Other Business a) Wildfire advocacy update b) Future meetings during 2021 legislative session Legislative Review Committee (LRC) Minutes Date: October 30th, 2020 Time: 8:00 am – 9:00 am Location: Zoom Webinar - https://zoom.us/j/91946971026 Councilmembers Present: Ross Cunniff, Susan Gutowsky Staff Present: Carrie Daggett, John Duval, Tyler Marr, Chief Swoboda, Honore Depew, Jeanne Sanford, Sierra Anderson Approval of September 29th, 2020 Minutes • Gutowsky: Motioned for the approval of the September 29th, 2020 minutes. Minutes were approved unanimously. Review 2021 Legislative Policy Agenda (LPA): Staff recommended edits, further LRC direction Childcare • Depew – Intention of Item 2 is not to reduce the quality of childcare standards. Some state rules make it more difficult for childcare providers to provide services. • Marr – No grandfathering in building codes. If daycares are in business for many years, they still need to update their building codes. • Cunniff – Support for maintaining the qualifier for the health and safety of children. Climate: • Marr: Item 1 qualifier added. • LRC support Human Resources • Marr – Item 5 confirmed that alcohol and marijuana are the main drugs of concern. • Daggett – Impairment is the significant concern and should be noted. • Cunniff – Okay leaving if alcohol and marijuana are the main concerns of impairment. • Daggett – There are some constitutional and statutory limitations to the City’s ability to test. • Gutowsky – Question about legality of marijuana in Colorado vs federal government. • Carrie – The federal government and the Department of Justice use discretion on how they are enforcing. There is always the potential to raise issues. Typically, the federal government’s concern is with interstate trafficking. Public Safety • Marr – The changes highlighted in red were provided by community groups. • Item 3 focuses on bilingual content. • Item 15 and 16 are staff additions which focus on clarity of standards and consistency. • Item 17 and 18 are community additions. • Cunniff – Support for 17, 18 and 15. Question on item 16 and restricted standards. • Swoboda – Goal of Item 16 is to make sure there is consistency and increased conversations. Item 16 requests that law enforcement agencies are contacted before rulings are passed. Police train based on laws and want to be aware before the rulings pass. • Cunniff – Suggested rewrite: supports standards related to use of force which appropriately balance the rights and safety of citizens with the safety of first responders. Suggested the change to highlight that we support a balance between the safety of residents and staff. • Depew – Questioned if there is room for an additional local control statement in Item 16. • Swoboda –Request to be brought into the conversation before making decisions. • Marr – Staff will highlight any changes made before submitting to the rest of Council. • Gutowsky – Asked if the statement needs more strength regarding what we do. • Cunniff – Suggested changing language to “practical standards.” Recycling and Solid Waste • Marr: Item 1 call out for local haulers. Transportation • Item 8 – Opposed divesting – more appropriate with practice in the past • Item 10 – Most has been funded without a ballot. • Marr – Minor changes across the section Water • Item 3 – No longer need legislative authority to move forward. • Item 6 – Added watershed. • Cunniff – Suggested changing Item 6 to “Fort Collins water supply.” Motion • Cunniff – Motion to approve the LPA as edited today. Approved unanimously. Other Business: • Marr: Legislative breakfast update: Dec. 9th works for all three legislators. Zoom breakfast meeting and discussion. o LRC confirmed. o Marr: Staff will put together a brief agenda and recognizes this an opportunity for Council to get a better understanding of the legislators’ interests and plans.
