Present: Councilmen Carson, Troxell., Lopez and Chilton, City Manager Coffey,, Crays Attorney March and Director of Public Works Liquin. Absent: Councilman Kruchten, excused: The Merchant of the Month award was presented to Gary Garwood of Farnham and Garwood Agency, 521 South College Avenue. Fireman Clyde Jewart was present and stated the Fire i';, Department, in their inspections, could find nothing wrong in the way of fire hazards and that this business had an extra sprinkling system in the front of the building. The following ordinance was presented on second reading:' ORDINANCE NO: 65, 1970 BEING "THE ANNUAL APPROPRIATION ORDINANCE" RELATING TO THE ANNUAL APPROPRIATIONS FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1971, AND ENDING DECEMBER 31, 1971, AND FIXING THE MILL LEVY FOR SAID FISCAL YEAR. The City Manager stated that there was an accounting error in the transfer from the' depreciation fund to the interfund transfers, but did not. effect the total of the budget. Motion was made by Councilman Troxell, seconded by "Councilman Chilton, that Ordinance No. 65, 1970, be adopted, as amended. Roll was called resulting as follows: Ayes: Councilmen Carson, Troxell, Lopez and Chilton, Absent: Councilman Kruchten, excused. Nayes: None. The Mayor declared the motion adopted. Mr. Ray Delahoy, a member of the Woodward Governor Tax Committee, was present and spoke' relating to the budget. He stated he felt that the City should tighten its belt and -cut dorm on spending, that increased spending caused a need for -higher taxes or other sources of:revenue. He stated the City and Federal taxes are go}ng up all the -time. He said he had spent several hours studying the budget and there were several items proposed in the budget which they did not understand, such as direct transfers from the Water Capital Improvement fund to finance the, new golf course and questioned the legality of this. He remarked that the City spend less, that I might have more. Mayor Carson stated that the City reduced the mill levy 5 mills at the time of the 1 City sales tax. That there were many that were enjoying our services without paying any tax. He stated the City expects the golf course to be.a deficit.at the beginning but that money transferred to finance it will be paid pack with interest and that they expect it to make a profit over and above the.amount required for repayment, that they have been quite judicious in going over the budget. -The City Manager stated that the reduction of different departments was reduced approx- imately 30% and believe we have our budget in the proper aspect. Mr. Guy Palmes was present and stated that the sales tax hurts the older folks, and that we sometimes pay two times on this tax. He stated that the transfers to the Water Department is not earmarked for the golf course, that it is alright to have the golf- course if you can pay for it, that most golf courses do not pay for themselves. The Mayor stated there will be a fee added to -the greens fee, that some courses in Denver contribute to recreation. The following ordinance was presented and read at length on first reading: ORDINANCE NO. 69, 1970 BEING AN ORDINANCE RELATING TO THE LOCATION, USE AND OCCUPANCY OF MOBILE HOMES AND MOBILE OFFICES WITH -THE CITY OF FORT COLLINS There was considerable discussion concerning this ordinance. Councilman Troxell suggested that Section 5B be amended to remove "in width"; SG to. add "in the Mobile Home; aid 4D''to "renew one year only".After further discussion, motion as made by Councilman Lopezi, seconded by Councilman Troxell, that Ordinance No. 69, 1970, be adopted as revised. Kuppinge;, rurcha>:ng Agent SUBJECT: BIDS FOR CONSTRUCTION 4GITERIA'.S =Bids have been received and evaluated covering consideration for purchase of: Various construction materials for the Light aad Power Department. A summary of the bids are as follows: (A complete listing is attached) Flatiron Materials Company $. 6,575.00 Kiefer Concrete 7,045.25 Bob Kost, Senior Electrcal Engineer, has evaluated the bids and all specifications have been met by the low bidder. The recommendation is that Flatiron Materials Company be awarded the contract in the amount of $6,575:00. Respectfully submitted, /s/ E. M. The following communication was presented and read at length: October 22, 1970 The Honorable Mayor Karl Carson and members of the City Council Municipal Building 300 LaPorte Avenue Fort Collins, Colorado Gentlemen: The Fart Collins League of Women Voters supports the employment of a Human Relations Director by the City of Fort Collins as a positive step to inform individuals in this community_ of their civil rights in education, employment and housin g. On the basis of its study of state and federal fair housing laws the League takes the following position. That in the enforcement of fair housing laws, speedy resolution should be ensured. Administrative procedures and responsibilities should be clearly defined and widely publicized. Mediation and legal redress should be readily available. The process should ensure every possible protection for both complainant and persons or institutions against whom complaints are lodged. Avenues for mediation and legal redress should be widely and and should be easily accessible. Funding should be adequate to provide trained and d om- petent staff for public.education to inform citizens of the provisions of fair housing legis- lation, of their fair housing rights and of procedures to be followed in securing them. The League also feels that it is the responsibility of all levels of government to provide equality of opportunity in education, employment and housing. Sincerely, /s/ Nona Thayer President of the Fort Collins League of Women Voters The following resolution was presented and read at length: RESOLUTION 70-109 OF THE COUNCIL OF THE CITY OF FORT COLLINS EXPRESSING THE SUPPORT OF THE CITY COUNCIL OF THE, CITY OF FORT COLLINS FOR PROPOSED CONSTITUTIONAL AMENDMENTS NO. 1, 2 AND 3 TO BE ON THE BALLOT AT THE NEXT GENERAL ELECTION WHEREAS, at the next general election on November 3, 1970, there will appear on the " ballot proposed constitutional amendments No. 1, 2 and 3; and WHEREAS, in the opinion of the Council of the City of Fort Collins, such proposed 11 ,.,° i amendments are deserving of support. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the, City Council supports constitutional amendments 1, 2 and 3 and urges the citizens of -the City of Fort Collins to vote in favor of such amendments. The City Manager stated he had a petition signed by 71 people living in and around. Fort Collins requesting signal lights at the intersection of Mountain Lincoln and Jefferson,'." and stated this matter should be corrected. The following memo was presented and read at length: October 28, 1970 TO: Tom Coffey, City Manager THRU: Charles Liquin, Director of Public Works FROM: Joe Rice, City Traffic Engineer RE.: Jefferson $ Mountain -Lincoln, Signalization thereof As per your verbal request of October 28, 1970, the following information is submitteda` to you as confirmation of our conversation. �h i On May 15, 1970, a study was completed.of the referenced intersection, the results bein' no signalization at that time. The study indicated signalization warrants were closely. approached but not met. However, since that time, a follow-up study has been initiated and- ' as of now all results indicate signalization is warranted. Therefore, it will be necessary to initiate a formal request from the State Highway ' Department for permission to install the necessary equipment. This request will be submitted as soon as the rough information now 'on hand is finalized and the report completed. Respectfully submitted, /s/ Joe A. He said the signal lights probably would necessitate the elimination of at least a part of a feed store presently in that area, Motion was made by Councilman Troxell, seconded by Councilman Lopez, that the Council adjourn.
