Regular Meeting
A regular meeting of. the Council of the City of Fort Collins, Colorado, was
held on Thursday, March 1, 1973, at 1:30 P.M. in the Council Chambers of
the City Ha.,",. Mayor Carson called the meetv:�., to order; there were present
Councilmen Carson, Lopez, Preble, Peterson and Feau.
Staff: members present: Brunton, DiTullio, Liquin, Cain, March and Lewis.
Merchant of the Month Award
Mayor'Carson stated he was pleased to present the award to the "Grovert
Brothers", Fire Inspector Darrel Watson stated City Drug had been chosen
for'.the award because of their exceptional housekeeping and concern for fire
safety.
Mr. Harold Grovert and Mr. Art Grovert were both present and received the
award�on behalf of City Drug.
Minutes of February 22, 1973 meeting approved
Councilman Lopez made a motion, secen,led by Councilman Pe',': --son, to approve
the minutes of February 22, 1973,-as published. Yeas: Councilmen Carson,
Lopez, Preble, Peterson and Fead. Nays: None.
Special Events Permit approved for American
Legion Post 1.87
City Attorney March stated,as submitted, the application was not in proper
form. Mr. Paul A. Vigil, Secretary -Treasurer of the organization proceeded
to correct the application.
Councilman Lopez indicated one additional correction to indicate the special.
events permit for malt, vinous and spiritous liquor would be 'sl in the Holy
Family Recreation Hall basement.
Nlr. Vigil stated the nature nf the event was a fund raising p-,ojc;:t and would
be open Lo the public. Further, provision had been made for the checking of
identification of those in attendance.
Councilman F;ad made a motion, seconded by Councilman Peterson; to approve tiro
application for the Special Events Permit. Yeas: Councilmen Carson, Lopez,
Treble, Peterson and Fead. Nays: None.
Prospect Greens Planned Unit Development Plan
Approved
Councilman Preble made a motion, seconded by Councilman Lopez, to remove the item
from the table (tabled February 22, 1973), for consideration. Yeas: Councilmen
Carson, Lopez, Preble, Peterson and Fead. Nays: None.
: ty Manager Brunton referred to a memorandum from Rey Bingman, Director of:
Cormm=i.ty Development, which stated in part:

"After several ,^,, ings with the developer, we have reached what we Ieel. is
a satisfactory resolution of the problem, including the following:
1. ']'he developer will relocate the New Mercer Canal and concrete line it
to meet ditch company requirements. The ditch company has approved this.
2. The parking area will be relocated adjacent to the building, to pro-
vide direct vehicle and fire access.
3. The future canal i.n:provements to the north ditch will be shifted
away from the buildings, to provide greater safety. The developer will
provide the required embankment at time of development.
Tile Conceptual Review Committee recommends approval of the plan, based
on the indicated changes."
City Manager Brunton also referred to a letter submitted by the developers of
Prospect Greens relative to their negotiations with the di.tch companies.
Prospect Greens representatives presented slides on the area in question and
answered questions of the public and Council. Other items discussed were a
pedestrian walk way to Bennett School, the need of the City and School.
Administrators to finding a solution to this problem, additional student
involved in this project and the desirability of cooperation between the
developers and the City to keep down dust, and related problems during con-
struction.`
Councilman Fead made a motion, seconded by Councilman Lopez, to approve the
Prospect Greens Plasm ed Unit Development Plan. Yeas: Councilmen Carson, Lopez,
Preble, Peterson and Fead. Nays: None.
Request denied for a one -hour parking
restriction on the north side of Walnut
Street between Linden and Chestnut
City Manager Brunton stated this item had been discussed by the Traffic
Committee, and that a better system than that of marking tires is:desirable
for enforcement of these restrictions. Furthel the Committee felt the two
hour parking was sufficient right now, therefore, the recommendation was
for denial.
Counci.lma.n Lopez :made a motion, seconded by Councilman. Fead, to deny the
request for a one -hour parking restriction made by W. D. widdows. Yeas:
Councilmen Carson, Lopez, Preble, Peterson an,] Fead. Nays: None.
Request approved for a one-haur parking
restriction on the west side of the
100 block on zouth side of Mountain
City Manager Brunton stated there was no easy answer to the parking problem,
once it was changed, it was just pushing the problem one block. This item
too had been discussed by the Traffic Committee, and the recommiendation was
to approve a one -hour parking restriction for the first 200 feet on the
south side of Mountain.
Councilman Fead,made a motion,seconded by Councilman Preble, to approve
the request as recommended by the City Manager. Yeas: Councilmen Carson,

Ordinance adopted designating the Nelson Milkhouse
as an Historic Landmark
Councilman Preble made a motion, seconded by Councilman Peterson, to adopt
Ordinance No. 19, 1973; on second reading. Yeas: Councilmen Carson, Lopez,
Preble, Peterson and. Fead. Nays: None.
ORDISANCE NO. 19, 1973
BEING AN ORDINANCE DMIGNATIING CERTAIN PROPERTY AS A LANDNAR;
WHEREAS, the Landmark Preservation Commission has, by Resolution,
recom:ended to is City Council, Inn designation of the property hereinafter
described as a landmark; and
WHEREAS, the owner of said property has consented to the designation
of the same as a landmark; and
WHEREAS, the City Council has reviewed the recommendation of the
Landmark Preservation Commission and has heard a report by the members of
said commission and desires to accept such recommendation and designate said
property as a landmark.
:JO'�i, THEREFORE, BE IT ORDAINED BY TIE COUNCIL OF THE CM OF FORT
COLLINS that the structure known as the Nelson Milkhouse, located on lands
described as follows, to -wit:
The Northeast corner of Tract J, Southmoor Village, a sub-
division of the City of Fort Collins, Colorado;
be and the same hereby is designated as a landmark in accordance with the
Ordinances of the City of Fort Collins.
Introduced, considered favorably on first reading, and ordered published

Request for Parking restrictions on
South Meldrun Tabled
City Manager Brunton stated more study was needed on the overall parking
situation and the study should be completed during the neat two months,
therefore, he recommended that this request either be denied or tabled pen3-
ing the study.
Councilman Preble made a motion, seconded by Councilman Lopez, to table the
matter pending the study. Yeas: Councilmen Carson, Lopez, Preble, Peterson,
and Fead. Nays: None.
Request of the American Public Power Association
for participation in research program
Approved
City Manger Brunton stated the administration endorsed the system. The
specific request was for a contribution of $3,000 to apply for research
monies for the Electric Power Research Institute. Mr. Brunton added we must
work together on the local level or have a. surtax imposed by the.Pederal
Government and recommended the approval of the $3,000.
Councilman Preble spoke to the question of the setting out a formula, the
i.nade quate contributions and the possibility of changing the formula so
that everyone is contributing.
Councilman Pead pointed out this contribution should be made for two reasons,
(1) the research would guarantee adequate amounts of power and (2) the hope
that power would be cheaper because of the research.
In response to a citizen enquiry to allow the electorate to decide on
amounts of contribution and places where they would be used. Councilman
Lopez read.. a portion of a statement by Dr. Chauncey Starr, President of the
Electric Power Research Institute below:
"In the past decade we have passed from a period of environmental innocence
to one of national concerns which have significantly altered our R&D priorties.
i'de now have a pressing need for coordinated national planning of all energy
services, and of electricity supply in particular. Because of the long lead
time for altering and improving these systems, we now must plan decades ahead.
In view of the variety,of future technologies in the R$D pipel-ine (like
fusion, and solar power, for example): and the uncertain feasibility of a
n].urality of near term engineering concepts (such as pollution abatement, and
coal gasification), it is now essential that the utility industry mo.i.ntain
an overview of, and participation in, all technical areas so as to keep its
options open and to move flexibly in new untraditional directions".
Councilman Lopez made a motion, seconded by Councilman Preble, to approve the
recommendation of the City Manager and approve the request for a contribution
of $3,000. Yeas: Councilmen Carson, Lopez, Preble,-Peterson and read. gays:

Resolution adopted establishing a deferred
Compensation Plan for the City Manager
City Manager Brunton stated this was part of his original agreement and was
just a realocation of his salary. He further stated it is the first time the
Internal Revenue Service has allowed this deferrment for City 'Managers.
Councilman Preble made a motion, seconded by Councilman Lopez, to adopt the
resolution establishing a deferred compensation Plan for the City Manager. .Yeas:

ESTABLISHING A DEFERRED CO19PENSATION PLAN FOR THE CITY MANAGER
WHERFAS, the City has in its employ, ROBERT L. BRUNTON, in the position
of City Manager; and
WHEREAS, the said Robert L. Brunton is and will be rendering valuable
s ;rvices to the Cit,'; and
WHEREAS, the City has considered the establishment of a deferred compen-
sation plan for the City Manager, Robert L. Brunton. made available :io the Cit-v
and to the City Manager by the International City Management Association Retirement
Corporation; and

WHEREAS, certain income tax benefits accrue to the City Manager through
participation in said plan; and
WHEREAS, the City recognizes ths,, the, tax advantages of said plan to the
City Manager constitute a benefit to the City by allowing the City to offer an
additional "fringe benefit" in recruiting and retaining qualified personnel in its
employment at no charge or cost to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that ':he City of Fort Collins establis:, the said Deferred Compensation Plan
for the City Manager, Robert L. Brunton, and for this purpose, agree to the following:
A. The Trust Agreement with the International City Management Association
Retirement Corporation, attached hereto as Exhibit "A"; and
B. The Deferred Compensation Employment Agreement attached hereto as
Exhibit "B".
both of which are approved and adopted; and
BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they hereby
are, authorized and directed to execute such'agreements.for and on behalf of the
City of Fort Collins.

Bid awarded for eighty Streetlights
City Manager Brunton referred to a memorandum from Senior Electrical Engineer,
Bob Rost, in which he stated the bid submitted by Mine and Swelter Industries
in the amount of $6,640 meets specifications and acceptance of their bid is
recoinitended .
Councilman Preble made a motion, seconded by Councilman Lopez, to approve the
reco)nnendations and award the bid as recommended. Yeas: Councilmen Carson,
Lopez, Preble, Peterson and Fead. Nays: None.
Revision to No. 14 to USBR Contract and now schedule
to Platt River Municipal Power Association Contract

The first Revision No. 14 to EXI'nibit A,- USBR Contract No. 14-06-700-6155
is the standard six month revision. City Manager Brunton stated the new
schedule with the Platt River Municipal Power Association (Schedule or rates
for lvholesale Firm Power Service) was a landmark for the City of Fort Collins.
Councilman Peterson made a motion, s-eccnded by Counci.ln-n Fead, to approve
the revision and the new schedule as recommended. Yeas: Councilmen Carson,
Lopez, Preble, Pererson and Fead. Nays: None.

Report on Sidewalk on Prospect Street
near Fox Shopping Center
City Manager Brunton referred to a memorandums.from Roy Bingiian, City P-2igineer,
in :which he reported there is an area at about the 200 or 300 block on Prospect
where sidewalk had never been installed.
Mr. Pat Griffin of Gasamat, had indicated he would install sidewalk if the
University would. Theiefore, lie requested official direction to contacL Mr.
Terry Suber of Colorado State University' to encourage the,: to install the side-
walk.
Councilman Fead made a motion, seconded by Councilman Peterson, to direct the
administration to pursue the request for installation of sidewalk with
Colorado State University. Yeas. Councilmen Carson, Lopez, Preule, Peterson
and Fead. Nays: None.
Announcements
City Manager Brunton introduced Ann Sachs, who has been hired as an Administration
Assistant to work primarily in the Personnel section. The City Manager
reviewed her academic back ground. Mayor Carson welcomed her to the City and
stated the Council was looking forward to having her work with us.
Mayor Carson stated lie would like to suggest the name of Charles Shepardson
to fill a vacancy on the Retirement Board.
Councilman Preble spoke in favor of the nomination as she felt Mr. Shepherdson
was well qualified.
Councilman Preble made a motion, seconded by Councilman Fead, to ief,�r the matter
to the City Attorney to prepare a resolution of appointment of bir. Shepardson
to the Retirement Committee. Yeas: Councilmen Carson, Lopez, Preble, Peterson
and Fead. Nays: None.

Councilman Lopez made a motion, seconded by Councilman Fead, to adjourn the
Council meeting of March 1, 1973. Yeas: Councilmen Carson, Lopez, Preble,
Peterson and Fead. Nays: None.
