings. He asked if this
policy is being enforced. City Manager Atteberry confirmed that there is an expectation for City
employees to wear face coverings and that the complaint is being reviewed.
Mayor Troxell:
• Noted the ribbon cutting that occurred for the new Police training facility; nice event. Both cities were
well represented.
• Noted this week is the National League of Cities (NLC) City Conference. He participated in a
transportation infrastructure services session yesterday and will be presenting, along with two other
mayors, as part of the western municipality gathering on CARES funding and how the City has applied
these.
• Noted the Boulder riot that occurred over the weekend. Staff has had a series of communications with
Colorado State University over messaging that will be going out to students about there being no
toleration for this type of activity and the severity of consequences should this occur. Police staff is
paying close attention to this item as well.
• Noted the email received about the cadence of the Pledge of Allegiance. He plans to respond.
• Noted the Futures Committee meeting scheduled for today. This will be a retrospective compendium of
future committee topics with service area directors providing their reflections.

Hauler Request to Delay Implementation of Community Recycling Ordinance for
Businesses
Bottom Line
The purpose of this memo is to request Council feedback on a request submitted by Republic
Services to delay the final implementation date of the Community Recycling Ordinance for commercial
customers (not multifamily units) from June 30, 2021 to November 30, 2021.
If Councilmembers are interested in exploring a delay, they may raise their interest under "Other
Business" at a City Council meeting. If this topic has not been raised by Councilmembers by March
17, 2021, staff will reply to Republic Services that their request was not acted upon.
Background
The Community Recycling Ordinance, enacted by City Council in 2016, included a requirement that
private haulers provide recycling service to businesses and apartment complexes by December 31,
2020. It included a long roll out time at the request of local haulers.
In April 2020, City Council approved a delay in the full implementation deadline for the CRO to June
30, 2021, due to impacts of COVID.
This year, Republic Services (the company that purchased Gallegos Sanitation Inc) has requested an
additional delay for commercial customers to November 30, 2021. See attached request letter.
Among other reasons, Republic Services cites impacts to businesses from COVID:
Local businesses have been hit hard by COVID-19. With staff reductions, revenue losses,
closures, increased expenses, and the many other debilitating factors this pandemic brought to
our community, we feel the timing is not optimal for businesses that are suffering; with the
general public slated for vaccinations in Colorado, we believe the end of November 2021 would
be reasonable to onboard all customers.
We have not received a request to delay the CRO implementation from the other haulers serving Fort
Collins.
Considerations
In January, the City's Economic Health Office asked for feedback on this topic from representatives of
the business community and business partners. Perspectives were shared that businesses are still

struggling and CRO implementation feels like it adds to the "one more thing" factor. There was
interest in delaying the ordinance.
Implementation Progress
The three haulers providing this service in Fort Collins report the following information:

When the CRO was adopted in 2016, it was estimated at that time that 1600 commercial customers
did not have recycling.
Next Steps
• If this issue is not raised by City Council by March 17, 2021, staff will inform Republic Services
that their request was not acted upon.
• If Council expresses an interest in delaying the CRO per Republic Services' request, it could
be accomplished via these avenues:
o An Emergency Regulation related to COVID-19 impacts, to be followed by Council
ratification
o A standard ordinance process requiring two readings

RE: Community Recycling Ordinance MFU & Commercial Business Recycling

Dear City of Fort Collins Waste Reduction and Recycling Department:
We want to thank you for your pledge to waste diversion and continued efforts toward the Road to
Zero Waste. As one of the nation's top haulers of refuse and recycling materials, Republic Services is
committed to keeping communities clean and providing a Healthy Blue Planet.
We recognize the City of Fort Collins and Gallegos Sanitation, Inc. (GSI) had previously been in
discussions, over the years, regarding the Community Recycling Ordinance. Most recently, it was
determined GSI was at approximately 72% to goal of onboarding businesses and MFUs with recycling,
and it was noted GSI requested a second extension to complete the process, which was not granted
by the City in mid -January of 2021.
As Republic Services, we understand pursuant to Section 15-413 of the Fort Collins Municipal Code,
any commercial or multi -family customer receiving solid waste (trash) collection services shall subscribe
to a collection service for recyclables that is not less than one-third of the total collection volume by a
collector licensed to provide such services within the City. Collection volume (including both solid
waste and recyclables) is based on the size of the containers and the service frequency. Any person
who owns or operates a business or multi -family complex may apply for a variance with the following
provisions:
• Space constraints
• Self -hauling of recyclables to a recycling drop-off center
• Utilization of a separate licensed recycling collection provider
• Failure to generate recyclables
• Only available location for recycling bin is not safely serviceable by hauler
Republic Services is excited to partner with the City of Fort Collins and continue the collaborative
dialogue. At this juncture, however, we are requesting the CRO date of final customer onboarding be
moved to November 30, 2021 for the following reasons:
1. Republic Services acquired Gallegos Sanitation, Inc. on January 1, 2021. Being new to the
Northern Colorado market, we recognize the City conducted extensive outreach at the onset
of the CRO discussion in 2016 and years prior with GSI.
• We are concerned of the optics and as the "new national company" customers will
perceive the former family -owned trash hauler is out and Republic Services is the one
responsible for mandating recycling at complexes and business during an extremely
challenging economical time.

2. Our drivers have experienced long wait times at the Larimer County Recycling Center and
adding 480-500 customers will only compound the issues at hand. We are currently in
discussions with officials at Larimer County to determine a timeline for possible solutions
Please see below for a complete breakdown of wait times our trucks experienced since the
first of this year through the first week of February:
• 60-90 minutes in 28 cases
• 30-60 minutes in 103 cases
• 29-20 minutes 55 cases
• :16-19 minutes 89 cases
3. Local businesses have been hit hard by COVID-19. With staff reductions, revenue losses,
closures, increased expenses, and the many other debilitating factors this pandemic brought
to our community, we feel the timing is not optimal for businesses that are suffering; with the
general public slated for vaccinations in Colorado, we believe the end of November 2021
would be reasonable to onboard all customers.
4. Enforcement of the CRO: We understand the city has identified a staff member to ensure the
CRO is implemented. We are requesting a written plan for how the CRO will be enforced for all
haulers.
5. Public Communication: We would further like to propose the City to put forth a "2021
PSA/outreach" effort to the community/businesses/MFUs regarding this mandated program.
6. Granting of Variances: Last week, it was determined only a handful of variance forms had been
submitted to the City (and not yet approved). We understand there are many customers who
meet one or more of the variance qualifications listed on page 1 of this letter, and they have
yet to apply.
We thank you for the opportunity to resume the CRO extension conversation, and the City's
consideration of our request. As the front-runner of commercial recycling in Fort Collins, Republic
Services strives to continue providing the very best sustainable services and do it in a way that is
equitable and well-timed.
