1. Council will consider a motion to adjourn into executive session.
Mayor Pro Tem Horak made motion, seconded by Councilmember Martinez, to go into executive
session for the purpose of meeting with the City Attorneys and City management staff as permitted
under City Charter Article H, Section 112, City Code Section 2-31(A)(2), and Colorado Revised
Statute Section 24-6-402(4)(B) to discuss specific legal questions related to pending litigation
regarding the City's public nudity ordinance and the manner in which particular policies, practices,
or regulations of the City related to public nudity may be affected by existing or proposed revisions
of federal, state, or local law.

2. Possible Motion Directing the City Attorney on Next StepsRelatedto Litigation_ Regarding -the
City's Public Nudity Ordinance. (Adopted)
The purpose of this item is for Council to provide possible direction to the City Attorney on the next
steps she should take related to pending litigation challenging the City's public nudity ordinance.
Councilmember Cunniff made a motion, seconded by Councilmember Martinez, to direct the City
Attorney to further evaluate the City's options in regard to the public nudity ordinance case and
return with information leading to a possible executive session no later than March 26.
